Van Milligen, City Manager SUBJECT: Eagle Point Bluff Study - Consulting/Engineering Services On May 2, 2005, the City Council approved the selection of Kleinfelder, Inc. to provide professional consulting services for the Eagle Point Bluff Study. Kleinfelder found there is a high level of risk of a large-scale failure, and the risk has been increased because of the 2003 excavation that steepened the slope from 75 to 80 degrees and increased the height from 35 to 60 feet. While they found no fault with the actual blasting operation, striking the rock face with a track hoe and wrecking ball "exacerbated the instability of the rock slope." Kleinfelder made recommendations to stabilize the bluff based on the use of the property below the bluff: commercial, residential, and undeveloped. Stabilization is recommended for all three. Clearly more measures are recommended if the site is developed for commercial or residential use. Scaling loose rocks and removing trees from the brow of the bluff is recommended regardless of the use of the property below the bluff. The estimated cost to do the scaling and remove the trees is $61,000. The Fiscal Year 2007 Capital Improvement Program budget includes $350,000 to stabilize the bluff. This is the only bluff stabilization effort the City needs to undertake, as City Attorney Barry Lindahl recommends that any future development of the area below the bluff be contingent on the developer completing the remainder of the estimated $300,000 in bluff stabilization activities prior to any development. City Engineer Gus Psihoyos recommends City Council approval to hire Kleinfelder, Inc. to help develop bid documents to scale the loose rocks and remove trees from the brow of the Eagle Point Bluff slope and hire Kleinfelder to inspect the work as it is performed. Van Milligen City Manager DATE: June 1, 2006 RE: Eagle Point Bluff Study I have reviewed the May 18, 2006 memorandum from City Engineer Gus Psihoyos to you on the status of the Eagle Point Bluff Study. Included with the memorandum is a letter dated March 6, 2006 from Kleinfelder, Inc. to Gus Psihoyos concerning the risks of waiting to mitigate rockfall potential at Eagle Point Bluff until the Developer makes a determination of the use of the property. In the letter, Kleinfelder, Inc. recommends that the City proceed with scaling loose rocks and removing trees from the brow of the bluff at a total cost of $61,000. Kleinfelder, Inc. notes that although the City has implemented Kleinfelder's recommendations to have the area below the bluff fenced off to the public and the Engineering Department regularly inspects the site, the possibility of injury from a rockfall remains. By moving ahead with the scaling and tree removal, the possibility of injury resulting from rockfall is, as Kleinfelder, Inc. indicated, "low but not eliminated to the general public." I agree with that recommendation. Kleinfelder, Inc., in its Phase I Report, also made additional recommendations to stabilize the bluff based on the future use of the property below the bluff as commercial, residential, and undeveloped at a cost estimate ranging from $80,000 to $250,000. The oral ar~ument of the appeal in the lawsuit relating to Eagle Point Bluff is scheduled for June 15 h Thus, we will know within a matter of a month or two whether or not the Developer can proceed with development of the condominium project. An alternative to the City proceeding with the stabilization recommended by Kleinfelder, Inc., is to require that the Developer implement the stabilization recommendations before any development of the property is allowed, regardless of the outcome of the Supreme Court appeal. Van Milligen, City M~ljP~ Gus Psihoyos, City Engineer J'iJ SUBJECT: Eagle Point Bluff Study - Consulting/Engineering Services INTRODUCTION The purpose of this memo is to seek authorization to hire Kleinfelder, Inc. to help develop bid documents to scale the loose rocks and remove trees from the brow of the slope and hire them to inspect the work as it is performed. BACKGROUND On May 2, 2005, the City Council approved the selection of Kleinfelder, Inc. to provide professional consulting services for the Eagle Point Bluff Study. In November of 2005, Kleinfelder, Inc. completed Phase I of the Eagle Point Bluff Study and presented its findings in two documents: 1. Eaqle Point Bluff Study Phase I - Rock Slope Investiqation This document is an unabridged guide to the Study and it includes the engineering methods, testing, and analysis used to perform the bluff investigation and establish recommendations. 