The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your
review.
Discussion
The applicant spoke in favor of the request, reviewing the changes to the subject
property and number of lots being created.
Staff reviewed the history of zoning changes to the site and the availability of city
utilities to the subject property.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the submitted plat
is consistent with the City of Dubuque Subdivision Regulations.
Recommendation
Bya vote of 5 to 0, the Zoning Advisory Commission recommends that the City
Council approve the request.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION NO. 267 -06
RESOLUTION APPROVING THE FINAL PLAT OF SEIPPEL ROAD COMMERCIAL
PARK, PLAT 2, IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Final Plat of Seippel Road
Commercial Park, Plat 2, in the City of Dubuque, Iowa ; and
Whereas, said Final Plat has been reviewed by the Zoning Advisory Commission and
had their approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Final Plat of Seippel Road Commercial Park, Plat 2, is hereby
approved and the Mayor and City Clerk are hereby authorized and directecl to endorse the
approval of the City of Dubuque, Iowa upon said Final Plat.
Section 2. That prior to the issuance of a building permit on any lot, a waste water
treatment system which meets all state and local codes, must be designed by a professional
engineer and approved by the Engineering and Health Departments of the City of Dubuque. A
permit must be obtained for the private sewage system from the City of Dubuque Health
Department prior to construction. All lots within this subdivision shall connect to the City sanitary
sewer system within five (5) years after the connection to the interceptor sewer has been made
or sooner if the private sewage system(s) fails. Payment of interceptor fees shall be paid by the
owner of each lot prior to connection.

SUBJECT: Final Plat Seippel Road Commercial Park Plat NO.2
INTRODUCTION
James F. Kress has submitted a final plat for Seippel Road Commercial Park Plat NO.2
that resubdivides the northern portion of the subject property to facilitate development of
the R-2 Two-Family Residential zoned properties fronting on Old Highway Road. The
Zoning Advisory Commission previously reviewed the preliminary plat for this
subdivision in December 2003 and the City Council approved the final plat in October
2005.
DISCUSSION
The submitted final plat of Seippel Road Commercial Park, Plat NO.2 principally
subdivides the R-2 lots fronting on Old Highway Road from five lots into eight lots. The
replatting also reduces the lot depth of these lots from 219 feet to 180 feet. Access for
these lots will be from Old Highway Road.
City water is currently available to the site while City sanitary sewer service terminates
approximately one mile from the subject property. The Engineering Department is in
the process of updating the capital improvement program and is evaluating alternatives
for bringing sanitary sewer to the subject property. In the interim, subject to approval by
Engineering and Health Departments, the development of lots will require septic
systems to be installed in a manner that when the sanitary sewer is available, they can
readily be hooked up to the City sewer line.
RECOMMENDATION
Planning staff recommends the Zoning advisory Commission approve the submitted
final plat of Seippel Road Commercial Park, Plat NO.2 as it is in substantial compliance
with City of Dubuque Subdivision Regulations.
