Van Milligen, City Manager FROM: Mary Rose Corrigan, RN, Public Health Specialist SUBJECT: Animals on Unoccupied Residential Properties INTRODUCTION This memorandum submits an Ordinance for City Council consideration prohibiting the keeping of cats and dogs on unoccupied residential property. BACKGROUND The Health Services Department occasionally receives complaints regarding the mistreatment of dogs and cats being housed at unoccupied and/or vacant residential property. Often the minimal standards of care for dogs and cats are maintained, but monitoring of the animals is difficult. These animals tend to create other nuisances, such as barking, when the owner is not present. DISCUSSION An Ordinance prohibiting the keeping of cats and dogs on unoccupied residential property would provide the tools necessary to enforce nuisances often created by theses animals, ultimately decreasing neighborhood complaints. The Dubuque Regional Humane Society and City Animal Control respond to complaints regarding the welfare of these animals housed on the unoccupied property. However, it is difficult for the Humane Society and City Animal Control to monitor animals at unoccupied residences on a daily or frequent basis. RECOMMENDATION I recommend adopting the attached Ordinance which would prohibit the keeping of cats and dogs on unoccupied residential property. CITY COUNCIL ACTION Adopt the attached Ordinance. Chapter 7 of the City of Dubuque Code of Ordinances is hereby amended by adopting the following new section: 7-29: Keeping of Cats or Dogs on Unoccupied Residential Property Prohibited The owner of unoccupied residential property shall not keep or allow to be kept on the property any cats or dogs. For purposes of this provision, unoccupied shall mean that the property is not the primary residence of the property owner or any other occupant. Section 2.
