SUBJECT: Agreement with ECIA for Funding a Part-Time Transportation
Planner
During the Fiscal Year 2007 budget process, the Mayor and City Council agreed to provide
$5,000 annually for 3 years to East Central Intergovernmental Association (ECIA) toward a
part-time transportation planner.
Budget Director Dawn Lang is recommending execution of the attached contract with ECIA
to assist in funding a part-time transportation planner to primarily provide traffic and
transportation planning for the City of Dubuque Engineering Department and Planning
Department.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Agreement with ECIA for Funding a Part-Time Transportation
Planner
Attached for City Council consideration is an agreement to provide funding for 3 years
to East Central Intergovernmental Association (ECIA) toward a part-time transportation
planner position.
The adopted Fiscal Year 2007 includes an improvement package providing $5,000 each
year for 3 years to assist in funding a part-time transportation planner to primarily provide
traffic and transportation planning for the City of Dubuque Engineering Department and
Planning Department.
It is my recommendation that you request City Council consideration and approval of
the attached agreement with ECIA and authorization for the Mayor to execute the
agreement on behalf of the City.

BETWEEN
THE CITY OF DUBUQUE, IOWA,
AND
EAST CENTRAL INTERGOVERNMENTAL ASSOCIATION
THIS AGREEMENT, dated for reference purposes the 1st day of July, 2006, is
made and entered into by and between the City of Dubuque, Iowa, (City) and East Central
Intergovernmental Association (Agency).
WHEREAS, City has deemed it to be in the public interest to provide Agency with
local match contribution toward a part time transportation planner; and
WHEREAS, Agency has indicated its willingness to provide such services to City;
and
NOW THEREFORE, the parties hereto agree as follows:
1. ScoDe of Service
Traffic and Transportation assistance for the City Engineering Department and Planning
Department as requested as well as the following:
. Traffic counts as requested within the City of Dubuque
. Transportation Planning for Engineering such as:
o Downtown traffic counts and timing studies
o Data collection for engineering projects
o Train studies and Counts
· Assisting Engineering with Corridor projects
o EastlWest corridor Study
. Traffic Counts for the corridor.
. Meeting with City Engineering and planning to conforming the
development happening on the corridors
. Traffic volumes for designated corridors for years 2005,2010,2020
and 2030
. Helping engineering staff through out the project as required
. Participating in technical and political project meetings
o Down Town Study
. Traffic Counts for the designated area.
. Meeting with City Engineering and planning to conforming the
development happening in the area
. Traffic volumes for designated corridors for years 2005,2010,2020
and 2030

o Rockdale corridor Study
. Traffic Counts for the corridor.

2. Reportina
ECIA staff will be meeting monthly with City of Dubuque Engineering staff to
discuss the requirements.
Quarterly reports will be provided to the City of Dubuque Engineering
Department regarding the work done in that quarter.
2. Time of Performance
The term of this Agreement shall be from July 1, 2006, through June 30, 2009.
3. Compensation
City shall pay Agency $5,000.00 annually for three (3) years as local contribution for
the transportation planning efforts provided by Agency, which payment shall
constitute full and complete compensation for such services. Compensation shall
be paid by City to Agency within ten (10) days after execution of the Agreement by
both parties and upon receipt of an annual requisition by City of a requisition for
such sum from Agency.
4. Discrimination
In carrying the planning duties under this Agreement, Agency shall not discriminate
against any employee or applicant for employment because of race, creed, color,
sex, age, national origin, religion, sexual orientation, or disability. Agency shall take

affirmative action to ensure that applicants for employment are employed and that
employees are treated during employment without regard to race, creed, color, sex,
age, national origin, religion, sexual orientation, or disability. Such action shall
include, but not be limited to, the following: employment, upgrading, demotion or
transfer; recruitment or recruitment advertising; layoff or termination; rates of payor
other forms of compensation; and selection for training, including apprenticeship.
Agency assures that all qualified applicants will receive consideration for
employment without regard to race, creed, color, sex, age, national origin, religion,
sexual orientation, or disability.
Agency agrees and will undertake whatever affirmative measures are necessary so
that no person shall be excluded from participation in, be denied the benefits of, or
be subjected to discrimination under any program or activities funded in whole or in
part with any of the funds made available to Agency under the terms of this
Agreement because of race, color, creed, religion, sex, national origin, age, sexual
orientation, or disability.
5. Interest of Member. Officers or Emolovees of the Citv of Dubuaue. Members of the
Dubuaue Citv Council. or Other Public Officials
No member, officer or employee of City, or their designees or agents, no member of
the Dubuque City Council and no other public official of City who exercises any
function or responsibilities with respect to the program during his such person's
tenure, or one year thereafter, shall have any financial interest, direct or indirect, in
this Agreement or the proceeds thereof, for work to be performed in connection with
the program assisted under this Agreement.
6. Termination of Contract
If, through any cause, Agency shall fail to fulfill in a timely and proper manner its
obligations under this Agreement, or if Agency shall violate any of the covenants,
agreements or stipulations of this Agreement, City shall thereupon have the right to
terminate this Agreement by giving written notice to Agency of such and specifying
the effective date thereof, at least thirty days before the effective date of such
termination.
Upon termination of this Agreement, Agency shall return to City all unexpended
funds and/or any funds utilized for purposes other than stated in the Agreement.
7. Comoliance with Local Laws
Agency shall comply with all applicable laws, ordinances, and codes of the State of
Iowa and the City of Dubuque.

8. Assianabilitv
Agency shall not assign or transfer any interest in this Agreement without the prior
written approval of City.
