Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant's representative, Keith Wolff, spoke in favor of the request, noting the location of the proposed free - standing sign and that it would increase visibility of the bank for eastbound traffic on 9th Street. Staff Member Hemenway reviewed the staff report, explaining past amendments to the C -5 District and that the C -5 District is in the Old Town Neighborhood where property boundaries extend to the street centerline. He noted that this has allowed businesses to request the placement of signs within the City's roadway easement. There were no public comments. The Zoning Advisory Commission discussed the request and felt it was appropriate. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. INTRODUCTION Premier Bank, 140 W. 9th Street, is requesting an amendment to Section 15 -11.10 of the Unified Development Code regarding sign regulations in the C -5 Central Business zoning district. The request is to permit freestanding signs along 9th Street between Iowa Street and Main Street in the C -5 district. Currently, freestanding signs within the C -5 district are only permitted along the Locust and Iowa Street frontages, on 7th Street between Locust and Main Streets, and on Main Street between 8th and 10th Streets. The proposed amendment also establishes bulk standards for sign area, height and width for those signs that may be located along 9th Street. DISCUSSION The C -5 district extends from 4th Street to 10th Street and from Locust Street to Iowa Street. The C -5 district standards permit freestanding signs to be placed along Locust and Iowa Street frontages, on 7th Street between Locust and Main Streets, and on Main Street between 8th and 10th Streets. Currently, within the C -5 district, there is a freestanding sign located at Dave's Conoco at 500 Locust Street, IBM at 700 Locust Street, Cottingham & Butler at 800 Main Street, and the Grand Theater at 135 W. 8th Street. The restriction was originally established in part because most of the buildings along the frontages in this district extend to the public right -of -way or public right -of -way easement, not affording any space for freestanding signage. Originally, freestanding signs were not permitted anywhere within the 0-5 District. However, in 1998, the Zoning Advisory Commission and the City Council approved an amendment to the C -5 District sign regulations that allowed freestanding signs of up to 100 square feet in area and 25 feet in height along the Locust Street and Iowa Street frontages. Several of the businesses along these frontages, including a bank and gas Memo to Zoning Advisory Commission Page 2 station, are set back from the front property line and are better able to accommodate freestanding signage. The applicant is proposing to amend the C -5 District regulations to permit freestanding signs to be placed along the 9th Street frontage between Main Street and Iowa Streets. Most of the buildings in this area are built up to the public right -of -way easement. Therefore, freestanding signs located within the subject area will have to be placed on the easement and will require review and approval by the City so as to avoid conflict with utilities and to ensured traffic and pedestrian safety. The applicant proposes to limit their freestanding sign to 11 feet in height, five feet in width and 40 square feet in area. The height, width and area of the subject sign reflects the bulk standards proposed for the entire 9th Street frontage. If approved, staff anticipates that the City will recommend an amendment to the C -5 district that provides consistent sign regulations within the entire district, versus the somewhat piecemeal regulations that currently exist. RECOMMENDATION Staff recommends that the Zoning Advisory Commission review the applicant's request in accordance with Section 9 -6.1 of the City of Dubuque Unified Development Code.