2. Eaqle Point Bluff Study Phase I - Rock Slope Investiqation Citizen Guide This document contains a condensed version of the investigation. The technical aspects of the engineering behind the Study are not included. At a City Council Work Session held on January 12, 2006, Kleinfelder presented the project background, their evaluation, and stabilization recommendations. Kleinfelder found that there is a high level of risk of a large-scale failure. Options include controlled blasting, slope scaling, rock bolts, horizontal drains, and wire mesh slope protection. Cost estimates range from $80,000 to $250,000. Scaling loose rocks and removing trees from the brow of the bluff is recommended regardless of the use of the property below the bluff. On Friday 13, January 2006, Kleinfelder re-visited the Eagle Point Bluff site to review the need for fencing to secure the area. While at the site he observed what appeared to be a recent rock fall from the brow of the rock slope about 210 feet from the south end of the bluff. He observed one large rock block measuring about 4x4x4 feet along with smaller blocks. In a letter from Kleinfelder dated January 16, 2006, Kleinfelder recommended that the City "scale the loose rocks from the complete bluff face to reduce the risk of rockfall and remove trees from the brow of the slope to reduce the prying action by trees" that can induce rockfall. DISCUSSION In a letter dated March 6, 2006, Kleinfelder's presents its professional opinion that "there is a high probability that an additional rockfall event may occur." Although the City has implemented Kleinfelder's recommendations to have the area below the bluff fenced off to the public and Engineering regularly inspects the site, Kleinfelder asserts that the possibility of injury (from a rockfall) remains. They recommend that the City "scale the loose rocks from the rock cut . . . and remove trees from the brow of the slope." At the January 12, 2006 City Council Work Session, Kleinfelder presented several options to stabilize the bluff. And the options varied slightly depending on the use of the property below the bluff. But all of the options included scaling the loose rocks from the rock face and removing the trees from the brow of the slope. This was presented on page 10 of the Eagle Point Bluff Study, Phase I - Rock Slope Investigation - Citizen Guide. As presented therein, the estimate of probable construction cost for each scenario is: Scenario 1 & 2 - Commercial and Residential Zonina . Option 1- Scaling, tree removal, and controlled blasting: z$80,000 . Option 2 - Scaling, tree removal, rock bolts, wire mesh and horizontal drains: z$100,000 . Option 3 - Scaling, tree removal, rock bolts, Tecco Mesh and horizontal drains: z $250, 000 Scenario 3 - Undeveloped . Option 1 - Scaling, tree removal, and controlled blasting: z$80,000 . Option 2 - Scaling, tree removal, rock bolts and horizontal drains: z $90,000 The estimated cost to do the scaling and remove the trees is as follows: Construction (Scaling & Tree Removal) Contingency Engineering $38,000 8,000 15,000 $61.000 Total Project Cost With the adoption of the FY2007 Capital Improvement Program Budget, $350,000 was set aside to stabilize the bluff if deemed appropriate by the City Council (CIP 1021825). RECOMMENDATION Engineering concurs with Kleinfelder's recommendation to proceed with scaling the loose rock from the bluff and removing 15 to 20 feet of trees from the brow of the slope. To that end, Engineering recommends that the City hire Kleinfelder, Inc. to help develop bid documents for work. Following the preparation of the bid documents, authorization would be sought from the City Council to initiate the public bidding process to perform the scaling and tree removal. Upon award, Engineering recommends that the City utilize Kleinfelder's expertise to inspect the work as it is performed. ACTION TO BE TAKEN I respectfully request City Council approval to hire Kleinfelder, Inc. to help develop bid documents to scale the loose rocks and remove trees from the brow of the slope and hire them to inspect the work as it is performed. Schneider City Hall 50 W. 13th Street Dubuque, IA 52001 Dear Mayor Buol and City Council Members: Both Sara Sutton and I were astounded by the Telegraph Herald report on Sunday that the City would be paying anything at all, much less a substantial sum for the damage caused to the bluffs by A.J. Spiegel and Royal Oaks Development. There are two indemnification agreements entered into by the City and Royal Oaks Development obliging Royal Oaks to protect the City on any damage to the bluffs. We are attaching those documents to this letter, one dated September 8, 2003 and signed by City Manager VanMilligen and A.J. Spiegel and the other being a Blasting Permit from September 2003 which included a certificate ofliability insurance listing the City of Dubuque as an additional insured. The license which the City gave to Royal Oaks was conditioned upon Royal Oaks assuming all liability and to pay on behalf of the City of Dubuque all sums which the City would be obliged to pay, as well as indemnify and hold the City harmless from all claims. Why then should the City voluntarily agree to assume obligations which Royal Oaks Development assumed? The second question is, have these documents never been submitted by the City Manager to the City Council? Both of these documents and their obligations must be addressed and neither can be explained away. Our attorneys have submitted these documents many months ago to both the City Manager's office and the Telegraph Herald. For reasons unknown to us the Telegraph Herald never followed up on these questions which were raised some time ago. It now appears that the tax payers are going to be saddled with an obligation resting with Mr. Spiegel. Why?
