Heiar, Economic Development Director 7J 7t+ SUBJECT: Subdividing Parcel F adjacent to the Dubuque Technology Park INTRODUCTION The proposed development plans by Conlon Johnson Development LLC require the subdivision of a parcel of land adjacent to the Dubuque Technology Park. BACKGROUND In 2004, the City of Dubuque acquired excess Highway 151/61 right-of-way (parcel F) from the Iowa Department of Transportation to construct a sign designating the City of Dubuque as Home of Americas River. Not all of the 1.345 acres acquired at that time were needed for this signage. During negotiations with Conlon Johnson Development LLC, it was determined that a portion of the unused Parcel F property is adjacent to the lot being acquired for their project. Positioning the building and parking areas onto Lot 4 of the Dubuque Technology Park would require setback variances unless a portion of this 50 foot wide strip could also be acquired by the developer. This portion of Parcel F adds approximately .582 acres to lot 4 block 1 of the Dubuque Technology Park and would eliminate the need to request variances. To accommodate this plan Parcel F needs to be divided into 2 parcels (a north parcel- lot 1 and a south parcel - lot 2). Then lot 2 needs to be divided into 2 parts (lot 1 of Dubuque Technology Park number 2 and lot 2 of Dubuque Technology Park number 2)(see attached plats). Lot 1 of Dubuque Technology Park number 2 will be included in the proposed sale which will be scheduled for a public hearing on August 21, 2006. RECOMMENDATION I recommend the City Council approve the attached resolutions authorizing the Mayor to sign the plats to subdivide Parcel F which is adjacent to the Dubuque Technology Park to accommodate the development plans submitted by Conlon Johnson Development, LLC. Whereas, there has been presented to the City Council of the City of Dubuque, Iowa, a plat dated July 31, 2006 prepared by Buesing and Associates describing the division of Lot F of Dubuque Technology Park to be known as Lot 1 of F and Lot 2 of F of Dubuque Technology Park in the City of Dubuque, Dubuque County, Iowa; and Whereas, said plat conforms to the laws and statutes pertaining thereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the plat dated July 31, 2006 prepared by Buesing and Associates, relative to the real estate hereinabove described be and the same is hereby approved, and the Mayor and City Clerk be and they are hereby authorized and directed to execute said plat for and on behalf of the City of Dubuque, Iowa. Section 2. The City of Dubuque reserves unto itself a perpetual easement as shown on the plat including the right of ingress and egress thereto, for the purpose of erecting, installing, constructing, reconstructing, repairing, owning, operating, and maintaining water, sewer, drainage, gas, telephone, television cable, fiber optics, and electric lines as may be authorized by the City of Dubuque, Iowa. Section 3. That the City Clerk be and is hereby authorized and directed to file said plat and certified copy of this resolution in the office of the Recorder in and for Dubuque County, Iowa.
