ARTS AND CULTURAL AFFAIRS ADVISORY COMMISSION 2 -8 -1: COMMISSION CREATED: There is hereby created the arts and cultural affairs advisory commission to have such powers and responsibilities as hereinafter provided. (2007 Code § 8 -11) 2 -8 -2: MISSION: The mission of the commission is to build the community of Dubuque through arts and cultural programs by developing visibility, funding, audiences, information and partnerships. (2007 Code § 8 -12) 2 -8 -3: GOALS: The goals of the commission shall be as follows: A. To promote, educate and create awareness for arts and cultural activities in the Dubuque community; B. To develop and increase the market for arts and cultural activities in the Dubuque community; C. To facilitate and convene partnerships for arts and cultural activities in the Dubuque community; and D. To develop funding options and allocate budgeted funding for arts and cultural activities in the Dubuque community. (2007 Code § 8 -13) 2 -8 -4: PURPOSE: The purpose of the arts and cultural affairs advisory commission shall be to plan, promote and encourage programs to further public awareness of, accessibility to, participation in and support for the artistic and cultural development of the city and to make recommendations to the city council regarding the establishment of arts and cultural policies and programs, the expenditure of budgeted city funds on arts and cultural activities and the implementation of programs for arts and culture. (2007 Code § 8 -14) 2 -8 -5: POWERS: The commission shall have the following powers: A. To act in an advisory capacity to the city council in all matters pertaining to the arts and cultural environment of the city; B. To hold regular public meetings and maintain a written record of its proceedings; C. To make recommendations to the city council on the allocation of budgeted city funding for arts programs and services; D. To recommend to the city council applications and solicitations for grants, gifts and donations from individuals, groups, organizations and agencies, both private and public, for any purpose consistent with the purposes of the commission; E. To make recommendations to the city council regarding city sponsorship of public programs to further the development of public awareness of and accessibility to arts and culture programs and activities; F. At the request of the city council, to work with area organizations on broad community issues in which a cultural perspective is relevant and desirable; and G. To engage in comprehensive planning for the cultural development of the city. (2007 Code § 8 -15) 2 -8 -6: COOPERATION WITH OTHER AGENCIES: The commission shall cooperate with the Dubuque Cultural Alliance and other groups interested in the promotion and implementation of arts and cultural activities which are in the best interest of the city. (2007 Code § 8 -16) 2 -8 -7: SOLICITATION AND ACCEPTANCE OF DONATIONS: The commission may solicit and otherwise accept donations and gifts of money, personal and real property and personal services on behalf of the city. All such donations and gifts received shall become the property of the city for the general use or support of arts and cultural programs of the city as determined by the city council unless such items have been designated by the donor for specific purposes. (2007 Code § 8- 17) 2 -8 -8: MEMBERSHIP; APPOINTMENT: A. Membership; Terms: The commission shall comprise seven (7) members. The initial term of four (4) of the members shall be for three (3) years and the initial term of three (3) of the members shall be two (2) years. Thereafter, all terms shall be three (3) years. The expiration date for all terms of office shall be June 30 of the appropriate year. B. Qualifications: Four (4) members of the commission shall have significant knowledge and demonstrated interest in one or more areas of the arts including music, dance, literature, visual arts, theater, folk arts, media arts, design, arts education or be a member of the Dubuque Cultural Alliance. Two (2) members shall be from the business and professional community, one of whom lives or works in the cultural and entertainment district. One member shall be at large who lives or works outside the cultural and entertainment district. C. Vacancies: Vacancies caused by death, resignation or otherwise shall be promptly filled by the city council for the unexpired term of office. (2007 Code § 8 -18) 2 -8 -9: ATTENDANCE: A. Attendance Requirement: Members of the commission shall attend at least two - thirds (2/3) of all regularly scheduled and held meetings within any consecutive twelve (12) month period. If any member fails to attend such prescribed number of meetings, it shall be grounds for the commission to recommend to the city council that the position be declared vacant and a replacement appointed. B. Attendance Entered On Minutes: The attendance of all commission members shall be entered upon the minutes of all meetings by the secretary. (2007 Code § 8 -19) 2 -8 -10: COMPENSATION: Members of the commission shall serve without compensation except for reimbursement of necessary expenses. (2007 Code § 8 -20) 2 -8 -11: ORGANIZATION: At the initial meeting of the commission and at the first meeting in July of each year, the commission shall elect a chairperson, a vice chairperson and a secretary to serve one year terms of office. All officers shall be eligible to serve successive terms of office. (2007 Code § 8 -21) 2 -8 -12: MEETINGS: A. Regular Meetings: The commission shall hold a minimum of six (6) meetings a year. Meetings shall be held on the fourth Tuesday of each month at four thirty o'clock (4:30) P.M. B. Special Meetings: Special meetings may be called by the chairperson or at the written request of three (3) members. C. Open Meetings: All meetings shall be called and held in conformance with the Iowa open meetings law. D. Minutes Filed With City Council: A copy of the