City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the Bee Branch Phase !Completion — 15th Street Project, as completed by
McDermott Excavating, in the final contract amount of $86,268.17, which is 4.8% below
the original contract amount of $90,612.90.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for Bee
Branch Phase I Completion — 15th Street Project.
BACKGROUND
The Bee Branch - Phase I Completion — 15th Street Project provided for the completion
of Phase I of the Bee Branch Creek Restoration Project. Due to design changes in the
channel between the basin and the 16th Street Bridge more properties were acquired
along 15th Street changing the scope of the project. This work was done under a
separate contract because the acquisitions required more time than the original contract
completion date allowed.

In accordance with Iowa Code § 384.103 and § 364.12(3)(c), and Iowa Code, Section
26.14, on August 28, 2012 the City solicited informal bids for the Bee Branch Phase I
Completion — 15th Street Project. McDermott Excavating of Dubuque, Iowa, submitted
the low bid in the amount of $90,612.90.
The project included: the removal of a portion of Maple Street, removal of a parking lot,
water main abandonment, the construction of stormwater intakes, 346 feet of curb and
gutter, 1,425 square feet of PCC sidewalk, street patching, finish excavation of slopes
and the surrounding area, placement of decorative stones, placement of topsoil, and the
seeding of all areas to match the rest of Phase I.
DISCUSSION
The Bee Branch Phase I Completion — 15th Street Project was completed by McDermott
Excavating of Dubuque, Iowa, in the final contract amount of $86,268.17. This is 4.8%
below the original contract amount of $90,612.90.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $86,268.17 to McDermott Excavating for the Bee Branch Phase 1
Completion — 15th Street Project.

ACCEPTING THE BEE BRANCH PHASE I COMPLETION — 15TH STREET PROJECT
AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Bee Branch Phase I
Completion — 15th Street Project (the Project) has been completed and the City
Engineer has examined the work and filed a certificate stating that the Project has been
completed according to the terms of the Public Improvement Contract and that the City
Engineer recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Bee Branch Restoration Project capital improvement appropriation for the contract
amount of $86,268.17 less any retained percentage provided for therein as provided in
Iowa Code chapter 573, and to pay such retainage only in accordance with the
provisions of Iowa Code chapter 573.
