Experience or education which qualifies you for this board or commission:: Over 35 years experience in
owning /managing rental properties. Most of my work involved in owning has entailed remodeling,
construction, and landlord responsibilities. I am acquainted with updating to any code revisions required
by the City and I have personally been involved in most of the hands on work of maintaining properties. I
am familiar with the procedure when an inspection requires further action to fulfill the requirements of
codes and time limits involved to complete a project. I am also familiar with the factors that can influence
whether a project can be completed in an allotted time frame due to the amount of work required, weather
related issues, or other issues that may be particular circumstantial problems for an owner.
What contributions can you make or state reason for applying ?: As a board member of the Dubuque Area
Landlord Association I have seen the value of partnering with the various City dept. heads and the results
of a cooperative spirit from both parties. I feel there is a way to accommodate needs of
landlords /property owners, as well as the needs of the City to keep buildings in good repair. I will try to
bring fairness to the table and be someone that can see a solution to the issue in question and work
toward that solution.

BUILDING CODE BOARD OF APPEALS
14 -1A -2: INTERNATIONAL BUILDING CODE AMENDMENTS: Zi
Sec. 113. Building Code And Advisory Appeals Board.
A. Board Created. There is hereby created a building code and advisory appeals board.
B. Mission. The mission of the building code and advisory appeals board shall be to
determine the suitability of alternative building materials and methods of building
construction, to provide for reasonable interpretation of the provisions of the building
code, and to advise the city council on all building construction regulations and
procedures.
C. Internal Organization And Rules. The board may adopt rules and regulations to
govern its organizational procedures as may be necessary and which are not in conflict
with city or state code.
D. Procedures For Operation. All administrative, personnel, accounting, budgetary, and
procurement policies of the city shall govern the board in all its operations.
E. Membership.
1. The building code advisory and appeals board shall consist of five (5) residents of the
city of Dubuque, appointed by the city council.
2. Special Qualifications.
a. One (1) member shall be an architect or engineer registered in the state of Iowa;
b. One (1) member shall be a general building construction contractor;
c. One (1) member shall be a journeyman carpenter; and,
d. Two (2) members shall be from the public at- large.
F. Terms. The term of office for members of the building code advisory and appeals
board shall be three (3) years. All officers shall be eligible to serve successive terms of
office.
G. Vacancies. Vacancies caused by death, resignation, or otherwise shall be promptly
filled by the city council for the unexpired term of office.
H. Officers /Organization. The board shall choose annually, from its own membership, a
chairperson and vice chairperson, each to serve a term of one (1) year. The building
official, or designee, shall be secretary of the board. The board shall fill vacancies
among its officers for the remainder of the unexpired term.
I. Meetings.
1. Regular Meetings. The building code advisory and appeals board shall meet upon
call of the chairperson, secretary or city manager.
2. Special Meetings. Special meetings may be called by the chairperson or at the
written request of three (3) members by giving at least twenty -four (24) hours notice to
every other member of the commission. The call for a special meeting shall include an
agenda and only matters included in that agenda may be acted on at the meeting.
3. Open Meetings. All meetings shall be called and held in conformance with the Iowa
open meetings law.
4. Attendance.
a. In the event a member of the building code advisory and appeals board, created by
this chapter, has been absent for three (3) or more consecutive meetings of the board,
without being excused by the chairperson, it shall be grounds for the board to
recommend to the city council that the position be declared vacant and a replacement
appointed.
b. Attendance shall be entered upon the minutes of all meetings.
5. Minutes. A copy of the minutes of all regular and special meetings of the board shall
be filed with the city council within ten (10) working days after each meeting.
6. Quorum. Three (3) members of the board shall constitute a quorum for the
transaction of business. The affirmative vote of at least three (3) members shall be
necessary for the adoption of any resolution.
J. Compensation. The members of the building code advisory and appeals board
created by this chapter shall serve without compensation, provided that they may
receive reimbursement for necessary travel and other expenses while on official board
business and such shall be within the limits established in the city budget.
K. Removal. The city council may remove any member of any board or commission
which it has established.
