Minutes Housing Comm. 5 23 06 , MINUTES OF HOUSING COMMISSION MEETING DATE: TIME: PLACE: 23 May 2006 4 p.m. Housing and Community Development Department Chairperson Kapler called the meeting to order at 4:05 p.m. following staff assurance of compliance with Iowa Open Meeting Law. Commissioners Present: Angie Mozena Bill Helling Harry Neustadt Dave Kapler Char Eddy Jim Holz Dorothy Culbertson Dorothy Schwendinger, OSF Commissioners Absent: Danita Grant John Plein Staff Present: David Harris Joleen Patterson Janet Walker Tusdee Blus Public Present: None Review and Certification of Minutes of 25 April 2006 Commission Meetina Commissioner Eddy noted that she had not been listed as taking over the meeting after Chairperson Kapler left. She also requested that in the fourth paragraph, page two that her name be struck from the minutes with regard to counseling the homeowner applicant. Joleen Patterson also requested a modification in the first paragraph, page two by adding the sentence "At the request of the City, the bank purchased the property", after the phrase "and paid more than it is actually worth". Commissioner Eddy motioned to approve the 25 April 2006 meeting minutes with changes as submitted. Commissioner Schwendinger seconded. Roll call. Commissioners Mozena and Holz abstained. All others present in favor. Motion passed. Old Business Lending Policy Change for First-Time Homebuyers: Prior Year Ownership Waiver for Displaced Homemakers Joleen Patterson responded to the Commission's request for more information regarding the issue of divorcees becoming first-time homebuyers even though they may have already owned a home before. Janet Walker and Joleen provided documentation supporting IFA and HUD's stance on this subject, and what their current policies state. The Commission asked to add the following excerpt from the IFA program be added to section 7a of our current written Section 8 Administrative Policy: First-time Homebuyer: An individual or an individual and his or her spouse who have not owned a home during the prior 3-year period except that - (A) any individual who is a displaced homemaker may not be excluded from consideration as a first-time homebuyer under this paragraph on the basis that the individual, while a homemaker, owned a home with his or her spouse or resided in a home owned by the spouse; (B) any individual who is a single'parent may not be excluded from consideration as a first-time homebuyer under this paragraph on the basis that the individual, while married, owned a home with his or her spouse or resided in a home owned by a spouse..." Commissioner Holz motioned to approve the request to modify the Lending Policy for First-Time Homebuyers. Commissioner Eddy seconded. Roll call. All present in favor. Motion passed. , New Business Amendments to Section 8 Administrative Plan: Lifetime Sex Offender Registration Requirement Janet explained that the change, removing the term "lifetime" is to make the policy uniform, and asked that it be changed to state that "if required to register on any offender list" they are not eligible. She stated that this will not affect anyone in the future any differently than it has in the past; however, the language is clearer and meant to be consistent with all state laws. She noted that when any state changes its law, we may need to revisit our policy, but it is an administrative burden to continually check every state regarding their "lifetime" offender laws. Commissioner Holz motioned to approve the change in terminology. Commissioner Eddy seconded. Roll call. All present in favor. Motion passed. Termination Due to Monies Owed to Previous Landlord Janet stated that there are no HUD regulations allowing us to keep someone off of the Section 8 program if they owe monies to a previous landlord. Commissioner Culbertson asked if the landlord would have grounds to deny tenancy based upon prior problems the tenant may have had and Janet said that they would. However, there are no HUD regulations allowing us to get involved in any dispute between the tenant and that landlord. The landlord can ask the Housing Authority for information and we can then divulge certain information to them. Janet stated that we will notify the landlords of the change. Commissioner Holz motioned to remove the current policy language from the Administrative Plan. Commissioner Culbertson seconded. Roll call. All present in favor. Motion passed. Presentation: Sarah Davidson, President of Step by Step Sarah gave a PowerPoint presentation regarding the accessibility changes made to her residence at the Henry Stout Apartments. She stated that the focus was on the principles of usable design to ensure the space is actually functional and usable, which goes further than standard ADA requirements. Adiournment There being no further business to come before the Commission, Commissioner Holz motioned to adjourn the meeting. Commissioner Eddy seconded. Motion passed by acclamation.
