This letter is in response to your inquiry concerning whether a junk and salvage yard
operation would be permitted in the Julien Dubuque Drive Planned Unit Development
District. Attached to this letter are three ordinances - 17-84, 2-91 and 75-92.
Ordinance 17-84 established the Julien Dubuque Drive PUD District. Section A of the
Ordinance indicates that any principle permitted accessory or conditional use
permitted in the Heavy Industrial District shall be permitted, provided such use
conforms with Section 4-121 of the Planned Industrial District ofthe Zoning
Ordinance, except as provided hereafter. Section E of Ordinance 17-84 establishes
additional standards, including Subsection b that states in part, "outdoor storage of
materials and equipment, providing that such storage areas are visually screened.
Screening shall be completely opaque fence, wall or other feature not exceeding a
height of ten (10) feet measured from the adjacent ground level. Shrubbery and/or
other plantings may be substituted for opaque fencing, if designed and planted to
eventually screen the area from off-site visibility. In such cases, if the initial plants are
of a six (6) foot height or greater, the requirements for other opaque screenings shall
be omitted."
In addition to the screening requirements contained in the PUD Ordinance, Section
29-6 of the Municipal Code also stipulates screening requirements for junk
yard/salvage operations. A copy of that section of the Municipal Code is attached for
your review.
On January 7, 1991, Ordinance 02-91 was adopted, which amended Ordinance 17-
84. The Ordinance amendment specifically addressed parcel D, which is in an area
on the north side of Julien Dubuque Drive that had previously been designated as
areas for open space only. Parcel D was also given a different list of permitted uses,
specifically those uses number 1 thru 52, inclusive, in the Heavy Industrial District.
The other portions of the industrial park designated for industrial uses or allowed any
uses that were listed in the Heavy Industrial District section of the Zoning Ordinance.

Ordinance No. 17-84 and Ordinance 02-91 were amended on October 5,1992 by
Ordinance 75-92. This Ordinance modified the parcels where industrial development
could occur by including a new Parcel B on the north side of Julien Dubuque Drive.
Parcel D and Parcel B were again limited to those uses numbered 1 thru 52, inclusive,
in the Heavy Industrial District. The other parcels on the south side of Julien Dubuque
Drive again were allowed any use permitted in the Heavy Industrial District.
Based on the three ordinances referenced in this letter and Section 29-6 of the City's
Municipal Code, a junk and salvage yard operation would be an allowed use within the
Julien Dubuque Planned Industrial District on parcels designated for industrial use.
The junk yard/salvage yard operation would be subject to the screening requirements
of the PUD Ordinance as well as Section 29-6 of the Municipal Code. Review of the
screening requirements would be done as part of the site plan review procedure
required by the Julien Dubuque PUD Ordinance. Because of the subject site's
location relative to U.S. Highway 61/151, it is very likely that a salvage yard operation
would need to be enclosed to effectively screen it from the highway.

set forth in Section 3-4.3 of the Code of Ordinances, Appendix A thereof, of
the City of Dubuque, Iowa; and
Whereas, the Zoning Commission recommended the concurrence of the City
Council and approval of said amended conceptual development plan; and
Whereas, the City Council has received the recommendation of the Zoning
Commission and held its own publiC hearing on said amended conceptual
development plan pursuant to required published notice; and
Whereas, the City Council has approved said amended conceptual
development plan subject to the same specific conditions and restrictions.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That Ordinance No. 2-91 be amended by repealing Section
2.A(I) thereof and enactin9 a new Section 2.A(I) in lieu thereof, as follows:

(3) Uses already established or pre--
viously existing on the effective date
of this Ordinance shall be permitted
and may be altered, enlarged,
expanded or modified provided that
the addition or change8 comply with
the standards contained herein.
(4) Any alterations or additioDB that
require an increue in the number of
trucks to facilitate the expanded use
may do so up to a maximum of twenty
perent (20%) increase above the num.
ber of trucks existing on the effective
date of this Ordinance. The percentage
increase does not include Beasonal fluc-
tuations nonnally 8880ciated with cer-
tain industries but does not include the
maximum number of trucks ll880Ciated
with the industrial use on a yearly
buis.
(5) Existing uses may be sold or
leased provided that the new use is not
an intensification of the current opera-
tion except that, such new usee shall
be given the same expansion opportun-
ities under this ordinance 88 the origi-
nal industry preceding it.
(6) Any city approved alternate
access, such a8 the Rockdale Road
Bridge, to the Julien Dubuque Drive
Planned Industrial District shall nul.

WHEREAS, proposed plans have
been duly prepared and approved by
the City Cnuncil of the City nf Dubu-
que. Iowa, and are now on file in the of-
fice of the City Clerk showing among
other things the plans, specifications
and form of contract for the improve-
ment. and an estimate of the cost for
the Chaplain Schmitt Memorial Island
Park and Recreation Complex;
Backstop, Dugout. and Interior Fenc-
ing.
BE IT THEREFORE RESOLVED
that the City Council deeIIl8 it ad-
visable and necessary for the public
welfare to make the herein mentioned
improvement. and unless interested.
persons at the time of the final con-
sideration of this proposed resolution
have filed objections with the City
Clerk to the prnpoaed plans, specifica-
tions. contract or estimated cost of the
improvement. they shall be deemed to
have waived all objections thereto.
Said improvement shall be con-
structed and done in accordance with