L. Powers. The building code advisory and appeals board shall have the following
powers, duties, and responsibilities:
1. Any person who is aggrieved by a decision of the building official on any
requirements resulting from the enforcement of the building code may appeal from such
decision to the building code board and said board shall serve as an appeal board. In
case the aggrieved party is a member of said board, said member shall be disqualified
as a member of the board acting as an appeal board, until the person aggrieved has
been heard and a decision rendered.
The appeal shall be made by the person aggrieved, giving written notice of such appeal
to the building official within seven (7) days of receipt of decision from which the appeal
is taken. The building code board sitting as an appeal board shall meet within ten (10)
working days after receiving such notice and render a decision within five (5) working
days thereafter. Any interested party, including the building official, shall have the right
to present their case to the appeal board, whose decision shall be final unless appealed
to the district court as provided by law.
The board of appeals may reverse or modify a decision of the building official only on
finding that:
a. The building official had incorrectly interpreted the provision of this code; or,
b. The decision of the building official creates an unnecessary hardship upon the
appellant.
The board of appeals shall require that sufficient evidence or proof be submitted to
substantiate any claims made regarding the use of alternates.
All appeal hearings shall be conducted in accordance with the procedures specified in
this code.
On issues before the board involving the Americans with disabilities act (ADA) the board
may elect to seek input from ADA advocates in the community. If the board elects to
seek input from ADA advocates in the community the board shall consult with a
minimum of two (2) individuals.
M. Limitations Of Authority. The board of appeals shall have no authority relative to
interpretation of the administrative provisions of this code nor shall the board be
empowered to waive requirements of this code.
In so modifying or reversing such decision of the building official, the board of appeals
may authorize any alternate to the decision of the building official and the provisions,
provided it finds the proposed material or method of construction is satisfactory for the
use intended and complies with the provisions of this code, and that the material,
method, or work offered is, for the purpose intended, at least equivalent to that
prescribed by this code in suitability, strength, effectiveness, durability, fire resistance,
and safety.
ORDINANCE NO. 6 -o8
AMENDING CHAPTER 11, BUILDINGS AND BUILDING REGULATIONS, OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY ADDING A NEW
ARTICLE VIII, ACCESSIBILITY CODE FOR READILY ACHIEVABLE
CHANGES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. Chapter 11 of the Dubuque Code of Ordinances is hereby
amended by adding the following Article VIII:
ARTICLE VIII. Accessibility Code for Readily Achievable Changes
Sec. 11 -84. Public accommodations.
A place of public accommodation means a facility whose operations fall within
one of the following categories:
(a) An inn, hotel, motel, or other place of lodging, except for an establishment
located within a building that contains not more than five (5) rooms for rent or hire
and that is actually occupied by the proprietor of such establishment as the
residence of such proprietor;
(b) A restaurant, bar or other establishment serving food or drink;
(c) A motion picture house, theater, concert hall, stadium or other place of
exhibition or entertainment;
(d) An auditorium, convention center, lecture hall or other place of public
gathering;
(e) A bakery, grocery store, clothing store, hardware store, shopping center or
other sales or rental establishment;
(f) A laundromat, dry- cleaner, bank, barber shop, beauty shop, travel service,
shoe repair service, funeral parlor, gas station, office of an accountant or lawyer,
pharmacy, insurance office, professional office of a health care provider, hospital
or other service establishment;
(g) A terminal, depot or other station used for public transportation;
(h) A museum, library, gallery or other place of public display or collection;
(i) A park, zoo, amusement park or other place of recreation;
(j) A nursery, elementary, secondary, undergraduate, or postgraduate private
school or other place of education;
(k) A day care center, senior citizen center, homeless shelter, food bank,
adoption agency or other social service center establishment; and
(I) A gymnasium, health spa, bowling alley, golf course or other place of
exercise or recreation.
Sec. 11 -85. Owner defined; Landlord and tenant responsibilities
For purposes of this Article, owner shall mean the owner of a building that is or
houses a place of public accommodation, a landlord who owns property that is or

houses a place of public accommodation, and a tenant who owns or operates a
place of public accommodation.
Sec. 11 -86. Removal of architectural barriers if readily achievable.
(a) It shall be a violation of this ordinance for an owner of a public
accommodation to fail to remove architectural barriers, and communication
barriers that are structural in nature, in any public accommodation, where such
removal is readily achievable. The phrase "readily achievable" shall have the
meaning set forth under the Americans with Disabilities Act of 1990 (42 U.S.C.
