Dear Mr. McCaw,
We, as a board, would like to enquire as to our legal options regarding the developer's
non-compliance with city ordinances regarding storm water run-off and erosion in the
development of Asbury Plaza in the city of Dubuque and the City's non-enforcement thereof.
Over the years, the storm water run-off still appears to be a problem for the Asbury Plaza
development. We believe there are still many violations at this site and the developers are not
complying with applicable storm water run-off regulations. As county representatives, we
request that you follow up on this matter and file any necessary injunction against the developer
and/or the city to mandate compliance with applicable federal, state, county and city regulations
on behalf of the Dubuque Township Trustees.
As trustees, we are concerned about the lack of compliance since there appears to be more
land being developed and developers are requesting voluntary annexation into the City of
Dubuque within the next several weeks. Although the Board of Supervisors appear to have
approved this annexation, we feel that it is incumbent upon us as township trustees of Dubuque
Township that all developers meet the standards and requirements imposed upon them as a
condition for granting the necessary development permits. We strongly believe if they are not in
compliance, all further development should be ceased until such time as they are compliant.
