SUBJECT: Cable TV Tele-Programming Amendment
Cable TV Coordinator Craig Nowack recommends City Council approval to amend
Section 44-219(a) of the City of Dubuque Code to set the quorum for the Community
Tele-Programming Commission to four members of the seven member Commission.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to recommend amending Sec. 44-219 (a) of the
City of Dubuque Code which requires that five (5) of the seven (7) members of the
Cable TV Community Tele-Programming Commission be present to constitute a
quorum.
BACKGROUND
Back in 1976 the Dubuque City Council created the Cable Television Community Tele-
Programming Commission to help assure that the resources dedicated to community
programming were used effectively, efficiently, and economically. The City Council saw
fit to create a commission of seven (7) members, of which five (5) must be present to
constitute a quorum.
It can be difficult, especially during the summer months, to gather five commissioners
and hold a meeting. It can be even more difficult to do this when there are vacancies on
the commission.
I examined the City of Dubuque Code in the City Clerk's office this morning to see what
requirements it placed on some of the City's other boards and commissions. Although
the Code does not always explicitly state the number required for a quorum, of the 10
boards and commissions where it does, only the Community Tele-Programming
Commission requires more than a simple majority. Typically, a five (5) member
commission requires three (3) members for a quorum and a seven (7) member
commission requires four (4).
RECOMMENDED ACTION
I respectfully request that you recommend the City Council approve the attached
amendment to Section 44-219 (a) of the City of Dubuque Code so that a quorum of the
Community Tele-Programming Commission need only constitute four (4) members.

ORDINANCE NO. 51-06
AMENDING THE CITY OF DUBUQUE CODE OF ORDINANCES SECTION 44-
219(a) ESTABLISHING THE QUORUM FOR MEETINGS OF THE CABLE
TELEVISION COMMUNITY TELE-PROGRAMMING COMMISSION
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF THE
CITY OF DUBUQUE, IOWA AS FOllOWS:
Section 1. Section 44-219 (a) of the City of Dubuque Code of Ordinances
is amended to read as follows:
Section 44-219. Meetings; Procedures:
(a) The members shall meet as needed to conduct the business
of the Commission, but not less frequently than once each calendar
quarter. A quorum of four (4) members shall be required for
members to conduct the business of the Commission. All meetings
and proceedings of the Commission shall confonn with applicable
open meeting requirements.
Section 2. This Ordinance shall take effect upon publication.