12182), as amended, and any implementing regulations.
(b) Where an owner can demonstrate that the removal of a barrier under
subsection (a) is not readily achievable, an owner shall nonetheless be required
to make existing facilities available through alternative methods if such methods
are readily achievable.
Sec. 11 -87. General Enforcement.
The building official is authorized to take such action as may be necessary to
enforce this Article.
Sec. 11 -88. Compliance agreements.
In lieu of or in addition to any penalty or procedure authorized herein or by law,
the building official and an owner accused of violating Chapter 11, Article VIII
may enter into a written agreement providing for the proper and timely abatement
of violations. A compliance agreement may include a description of the specific
action that will be taken to abate violations or to provide greater accessibility, a
compliance timetable, a requirement for performance security, notice procedures
and reporting requirements, liquidated penalties and other items reasonably
related to the proper and timely abatement of violations. A compliance
agreement shall constitute a written contract between the city and the owner
which may be enforced by any appropriate action at law or in equity, including an
action for specific performance or injunctive relief. A compliance agreement shall
run with the land and shall be recorded. The violation of a compliance agreement
shall constitute a separate violation of this Article. A compliance agreement shall
not relieve an owner from the continuing obligation to comply with this Article or
any other law or regulation pertaining to accessibility.
Sec. 11 -89. Notices and orders of building official
(a) Whenever the building official has inspected or caused to be inspected any
place of public accommodation and has found and determined that there exist
barriers whose removal is readily achievable, the building official shall
commence proceedings to cause the removal of such barriers.
(b) The building official shall attempt to reach an agreement with an owner
alleged to have violated this Article on a plan for proper and timely abatement of
violations. Such agreement shall be in writing signed by all of the owners and

the building official and shall include a description of the specific action that will
be taken by the owner to abate the alleged violations or to provide greater
accessibility, and a compliance timetable. A failure to abate the alleged
violations in accordance with the timetable shall constitute a municipal infraction.
(c) If the building official and an owner alleged to be in violation of this Article are
unable to reach agreement within 30 days of inspection, for the abatement of
the alleged violations, the building official shall issue a notice and order
directed to all of the owners of the public accommodation. The notice and
order shall include:
(1) The street address and a legal description sufficient for identification of the
premises upon which the building is located.
(2) A statement that the building official has found that barriers exist whose
removal is readily achievable.
(3) A statement of the action required to be taken as determined by the
building official. Such order shall require that all required permits be secured
therefor and the work physically commenced and completed within such time
as the building official shall determine is reasonable under all of the
circumstances, but not to exceed twelve months from the date of the order.
(4) Statements advising (a) that an owner may appeal from the notice and
order or any action of the building official to the building code and advisory
appeals board, provided the appeal is made in writing as provided in this
Article and filed with the building official within thirty (30) days from the date of
service of such notice and order; and (b) that failure to appeal will constitute a
waiver of all right to an appeal of the matter. The building code and advisory
appeals board shall follow the appeals and hearing process set forth in
sections 11 -26 and 11 -27 of this Chapter, except that the board shall be
supplemented with two additional members as described in section 11 -89 for
purposes of appeals under this Article.
(d) Service of the notice and order shall be made upon all persons entitled
thereto either personally or by mailing a copy of such notice and order by
certified mail, postage prepaid, return receipt requested, to each such person
at such person's last known address. If no address of any such person is
known to the building official, then a copy of the notice and order shall be so
mailed, addressed to such person, at the address of the building involved in
the proceedings and a summary of the notice and order shall be published in
a newspaper as defined in Section 618.3 of the Iowa Code published in and
having general circulation in the City. The failure of any such person to
receive such notice shall not affect the validity of any proceedings taken

under this section. Service by certified mail in the manner herein provided
shall be effective on the date of mailing.
(e) Proof of service of the notice and order shall be certified to at the time of
service by a written declaration under penalty of perjury executed by the
persons affecting service, declaring the time, date, and manner in which
service was made. The declaration, together with any receipt card returned in
acknowledgement of receipt by certified mail, or affidavit of publication, shall
be affixed to the copy of the notice and order retained by the building official.
Sec. 11 -90. Supplemental Membership on Building Code and Advisory Appeals
Board.