minutes of all regular and special meetings of the commission shall be filed with the city council within ten (10) working days after each such meeting. E. Quorum: Four (4) members of the commission shall constitute a quorum for the transaction of business. The affirmative vote of at least four (4) members shall be necessary for the adoption of any resolution. (2007 Code § 8 -22) 2 -8 -13: RULES AND REGULATIONS: The commission shall adopt such rules and regulations to govern its internal organization and procedure as it may deem necessary and which are not in conflict with this chapter or this code. Copies of such rules and regulations upon their adoption shall immediately be provided to the city council. (2007 Code § 8 -23) 2 -8 -14: ADMINISTRATIVE AND OTHER CITY POLICIES: All administrative, personnel, accounting, budgetary and procurement policies of the city shall govern the commission in all of its operations. ELECTRICAL CODE BOARD 14-1D-2: NATIONAL ELECTRICAL CODE AMENDMENTS: Article 81 81 -3. Electrical Code Board. (a) Board Established. In order to determine the suitability of alternative materials and methods of installation; to provide for reasonable interpretations of this code; to serve as an appeal body for the decisions of the building official; to advise the city council on all electrical regulations and procedures; and to provide for examining applicants for electrical maintenance license and issuing electrical maintenance license, there is hereby created the electrical code board. (b) Membership. The electrical code board shall consist of seven (7) members appointed by the city council. Six (6) members shall have a background or experience in electrical engineering, electrical contracting, electrical installation, or electrical maintenance, and one (1) member shall be appointed from the public at large. Special meetings may be called from time to time by the chairperson, the secretary, or the city manager. Any person who is aggrieved by a decision of the building official on any requirements resulting from the enforcement of this code may appeal from such decision to the board and said board shall serve as an appeal board. In case the aggrieved party is a member of said board, said member shall be disqualified as a member of the board acting as an appeal board until the person aggrieved has been heard and a decision rendered. The appeal shall be made by the person aggrieved, giving written notice of such appeal to the building official within seven (7) days of receipt of decision from which the appeal is taken. The electrical code board, sitting as an appeal board, shall meet within ten (10) business days after receiving such notice and render a decision within five (5) business days thereafter. Any interested party, including the building official, shall have the right to present their case to the appeal board, whose decision shall be final unless appealed to the district court as provided by law. The board of appeals may reverse or modify a decision of the building official only on finding that: a. The building official had incorrectly interpreted the provision of this code; or b. The decision of the building official creates an unnecessary hardship upon the appellant. The board of appeals shall require that sufficient evidence or proof be submitted to substantiate any claims made regarding the use of alternates. All appeal hearings shall be conducted in accordance with the procedures specified in this code. (e) Limitations Of Authority. The board of appeals shall have no authority relative to interpretation of the administrative provisions of this code nor shall the board be empowered to waive requirements of this code. In so modifying or reversing such decision of the building official, the board of appeals may authorize any alternate to the decision of the building official and the provisions, provided it finds the proposed material or method of construction is satisfactory for the use intended and complies with the provisions of this code and that the material, method, or work offered is, for the purpose intended, at least equivalent to that prescribed by this code in suitability, strength, effectiveness, durability, and safety. 81 -4. Violations. It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, or maintain any electrical system or equipment or cause or permit the same to be done in violation of this code. The doing of any act, or the omission of any act, declared to be unlawful by this code or any code or ordinance herein adopted by reference shall be deemed a separate offense for each and every day or portion thereof during which any such unlawful act is committed, continued, or permitted; and, upon conviction, shall be punishable as provided in title 1, chapter 4 of the city of Dubuque code of ordinances. I continue to work with the board on its strategic planning. Since 2006, I have served on the Iowa Commission on Libraries, having been appointed by Gov. Vilsack and reappointed by Governors Culver and Branstad. I am currently the vice president and will assume duties as the president in May. I have been very active with the Iowa Library Association, and currently chair the Strategic Planning Committee of ILA. I have raised a child and know the critical importance of a thriving public library for the health of the community. What contributions can you make or state reason for applying ?: As a citizen of Dubuque and a library patron, I am proud of the Carnegie -Stout Library, and would like to do what I can to enable it to continue to address the needs and challenges of the citizens of Dubuque. As a longtime professional librarian, I have a pretty good idea of issues facing the library, and a good network of colleagues who are finding imgaginative and economic solutions. As a longtime public library board member, I have experience with serving as a liaison from the community to the library, wrestling with