Van Milligen, City Manager SUBJECT: Agreement with ECIA for Prosperity Eastern Iowa Marketing Efforts During the Fiscal Year 2007 budget process, the Mayor and City Council provided $2,000 annually for 3 years for an agreement with East Central Intergovernmental Association (ECIA) toward the Prosperity Eastern Iowa marketing efforts. Budget Director Dawn Lang is recommending execution of the attached contract with ECIA to assist in funding a collaborative marketing effort by Prosperity Eastern Iowa to promote economic development opportunities as well as to increase and expand the economic segments within the six-county region of Cedar, Clinton, Delaware, Dubuque, Jackson and Jones Counties, sharing expertise, support services, experiences, and projects that empower each individual entity with the strength of the partners as a whole. Van Milligen, City Manager FROM: Dawn Lang, Budget Director SUBJECT: Agreement with ECIA for Prosperity Eastern Iowa Marketing Efforts Attached for City Council approval is an agreement to provide funding for 3 years to East Central Intergovernmental Association (ECIA) toward the Prosperity Eastern Iowa marketing efforts. The adopted Fiscal Year 2007 includes an improvement package providing $2,000 each year for 3 years to assist in funding a collaborative marketing effort by Prosperity Eastern Iowa. This effort will promote economic development opportunities as well as increase and expand the economic segments within the six-county region of Cedar, Clinton, Delaware, Dubuque, Jackson and Jones Counties, sharing expertise, support services, experiences, and projects that empower each individual entity with the strength of the partners as a whole. It is my recommendation that the City Council approves the attached agreement with ECIA and authorize the Mayor to execute the contract on behalf of the City. DLL Attachment AGREEMENT BETWEEN CITY OF DUBUQUE, IOWA, AND EAST CENTRAL INTERGOVERNMENTAL ASSOCIATION THIS AGREEMENT, dated for reference purposes the 1 st day of July 2006, is made and entered into by and between the City of Dubuque, Iowa, (City) and East Central Intergovernmental Association (Agency). WHEREAS, City has deemed it to be in the public interest to provide Agency with local match contribution toward the Prosperity Eastern Iowa marketing efforts; and WHEREAS, the Agency has indicated its willingness to provide such services to the City; and NOW THEREFORE, the parties hereto agree as follows: 1. Scope of Service Agency shall coordinate a collaborative marketing effort through Prosperity Eastern Iowa. This effort shall promote economic development opportunities as well as increase and expand the economic segments within the six-county region of Cedar, Clinton, Delaware, Dubuque, Jackson, and Jones Counties, plus the communities of Marion and Springville in Linn County, sharing expertise, support services, experiences, and projects that empower each individual entity with the strength of the partners as a whole. Activities shall include internal and external marketing of Prosperity Eastern Iowa; assistance and coordination with the Greater Dubuque Development Corp., as well as other economic development groups within the region, to provide current and accurate information for posting on the Location One Information System (LOIS), an on-line searchable economic development database that provides detailed information on buildings, sites and locations for businesses and site selectors; assistance throughout the region to promote an active business retention and expansion program, including trending on supplies, services, and workforce, utilizing the software capabilities of e-synchronist; the implementation of a regional program aimed at local companies to promote the purchase of supplies from within the region rather than from outside the region; and other future initiatives as determined by the Executive Committee of Prosperity Eastern Iowa. The City of Dubuque is represented on this committee by their Economic Development Director. 2. Time of Performance The term of this Agreement shall be from July 1, 2006, through June 30, 2009. 1 3. Comoensation The City shall pay Agency $2,000.00 annually for three (3) years as local contribution for the marketing effort provided by Agency, which payment shall constitute full and complete compensation for such services. Compensation shall be paid by City to Agency within ten (10) days after execution of the Agreement by both parties and upon receipt of a requisition by City of a requisition for such sum from Agency. 4. Discrimination In carrying the marketing effort under this Agreement, Agency shall not discriminate against any employee or applicant for employment because of race, creed, color, sex, age, national origin, religion, sexual orientation, or disability. Agency shall take affirmative action to ensure that applicants for employment are employed and that employees are treated during employment without regard to race, creed, color, sex, age, national origin, religion, sexual orientation, or disability. Such action shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of payor other forms of compensation; and selection for training, including apprenticeship. Agency assures that all qualified applicants will receive consideration for employment without regard to race, creed, color, sex, age, national origin, religion, sexual orientation, or disability. Agency agrees and will undertake whatever affirmative measures are necessary so that no person shall be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activities funded in whole or in part with any of the funds made available to Agency under the terms of this Agreement because of race, color, creed, religion, sex, national origin, age, sexual orientation, or disability. 5. Interest of Member. Officers or Emolovees of the Citv of DubuQue. Members of the DubuQue Citv Council. or Other Public Officials No member, officer or employee of City, or their designees or agents, no member of the Dubuque City Council and no other public official of City who exercises any function or responsibilities with respect to the program during his such person's tenure, or one year thereafter, shall have any financial interest, direct or indirect, in this Agreement or the proceeds thereof, for work to be performed in connection with the program assisted under this Agreement. 2 6. Termination of Contract If, through any cause, Corporation shall fail to fulfill in a timely and proper manner its obligations under this Agreement, or if the Corporation shall violate any of the covenants, agreements or stipulations of this Agreement, City shall thereupon have the right to terminate this Agreement by giving written notice to Corporation of such and specifying the effective date thereof, at least thirty days before the effective date of such termination. Upon termination of this Agreement, Corporation will return to City all unexpended funds and/or any funds utilized for purposes other than stated in the Agreement. 7. Comoliance with Local Laws Corporation shall comply with all applicable laws, ordinances, and codes of the State of Iowa and the City of Dubuque. 8.
