Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing lot layout and the extension of existing
public streets.
Staff reviewed the submitted plat noting that the subdivision's first phase was commenced in
the 1970s. The second phase is a configuration of the previously approved preliminary plat.
The extension of the existing public street will be in compliance with the City's subdivision
regulations.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that with approval of this
phase (20 lots), 61 single-family lots and 10 multi-family lots will be saved by a single access.
The Commission cautioned that any subsequent plat could be subject to obtaining a second
access into the project.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving the need for a preliminary plat.
A simple majority vote is needed for the City Council to approve the request.

Impact of Request on:
Utilities: Existing City utilities can be extended to serve the proposed lots.

Traffic Patterns: Access to the proposed lot is by way or Aerostar Drive with an
extension of Cessna Drive and Enstrom Court. No traffic counts are available for
these streets.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate storm water control is provided during all phases of
development.
Adjacent Properties: Adjacent property will most likely be impacted by the increase
in the amount of traffic on Aerostar Drive and the temporary impact of additional
construction activity.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted final plat of Terrace Estates 3rd Addition is located on
the City's north side near Peru Road. The preliminary plat for Terrace Estates
Subdivision was approved in March 1977. The first phase was approved in August of
1977.
The City's subdivision regulations, Section 42-14(d)(2), specifies that approval of a
preliminary plat shall remain in effect for a period of two years.
The submitted final plat for Terrace Estates 3rd Addition subdivides approximately
seven acres into 20 new single-family building lots. The subdivision includes the
extension of two existing public streets - Cessna Drive and Enstrom Court. Both
streets are currently stub streets without temporary cul-de-sacs.
There are currently 25 single-family homes built in Terrace Estates Subdivision with 16
single-family lots vacant and 10 R-4 Multi-Family residential district lots vacant. If all the
existing and proposed platted lots were to be built, the number of residences served by
a single access would exceed that which normally the City desires. The original
preliminary plat for Terrace Estates, a copy of which is attached to this staff report,
indicates that 111 single-family lots and 10 multi-family lots would be served by a single
access from Peru Road. A potential second access, dependent on future development
of adjacent property, was possible when Aerostar drive was stubbed to the western
property line of the subdivision. The property to the west of this subdivision is now
developed as part of the Alpine Heights Mobile Home Park and there is no potential for
a second access coming from that direction. In addition, property immediately north of
the subdivision is developed for Terrace Heights Mobile Home Park and there is no
potential for a second access at that point.

Planning staff is supportive of approving the final plat of Terrace Estates 3rd Addition
with the single access to Peru Road. The submitted final plat completes Cessna Drive
and Enstrom Court as originally envisioned by the preliminary plat and would provide
better circulation within the subdivision itself. Planning staff would caution, however,
future development of Terrace Estates Subdivision could be contingent on finding a
second access for the subdivision.
The submitted final plat for Terrace Estates 3rd Addition will comply with the City of
Dubuque's storm water control requirements even though when originally platted in
1977, there were no such requirements on residential subdivisions. Planning staff is
supportive of waiving the requirement for a new preliminary plat, as the submitted final
plat for Terrace Estates 3rd Addition is consistent with the preliminary plats approved in
1977. However, it is Planning staffs position that further development beyond the 3rd
Addition of Terrace Estates should be contingent upon exploring every opportunity for
providing a second means of access into this subdivision.
Recommendation
Planning staff recommends that the Zoning Advisory Commission approve the final plat
of Terrace Estates 3rd Addition subject to waiving the requirement for a preliminary plat.

RESOLUTION NO. 341-06
A RESOLUTION APPROVING THE FINAL PLAT OF TERRACE ESTATES THIRD
ADDITION, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a final plat of Terrace Estates
Third Addition, in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears streets to be known as Cessna Drive (Lot
A) and Enstrom Court (Lot B) together with certain public utility easements, which the
owners by said final plat have dedicated to the public forever; and
Whereas, the Final plat has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon, subject to the owners agreeing to the conditions noted in
Section 2 below; and
Whereas, said final plat has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating to it, except that no streets or public
utilities have yet been constructed or installed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Cessna Drive (Lot A) and Enstrom Court (Lot
B), together with the easements for public utilities and storm sewer as they appear upon
said final plat, be and the same are hereby accepted; and
Section 2. That the final plat of Terrace Estates Third Addition is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse

the approval of the City of Dubuque, Iowa, upon said final plat, provided the owners of
said property herein named, execute their written acceptance hereto attached agreeing:
(a) To reduce Cessna Drive (Lot A) and Enstrom Court (Lot B) to grade and to
construct concrete curb and gutter and to hard surface with asphaltic concrete, or
with concrete paving with integral curb, all in accordance with the City of Dubuque
standard specifications, all in a manner acceptable to the City Engineer, in
conformance with construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(b) To install water mains and water service laterals into each individual lot, sanitary
sewer mains and sewer surface laterals into each individual lot, storm sewers and
catch basins, boulevard street lighting and erosion control devices all in
accordance with the City of Dubuque standard specifications, all in a manner
acceptable to the City Engineer, and in accordance with construction
improvement plans approved by the City Engineer, and inspected by the City
Engineer.
(c) To construct said improvements, prior to two (2) years from the date of
acceptance of this resolution, at the sole expense of the owners, or future owner;
(d) To maintain the public improvements, for a period of two (2) years from the date
of the acceptance of those improvements by the City of Dubuque, Iowa, at the
sole expense of the owners, or future owner;
And, further provided that said Galen Manternach, as owner of said property, shall
secure the performance of the foregoing conditions provided in this Section by providing
guarantees in such form and with such sureties as may be acceptable to the City
Manager of the City of Dubuque, Iowa.
Section 3. Sidewalk installation shall be the responsibility of the owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code 41-161 through 41-164. The responsibility shall extend to all successors,
heirs and assignees. Sidewalk installation will not be required until the development of
the lot has been completed, except as required herein. In sparsely developed
subdivisions, sidewalks on developed lots will not be required until 50% of the lots
approved by the plat have been developed. All vacant lots shall have sidewalks
installed upon development of 80% of the lots approved by the plat.
Section 4. That the final acceptance of all public improvements shall occur
upon certification of the City Engineer to the City Council that all public improvements
have been completed in accordance with the improvement plans and City standard
specifications and accepted by City Council Resolution.
Section 5. That in the event Galen Manternach fails to execute the
acceptance and furnish the guarantees provided in Section 2 hereof within 180 days

after the date of this Resolution, the provisions hereof shall be null and void and the
acceptance of the dedication and approval the plat shall not be effective.

Manternach, managing partner) for a sum not to exceed $329,924.65
effective immediately and expiring on the close of business on August 3,
2007.
Funds under this Letter of Credit are available to you by your sight draft on
Nekoosa Port Edwards State Bank, 405 Market Street, Nekoosa, WI 54457
by submitting a sworn statement that the City has not accepted all of the
public improvements required under Resolution No. 341-06 for Terrace
Estates Third Addition and/or said improvements have not been maintained
for the two-year maintenance period following City acceptance.
Your draft shall contain the clause "drawn under the Nekoosa Port Edwards
State Bank Letter of Credit # 2115, dated August 3, 2006." The original
Letter of Credit must accompany any draft that exhausts the credit and must
be surrendered concurrently with the payment of such draft.
We hereby engage with the drawers, endorsers, and bona fide holders of
drafts, under and in compliance with the terms of this Letter of Credit, that
the same shall be duly honored upon presentation and delivery of the
documents specified to Nekoosa Port Edwards State Bank. It is a condition
