Sealed bids were received for the University Avenue Culvert Extension and University
Avenue Sanitary Sewer Reconstruction Project. City Engineer Gus Psihoyos
recommends award of the contract to the low bidder, Tschiggfrie Excavating Co., in the
amount of $363,808.28, which is 14.14% over the estimate of probable cost.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolutions authorize the award of the construction contract for the
University Avenue Culvert Extension and Sanitary Sewer Reconstruction Project.
BACKGROUND
The University Avenue Culvert Extension and Sanitary Sewer Reconstruction
Project will provide for constructing a 12-foot by 12-foot box culvert under
University Avenue, the extension of the box culvert constructed as part of the
grading for the University Avenue Extension Project.
The project will also complete the relocation of the 24-inch diameter sanitary
sewer necessary for the University Avenue (roadway) Extension Project.
Horsfield Construction is currently under contract to do the paving for the
University Avenue Extension Project, a change order is recommended to extend
Horsfield's paving limits to include the area of street that would have been
reconstructed by the sanitary and storm sewer project. The cost of this change
order is estimated to be $37,375.
The City will coordinate the closure of University Avenue required for this project
with the closure required for the University Avenue (roadway) Extension Project.
It is anticipated that University Avenue will be closed to through traffic from June
12 through August 4, an eight-week period. This is two weeks longer than the
original estimate based on discussions with local contractors. The exact time
period of the closure is dependent upon the completion of the permitting and
right-of-way acquisition activities.
BID RESULTS
Sealed bids were received on the project on May 23, 2006. Tschiggfrie
Excavating Co. of Dubuque, Iowa, submitted the low bid in the amount of
$363,808.28. This amount is 14.14% over the estimate of probable cost. A
summary of the bid proposals received is as follows:

Although the City and its consultant, IIW Engineers & Surveyors, PC, have
communicated with the Iowa Department of Natural Resources (DNR) throughout
the design process to ensure that the Iowa DNR would approve a floodplain
development permit, a permit has yet to be issued for the project. As a result,
the contract shall be modified so that it will become invalid unless the Iowa DNR
issues a permit for the project within the next 120 days. One of the conditions of
each bid is that the bid is valid for a 30-day period. Tschiggfrie Excavating Co.
has agreed to extend the period that the bid is valid from 30 days to 120 days.
Engineering is in the final phase of acquiring a temporary construction easement
at the upper end of the culvert site. It is anticipated that this easement will be in
place within the next few weeks and will not effect the construction schedule.
RECOMMENDATION
Engineering recommends that the City award the contract to Tschiggfrie
Excavating Co. in the amount of $363,808.28.

The project will be funded with the Fiscal Year 2007 appropriation for the
University Avenue Culvert Extension Project (CIP 7201811) in the amount of
$225,000 and the University Avenue Sanitary Sewer Reconstruction Project (CIP
7101805) in the amount of $148,500. Additional funding in the amount of
$17,224 will come from the Fiscal Year 2007 Street Program and the balance of
funding will come from the Fiscal Year 2007 Storm Sewer
Improvements/Extensions Project (CIP 7201008) in the amount of $30,000 and
Fiscal Year 2007 General Storm Sewer Repairs (CIP 7201066) funds in the
amount of $32,070.28.
ACTION TO BE TAKEN
I recommend that the City Council adopt the attached resolutions awarding the
University Avenue Culvert Extension and Sanitary Sewer Reconstruction Project
to Tschiggfrie Excavating Co. in the amount of $363,808.28.

RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
Whereas, on the 26th day of April, 2006, plans, specifications, form of
contract and estimated cost were filed with the City Clerk of Dubuque, Iowa for
the University Avenue Culvert Extension and Sanitary Sewer Reconstruction
Project.
Whereas, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are
hereby approved as the plans, specifications, form of contract and estimated cost
for said improvements for said project.

RESOLUTION NO. 232-06
AWARDING CONSTRUCTION CONTRACT FOR THE UNIVERSITY
AVENUE CULVERT EXTENSION AND SANITARY SEWER
RECONSTRUCTION PROJECT
Whereas, sealed proposals have been submitted by contractors for the
University Avenue Culvert Extension and Sanitary Sewer Reconstruction Project
(the Project) pursuant to Resolution No. and notice to bidders published in
a newspaper published in the City of Dubuque, Iowa on the 5th day of May, 2006.
Whereas, said sealed proposals were opened and read on the 23rd day of
May, 2006, and it has been determined that the bid of Tschiggfrie Excavating Co.
of Dubuque, Iowa, in the amount of $363,808.28 was the lowest bid for the
furnishings of all labor and materials and performing the work as provided for in
the plans and specifications; and
Whereas, the City is required to obtain a permit from the Iowa DNR prior
to the commencement of any work on the Project; and
Whereas, Tschiggfrie Excavating Co. is willing to enter into a contract for
the Project with the express condition, that if the necessary Iowa DNR permit is
not issued within one hundred twenty days from the date of this resolution, that
the contract shall be deemed null and void and of no further force and effect.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the contract for the above improvement be awarded to
Tschiggfrie Excavating Co. on the express condition, and the contract shall
include a provision that so provides, that if the necessary Iowa DNR permit is not
issued within one hundred twenty days from the date of this resolution, that this
resolution and the contract shall be deemed null and void and of no further force
and effect.
Section 2. The Manager be and is hereby directed to execute a
contract on behalf of the City of Dubuque for the complete performance of the
work.
Section 3. That upon the signing of said contract and the approval of
the contractor's bond, the City Treasurer is authorized and instructed to return
the bid deposits of the unsuccessful bidders.

Whereas the City Council by Resolution No. 232-06 awarded the
construction contract for the University Avenue Culvert Extension and Sanitary
Sewer Reconstruction Project to Tschiggfrie Excavating Co.; and
Whereas Tschiggfrie Excavating Co. has submitted the attached executed
contract and bond.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
1. The contract and bond attached hereto are hereby approved.
2. The City Manager is hereby authorized and directed to execute the
contract on behalf of the City of Dubuque.

RE: University Avenue Culvert and Sanitary Sewer Extension
Gus:
Tschiggfrie Excavating Co. was informed on 30 May 2006 that there could be a
possible delay in obtaining the DNR permits needed for the University Avenue
Culvert & Sanitary Sewer Extension Project bid on May 23rd.
If awarded the project, Tschiggfrie consents to holding the unit prices established
in our bid dated May 23,2006 for up to 120 days or until the DNR issues the
appropriate permits, which ever is sooner. Tschiggfrie further agrees that should
the City fail to obtain the appropriate DNR permits within the 120 time period, the
contract and award of the project becomes null and void.

TschiggfTie Excavating Company has the experience, workforce and equipment to properly
complete this contract. Therefore, we recommend award of the University Avenue Culveli
and Sanitary Sewer Extension project to Tschiggfric Excavating Company in the amount of
$363,808.28,
The city's estimate for this project was $318,738,00. The low bid of $363,808.28 is
$45,070.28 or 14,14% above the estimate,