budgets and policies, and advocating for the library. My years of helping my college, where I am the coordinator of Strategic Planning, and public libraries with their strategic planning provide a good basis for understanding long -term trends, needs, and challenges, and how to address them. All appointive boards, commissions, committees, and councils of the state established by the Code, if not otherwise provided by law, shall be gender balanced. No person shall be appointed or reappointed to any board, commission, committee, or council established by the Code if that appointment or reappointment would cause the number of members of the board, commission, committee, or council of one gender to be greater than one —half the membership of the board, commission, committee, or council plus one if the board, commission, committee, or council is composed of an odd number of members. If the board, commission, committee, or council is composed of an even number of members, not more than one —half of the membership shall be of one gender. If there are multiple appointing authorities for a board, commission, committee, or council, they shall consult each other to avoid a violation of this section. 2. All appointive boards, commissions, committees, and councils of a political subdivision of the state that are established by the Code, if not otherwise provided by law, shall be gender balanced as provided by subsection 1 unless the political subdivision has made a good faith effort to appoint a qualified person to fill a vacancy on a board, commission, committee, or council in compliance with subsection 1 for a period of three months but has been unable to make a compliant appointment. In complying with the requirements of this subsection, political subdivisions shall utilize a fair and unbiased method of selecting the best qualified applicants. Last session, the General Assembly passed legislation that applies this requirement to the local level. This Q &A explains background on the legislation, the new requirements in the legislation for cities and how cities can comply. Q: What are the new requirements for gender balance on city boards and commissions? A: During the 2009 legislative session, legislation (HF243) was passed that extends to cities and counties gender balance require- ment for all appointive boards, commissions, committees and councils created by the Iowa code. In other words, bodies cities are required to have under Iowa code when they provide certain functions or services, such as the planning and zoning commission, library boards and the board of adjustment, with appointed (not elected) members, must be gender balanced. Q: What does `gender balanced' mean? A: Gender balance means if the body has an even number of ap- pointees, it must be evenly made up of men and women. For exam- ple, three women and three men must serve on a six member board. If the body has an odd number of appointees, it must be "one half plus one" of either gender. For instance, if there are five members, three could be men and the other two women, or vice versa. Q: When do the changes go into effect? A: Cities must have gender balanced boards, commissions, com- mittees and councils by January 1, 2012. This does not prohibit an individual whose term expires prior to January 1, 2012, from being reappointed even though the reappointment continues an inequity in gender balance; however, cities should start planning upcoming appointments now, to ensure gender balance is reached by that date. Making a chart of existing boards and upcoming vacancies, and/ or keeping track of current appointments and necessary recruit- ing periods would be a good start to ensuring your city is tracking gender balance, and is prepared for the January 1, 2012 implementa- tion date. Q: Is there any option if my city simply cannot find a person to serve on the board or commission of the needed gender? A: Yes. Under the new code section, cities that make a good faith effort to find a qualified person of the necessary gender to fill the position for a period of three months and are unable to do so may appoint a person to the position regardless of the gender balance requirement. Q: What constitutes a "good faith effort "? A: There is no hard and fast definition, but cities should be able to demonstrate a legitimate effort during the three month time period to recruit qualified members of the necessary gender, before appointing a member that creates gender imbalance. In addition, the legislation requires that cities must always "utilize a fair and unbiased method of selecting the best qualified applicants," regard- less of gender. Q: Is there a reporting requirement? A: No. The legislation did not include a reporting requirement; however, many cities keep information on their boards and commissions — including current members- posted online, to better inform citizens of the makeup of local governing bodies. Q: How can I recruit more women or men to volunteer for these positions? A: The Commission on the Status of Women has prepared a guide to help cities learn how to recruit gender balanced boards and com- missions. This resource can be found at www.women.iowa.gov / whats_new /index.html. The Commission also prepared a guide called the "Five Step Guide to City and County Boards and How to Get Appointed" to be used as a tool by interested women to learn more about how to get involved in city boards and commissions. Undertaken for the city of North Liberty, this project involves a membrane bioreactor method of treating wastewater and provides a significantly higher effluent water quality compared to conventional wastewater treatment processes. Used on a limited basis in the U.S. it is the first of its kind in Iowa. The city has certainly "gone the extra mile" to improve the water quality in their receiving stream; they are to be commended for their foresight and respect for the environment.
