City Engineer Gus Psihoyos recommends initiation of the bidding process for the US 20
(Devon Drive to Menards) Capacity Improvements Project - Phase I, Traffic Signal and
Intelligent Transportation System Improvements, and further recommends that a public
hearing be set for September 5, 2006.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
SUBJECT:
The enclosed resolutions authorize the public bidding procedure for the US 20 (Devon
Drive to Menards) Capacity Improvements Project - Phase I, Traffic Signal and
Intelligent Transportation System Improvements.
DISCUSSION
On July 7, 2006, the City Council approved (Res. 270-06) an agreement with the Iowa
Department of Transportation (Iowa DOT) and the City of Dubuque (City) for the funding
of the US 20 Capacity Improvements Project for the use of Iowa Clean Air Attainment
Program (ICAAP) funding. Under ICAAP funding, 80 percent (80%) or $260,370 of the
total eligible project items are reimbursable.
This project (Phases I and II) include the installation of fiber optic cable on US 20 from
Devon Drive to Hill Street and on various City streets from US 20 to City Hall with
camera installation and traffic signal improvements on US 20 at the Menards entrance,
Iowa 32 (Northwest Arterial), Wacker Drive, John F. Kennedy Road, and Devon Drive.

Phase II of this project will be bid-let by the Iowa Department of Transportation (Iowa
DOT) in October, 2006.
RECOMMENDATION
I recommend that the City Council give approval to the construction plans and
specifications and to establish September 5, 2006 as the date of the public hearing.

The Dubuque Metropolitan Area Transportation System (DMATS) has submitted the
funding into the Transportation Improvement Program (TIP) and the Iowa DOT has
submitted the funding into the Statewide Transportation Improvement Program (STIP)
for authorization of the federal funds.

The City Council is requested to approve to the construction plans and specifications
and to establish September 5, 2006 as the date of the public hearing for the US 20
(Devon Drive to Menards) Capacity Improvements Project - Phase I, Traffic Signal and

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the proposed plans, specifications, form of contract and estimated
cost for the US 20 (Devon Drive to Menards) Capacity Improvements Project -
Phase I, Traffic Signal and Intelligent Transportation System Improvements
(STP-A-020-9(186)-22-31) in the estimated amount $190,035.89 are hereby
approved and ordered filed in the office of the City Clerk for public inspection.

FIXING DATE OF HEARING ON PLANS AND SPECIFICATIONS
Whereas, the City Council of the City of Dubuque, Iowa has given its
preliminary approval on the proposed plans, specifications, and form of contract
and placed same on file in the office of the City Clerk for public inspection of the
US 20 (Devon Drive to Menards) Capacity Improvements Project - Phase I,
Traffic Signal and Intelligent Transportation System Improvements (STP-A-020-
9(186)-22-31).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That a public hearing will be held on the 5th day of September, 2006, at
6:30 p.m. in the Public Library Auditorium at which time interested persons may
appear and be heard for or against the proposed plans and specifications, form
of contract and cost of said improvement, and the City Clerk be and is hereby
directed to cause a notice of time and place of such hearing to be published in a
newspaper having general circulation in the City of Dubuque, Iowa, which notice
shall be not less than four days nor more than twenty days prior to the day fixed
for its consideration. At the hearing, any interested person may appear and file
objections to the proposed plans, specifications, contract, or estimated cost of
the improvement.

NOTICE IS HEREBY GIVEN: The City Council of Dubuque, Iowa will hold
a public hearing on the proposed plans, specifications, form of contract and
estimate of cost for the US 20 (Devon Drive to Menards) Capacity Improvements

A Proposal Guarantee not less than the amount as set forth in the proposal form shall be filed with each proposal. The Proposal Guarantee shall be in the form of a

The contracting authority will issue an exemption certificate for the purchase or use of building materials, supplies, and equipment that will be used in the performance of
the construction contract. as provided by Iowa Code Sections 422.42(16), 422.42(17) and 422.47(5)
Failure to execute a contract and file an acceptable Performance Bond and Certificate of Insurance within 30 days of the date of the approval for awarding the contract, as
herein provided, will be Just and sufficient cause for the denial of the award and the forfeiture of the proposal guarantee
The Iowa Department of Transportation (or other approved contracting authority) hereby notifies all bidders that it will affirmatively ensure that in any contract entered into
pursuant to this advertisement. disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated
against on the grounds of race, color, or national origin in consideration for an award.
On Federal Aid proJects, where disadvantaged business enterprise goals have been established, the bidder is required to complete and submit form 102115 with the bid
documents. On all projects without goals, the contractor must show that affirmative actions have been made to seek out and consider disadvantaged business enterprises
as potential sub-contractors
Some of the projects may be listed in multiple proposals (as an individual project or as part of a combined package of projects). The Contracting Authority will determine
which combination of proposals produce the lowest bid for these projects

Minimum wage rates for all Federal Aid projects have been predetermined by the Secretary of Labor and are set forth in the specifications. However, this does nol apply to

By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the Stale of Iowa, and also, a resident bidder shall be
allowed a preference as against a non-resident bidder from a state or foreign country which gives or requires a preference 10 bidders from that state or foreign country both
on projects in which there are no Federal Funds involved
