Building Services Manager Rich Russell recommends award of the contract to the low bidder, Portzen Construction, Inc., in the amount of $369,000. The project estimate was $227,000, and the primary reason for the difference between the estimate and the bids is the masonry work. Van Milligen, City Manager FROM: Rich Russell, Building Services Manager SUBJECT: 5th and Bluff Public Restroom Project Award of Contract Dubuque bitil All-America City hill! 2007 INTRODUCTION: The attached resolution awards the contract for the 5t" and Bluff Public Restroom Project to Portzen Construction of Dubuque, Iowa. BACKGROUND: The City Council previously approved the plans and specifications and authorized seeking bids for the 5t" and Bluff Public Restroom Project at their April 15, 2013 and May 6, 2013 meetings. Bids were due May 9, 2013. Three bids were received. The results are as follows: Portzen Construction $369,000.00 Dubuque TriCon $394,000.00 Dubuque Klauer Construction $415,350.00 Dubuque The project estimate was $227,000. The primary reason for the difference between the estimate and the bids was the masonry work. RECOMMENDATION: Ament Design, the project architect has reviewed bids and recommends that the City enter into a contract with Portzen Construction for the 5th and Bluff Public Restroom Project in the amount of $369,000.00. Heather Kakert's letter of recommendation is attached. I concur with Heather Kakert's recommendation. BUDGET IMPACT: Funding for the project will come from the Downtown TIF. Additional funding is available from the Downtown TIF due to the postponement of the E 7th Street Reconstruction Project. ACTION TO BE TAKEN: The City Council is requested to approve awarding the contract to Portzen Construction of Dubuque, Iowa in the amount of $369,000.00. RESOLUTION NO. 174 -13 AWARDING PUBLIC IMPROVEMENT CONTRACT FOR THE 5th AND BLUFF PUBLIC RESTROOM PROJECT Whereas, sealed proposals have been submitted by contractors for the 5th and Bluff Public Restroom Project (the Project) pursuant to Resolution No. 118 -13 and Notice to Bidders published in a newspaper published in the City of Dubuque, Iowa on the 19th day of April, 2013, and Whereas, said sealed proposals were opened and read on the 9th day of May, 2013 and it has been determined that Portzen Construction, Inc. of Dubuque, Iowa with a bid proposal in the amount of $369,000.00, is the responsive, responsible bidder for the Project, and Whereas, it has been determined that it is in the best interest of the City of Dubuque to enter into an improvement contract with Portzen Construction, Inc. for said Project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That a Public Improvement Contract for the Project is hereby awarded to Portzen Construction, Inc. and the City Manager is hereby directed to execute a Public Improvement Contract on behalf of the City of Dubuque for the Project. All bids were found to be in general compliance with the bid instructions. The base bids for the project ranged in value from $369,000 to $415,350. There were no alternate bids. There were no discrepancies or irregularities in any of the bids. A bid tabulation sheet is included for your reference. Portzen Construction, Inc. of Dubuque, IA. submitted the low base bid of $369,000.00. Therefore, we recommend that the City of Dubuque award the contract for this project to Portzen Construction, Inc. Finally, we also suggest the City consider setting aside a construction -phase contingency amount totaling approximately 5 to 10% of the bid to be used for unforeseen conditions as the work proceeds. Portzen Construction, Inc. has subsequently acknowledged the scope of work represented by the plans and specs, the necessary schedule constraints and has included bid - acceptable products for this project. We therefore feel this denotes that his company understood the scope of these project, as did the other bidding contractors, and action regarding these bids can be taken in confidence.