For purposes of enforcement of this Article, two additional members shall be
appointed by the City Council to the Building Code and Advisory Appeals Board.
The two additional members shall participate only in appeals under this Article.
The terms of the two additional members shall be three years.
Sec. 11 -91. Licenses and permits.
In addition to any other remedy provided herein or otherwise under law, the City
Manager, upon providing notice and an opportunity to be heard, may refuse to
issue to an owner any license or permit provided for by ordinance for a failure of
an owner to comply with this Article, and may condition, suspend or revoke any
license or permit provided for by ordinance for a failure of an owner to comply
with this Article .
Sec. 11 -92. Responsible parties.
Unless otherwise provided by regulations promulgated under the Americans with
Disabilities Act, all owners shall be jointly and severally responsible for
compliance with this Article.

Zoning Board of Adjustment
5 -3.1. Establishment of Board:
A Zoning Board of Adjustment is hereby established pursuant to chapter 414 of the
Code of Iowa, 1975. The word "board" as used in this Ordinance shall mean the Zoning
Board of Adjustment.
(A) Membership of the Board: The Board shall consist of five (5) members appointed by
the City Council.
(B) Term Of Office: Members of the Board shall be appointed for a term of five (5)
years, excepting that when the Board shall first be created, one member shall be
appointed for a term of five (5) years, one for a term of four (4) years, one for a term
of three (3) years, one for a term of two (2) years, and one for a term of one year.
(C) Removal: Board Members may be removed for cause by the City Council upon
written charges and after a public hearing.
(D) Vacancies: Vacancies on the Board shall be filled for the unexpired term of any
member whose term becomes vacant.
(E) Appointment to Airport Zoning Board of Adjustment: Two (2) members of the Board
shall be appointed by the City Council to serve on the Airport Zoning Board of
Adjustment. A member shall serve out the term on the Airport Zoning Board of
Adjustment even if the member's term on the Zoning Board of Adjustment has
expired.
5 -3.2. General Procedure:
(A) Meetings: Meetings of the Board shall be held at the call of the chairperson and at
such other times as the Board may determine. Such chairperson, or in the
chairperson's absence, the acting chairperson, may administer oaths and compel
the attendance of witnesses. All meetings of the Board shall be open to the public.
The Board shall keep minutes of its proceedings, showing the vote of each member
upon each question, of if absent or failing to vote, indicating such fact, and shall
keep records of its examinations and other official actions, all of which shall be
immediately filed in the office of the board and shall be a public record. The board
may in addition adopt general rules of procedure not inconsistent with the provisions
of this ordinance.
(B) Vote of the board. The concurring vote of three (3) members of the board shall be
necessary to reverse any order, requirement, decision or determination of any
administrative official, or to decide in favor of the applicant on any matter upon which
it is required to pass under this ordinance, or to effect any variation in such
ordinance, or to adopt, repeal, or amend any rule of procedure adopted pursuant to
this section.
5 -3.3. General Powers:
The board shall have the following powers:
(A) Appeals from the administrative official. To hear and decide appeals where it is
alleged there is error in any order, requirement, decision, or determination made by
an administrative official in the enforcement of this ordinance,
(B) Conditional uses. To hear and decide applications for conditional use permits upon
which such board is required to pass under this ordinance.
(C) Variances. To authorize upon appeal in specific cases such variance from the bulk
regulation provisions including parking and sign requirements of the ordinance as
will not be contrary to the public interest, where owing to special conditions a literal
enforcement of the provisions of the ordinance will result in unnecessary hardship,
and so that the spirit of the ordinance shall be observed and substantial justice done.
(D) Special exceptions. To hear and decide applications for special exceptions to the
terms of this chapter, in accordance with the general regulations of the zone in which
the property is located and specific standards contained herein.

69.16A Gender balance.
1. All appointive boards, commissions, committees, and councils of the state
established by the Code, if not otherwise provided by law, shall be gender balanced.
No person shall be appointed or reappointed to any board, commission, committee, or
council established by the Code if that appointment or reappointment would cause the
number of members of the board, commission, committee, or council of one gender to
be greater than one —half the membership of the board, commission, committee, or
council plus one if the board, commission, committee, or council is composed of an odd
number of members. If the board, commission, committee, or council is composed of
an even number of members, not more than one —half of the membership shall be of one
gender. If there are multiple appointing authorities for a board, commission, committee,
or council, they shall consult each other to avoid a violation of this section.
