City Engineer Gus Psihoyos is recommending acceptance of the Heritage Trail
Extension Project - Phase II from the Heron Pond Wetlands to the Dubuque Jaycees
Trail, as completed by Tschiggfrie Excavating Co., in the final contract amount of
$292,269.14, which is a 7.9% decrease from the original contract award amount of
$317,368.51. .
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolutions provide for the acceptance of the construction contract for the
Heritage Trail Extension Project - Phase II from the Heron Pond Wetlands to the
Dubuque Jaycees Trail.
BACKGROUND
This portion of the Heritage Trail Extension Project - Phase II extends from 16th and
Kerper Boulevard at the end of the Dubuque Jaycees Trail to the Heron Pond
Wetlands Nature Trail located behind the Dubuque Greyhound Park. These two
portions linked the existing components of the Heritage Trail system and provided for
another section of off-road connection between the two existing trails.
DISCUSSION
The Heritage Trail Extension Project - Phase II from the Heron Pond Wetlands to the
Dubuque Jaycees Trail has been completed by Tschiggfrie Excavating Co. of Dubuque,
Iowa, in the final contract amount of $292,269.14, which is a 7.9% decrease from the
original contract award amount of $317,368.51.
RECOMMENDATION
I recommend that the City Council accept the improvements and establish the final
contract at $292,269.14.
BUDGET IMPACT
The project cost summary for both consultant services and the construction contract for
the Heritage Trail Extension Project - Phase II is as follows:

The DMATS STP TEA-21 Grant in the amount of $233,000 (eligible participating costs
(70%) for this project is $221,855.26) requires a 30% local match in the amount of
$95,567.88 in General Fund obligations for the Heritage Trail Project.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolutions accepting the
improvement and establishing the final construction cost for the Heritage Trail Extension
Project - Phase II from the Heron Pond Wetlands to the Dubuque Jaycees Trail.

CERTIFICATE OF COMPLETION

We hereby certify that we have made an on-site review of the completed
construction of the Heritage Trail Phase II under the Contract as performed
by Tschiggfrie Excavating Company of Dubuque, IA.
As Engineers for the project it is Veenstra & Kimm, Inc. 's opinion that the
work performed is in substantial accordance with the plans and
specifications and that the final amount of the construction improvement
contract is Two Hundred and Ninety Two Thousand- Two Hundred and
Sixty Nine and 14/100 Dollars ($292,269.14).
As Contractor for the project, Tschiggfrie Excavating Company accepts
$292,269.14 as the total due to the Contractor, as full settlement for all
claims for said improvements.
The total construction engineering cost for the project is Ten Thousand and
Thirty Two and 201100 Dollars ($10,032.20).
Therefore the total project construction cost for the Heritage Trail Phase II
project is Three Hundred and Two Thousand and Three Hundred and One
34/100 Dollars ($302,301.34).
I hereby certify that the above statement shows in detail the correct amount of all work
required to complete the above improvements.

RESOLUTION NO. 311-06
ACCEPTING THE HERITAGE TRAIL EXTENSION PROJECT - PHASE II
FROM THE HERON POND WETLANDS TO THE DUBUQUE JAYCEES TRAIL
Whereas, the contract for the Heritage Trail Extension Project - Phase II from the
Heron Pond Wetlands to the Dubuque Jaycees Trail (the Project) has been completed
and the City Manager has examined the work and filed a certificate stating that the
Project has been completed according to the terms of the contract, plans and
specifications and that the City Manager recommends that the Project be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Manager is approved and the Project
is hereby accepted.
Section 2. The City Treasurer is hereby directed to pay to the contractor from the
DMA TS STP TEA-21 Grant (STP-ES-2100 (631 )--81-31) in the amount of $221,855.26
and an appropriation from General Fund obligations for the Heritage Trail Project (30%
local match) in the amount of $95,567.88 for the contract amount in the amount of
$317,423.14 less any retained percentage provided for therein as provided in Iowa
Code chapter 573, and to pay such retainage only in accordance with the provisions of
Iowa Code chapter 573.
Passed, approved and adopted this 17th day of July, 2006.

Whereas, the construction contract for the Heritage Trail Extension Project -
Phase II from the Heron Pond Wetlands to the Dubuque Jaycees Trail has been
completed and the City Engineer has submitted his final estimate showing the cost
thereof including the cost of estimates, notices and inspection and all miscellaneous
costs.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the cost of said improvement is hereby determined to be
$317,423.14 and the said amount shall be paid from the allocation from the from the
DMATS STP TEA-21 Grant (STP-ES-2100 (631)--81-31) in the amount of $221,855.26
and an appropriation from General Fund obligations for the Heritage Trail Project (30%
local match) in the amount of $95,567.88 of the City of Dubuque, Iowa.
Passed, approved and adopted this 17th day of July, 2006.
