City Engineer Gus Psihoyos recommends City Council rescission of Resolution No.
139 -13, resulting in the cancellation of the public bidding process for Phase 1 of the 30
Inch Force Main Relocation Project from 9til Street to 11th Street. The project will be re-
initiated at a future City Council meeting once the plans and specifications have been
updated to reflect the Statewide Urban Design and Specification (SUDAS). City staff
will take the necessary steps in response to some environmental contamination that
exists in the area and then initiate this project again.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for City Council consideration the rescission of
Resolution No. 139 -13 resulting in the cancellation of the public bidding process for
Phase I of the 30 inch Force Main Relocation Project from 9th Street to 11th Street .
BACKGROUND
The public bidding process for Phase I of the 30 inch Force Main Relocation Project
from 9th Street to 11th Street was approved and initiated at the May 6, 2013 City Council
Meeting. The Public Hearing is currently scheduled for Monday, May 20, 2013 during
the regular meeting of the City Council. The bid letting is currently scheduled for May
23, 2013.
DISCUSSION
The Engineering Department is recommending the cancellation of the public bidding
process for Phase I of the 30 inch Force Main Relocation Project from 9th Street to 11th
Street through the rescission of Resolution No. 139 -13 which gave preliminary approval
of the proposed plans, specifications, form of contract, estimated cost, set the date for
the Public Hearing and ordered the advertisement for bids for Phase I of the 30 inch
Force Main Relocation Project from 9th Street to 11th Street.
Prior to the first initiation of the public bidding process, in March, test results from soil
samples did not indicate anything significant. Ground water samples were also taken,
however the testing period was of longer duration and the results were not available
until after the project was initiated and notice to bidders had been published. After the
Notice to Bidders publication it was brought to our attention that there were
environmental issues with the groundwater in the construction area. Engineering staff
and the consultant, IIW, P.C., needed some time to evaluate the results and determine
the best way to move forward on the project. The initiation was rescinded so further
research could be conducted to determine the best way to proceed. The engineering
department met with IIW, P.C. and consulted with an OSHA expert. Results of the
collaborative efforts, along with a soil and groundwater management plan were written
into the project specification to inform prospective bidders and city staff of the hazards
that may be encountered on this project. One of the requirements that was added is
for all contractors planning to bid on the project to obtain the 40 hour HAZWOPER
training certification prior to bidding. The requirement for the HAZWOPER training was
also applied to some Engineering department staff that will or may be involved with the
project during construction. The Staff training has been completed.
The project was planned to utilize the 1996 City of Dubuque Standard Specifications
(current) along with the current standard form of contract and other ancillary standard
forms and project specific documents. A thorough legal review of the current General
Conditions and form of contract, as it related to the hazardous materials, could not be
completed prior to Council initiating the project on May 6, 2013 and was planned to be
completed by May 9, 2013, so that plans would be available for contractors on the
following day. Engineering and Legal staff met and determined that many changes
were needed to the 1996 City of Dubuque Standard Specification, General Conditions,
to address the complexities of this project and that it would not be completed in time to
be available to contractors for bidding.
Engineering, Finance and Legal staff have been working diligently, over the last six
months, to review the Statewide Urban Design and Specification (SUDAS) and develop
supplemental specifications so that the Council Priority of adopting SUDAS can be
implemented. Legal staff has also been working on updating the standard form of
contract and other contract documents to correlate with SUDAS. This process is nearly
complete and will be completed and ready for implementation on several upcoming
projects. Staff determined that it would be more productive to spend the time needed
to finish up with SUDAS and implement it as the project specification rather than
revising the current City of Dubuque specifications which we will no longer be using.
Utilizing the new specifications and contract documents will better address the
complexities of this project.
RECOMMENDATION
I recommend that the City Council approve the attached resolution to rescind Resolution
No. 139 -13 which would cancel the public bidding process for Phase I of the 30 inch
Force Main Relocation Project from 9th Street to 11th Street through the. The project
will have to be re- initiated at a future City Council meeting once the plans and
specifications have been updated to reflect the SUDAS specification.

Whereas, the City Council of the city of Dubuque, Iowa at its meeting on May 6,
2013 approved by resolution the proposed plans, specifications, form of contract and
estimated cost for Phase I of the 30 inch Force Main Relocation Project from 9th Street
to 11th Street; and
Whereas, the project was planned to utilize the 1996 City of Dubuque Standard
Specifications (current) along with the current standard form of contract and other
ancillary standard forms and project specific documents. A thorough legal review of the

Project from 9th Street to 11th Street, in the estimated amount $1,185,437.50 is hereby
rescinded.
Section 2. The public hearing set for the 20th day of May 2013, at 6:30 p.m. in the
Historic Federal Building Council Chambers for interested persons to appear and be
heard for or against the proposed plans and specifications, form of contract and
estimated cost of said Project is hereby cancelled.