2. All appointive boards, commissions, committees, and councils of a political
subdivision of the state that are established by the Code, if not otherwise provided by
law, shall be gender balanced as provided by subsection 1 unless the political
subdivision has made a good faith effort to appoint a qualified person to fill a vacancy
on a board, commission, committee, or council in compliance with subsection 1 for a
period of three months but has been unable to make a compliant appointment. In
complying with the requirements of this subsection, political subdivisions shall utilize a
fair and unbiased method of selecting the best qualified applicants. This subsection
shall not prohibit an individual whose term expires prior to January 1, 2012, from being
reappointed even though the reappointment continues an inequity in gender balance.

New gender balanced bed1ils requirements for clues
Iowa has required gender balance on state -level boards and commissions for many years, under
Iowa Code section 69.16A. Last session, the General Assembly passed legislation that applies
this requirement to the local level. This Q &A explains background on the legislation, the new
requirements in the legislation for cities and how cities can comply.
Q: What are the new requirements for gender balance on city
boards and commissions?
A: During the 2009 legislative session, legislation (HF243) was
passed that extends to cities and counties gender balance require-
ment for all appointive boards, commissions, committees and
councils created by the Iowa code. In other words, bodies cities
are required to have under Iowa code when they provide certain
functions or services, such as the planning and zoning commission,
library boards and the board of adjustment, with appointed (not
elected) members, must be gender balanced.
Q: What does `gender balanced' mean?
A: Gender balance means if the body has an even number of ap-
pointees, it must be evenly made up of men and women. For exam-
ple, three women and three men must serve on a six member board.
If the body has an odd number of appointees, it must be "one half
plus one" of either gender. For instance, if there are five members,
three could be men and the other two women, or vice versa.
Q: When do the changes go into effect?
A: Cities must have gender balanced boards, commissions, com-
mittees and councils by January 1, 2012. This does not prohibit an
individual whose term expires prior to January 1, 2012, from being
reappointed even though the reappointment continues an inequity
in gender balance; however, cities should start planning upcoming
appointments now, to ensure gender balance is reached by that date.
Making a chart of existing boards and upcoming vacancies, and/
or keeping track of current appointments and necessary recruit-
ing periods would be a good start to ensuring your city is tracking
gender balance, and is prepared for the January 1, 2012 implementa-
tion date.
Q: Is there any option if my city simply cannot find a person to
serve on the board or commission of the needed gender?
A: Yes. Under the new code section, cities that make a good faith
effort to find a qualified person of the necessary gender to fill the
position for a period of three months and are unable to do so may
appoint a person to the position regardless of the gender balance
requirement.
Q: What constitutes a "good faith effort "?
A: There is no hard and fast definition, but cities should be able
to demonstrate a legitimate effort during the three month time
period to recruit qualified members of the necessary gender, before
appointing a member that creates gender imbalance. In addition,
the legislation requires that cities must always "utilize a fair and
unbiased method of selecting the best qualified applicants," regard-
less of gender.
Q: Is there a reporting requirement?
A: No. The legislation did not include a reporting requirement;
however, many cities keep information on their boards and
commissions — including current members- posted online, to better
inform citizens of the makeup of local governing bodies.
Q: How can I recruit more women or men to volunteer for
these positions?
A: The Commission on the Status of Women has prepared a guide
to help cities learn how to recruit gender balanced boards and com-
missions. This resource can be found at www.women.iowa.gov /
whats_new /index.html. The Commission also prepared a guide
called the "Five Step Guide to City and County Boards and How to
Get Appointed" to be used as a tool by interested women to learn
more about how to get involved in city boards and commissions.

Celebrating an environmental victory
FOX Engineering has received a 2008 Govemor's Iowa Environmental Excellence Award in the
Water Quality category. Undertaken for the city of North Liberty, this project involves a membrane
bioreactor method of treating wastewater and provides a significantly higher effluent water quality
compared to conventional wastewater treatment processes. Used on a limited basis in the U.S.
it is the first of its kind in Iowa. The city has certainly "gone the extra mile" to improve the water
quality in their receiving stream; they are to be commended for their foresight and respect for
