SUBJECT: National Mississippi River Museum and Aquarium Expansion Project -
Former Adams Company Building Re-roof and Structural Repairs
The enclosed resolutions authorize the award of the construction contract for the
National Mississippi River Museum and Aquarium Expansion Project Former Adams
Company Building Re-Roof and Structural Repairs.
City Engineer Gus Psihoyos is recommending the award to the low bidder, Tricon
General Construction, in the amount of 411 ,220.
There had been objections from the other bidders to the bid award, Conlon Construction
and Portzen Construction, but they have now agreed that the omission is a technical
irregularity in the bid that can be waived by the City.
City Attorney Barry Lindahl recommends that the City Council waive the technical
irregularity in the Tricon bid and award the contract to Tricon General Construction, Inc.,
as recommended by the City Engineer.
I concur with the recommendations and respectfully request Mayor and City Council
approval.

At the bid opening for this project on July 27, 2006, there were some concerns raised by
two of the bidders with respect to an omission in the Tricon General Construction, Inc.
bid. Tricon had failed to acknowledge receipt of one of the three addenda to the bid
documents.
The other two bidders, Conlon Construction and Portzen Construction, have now
agreed that the omission is a technical irregularity in the bid that can be waived by the
City.
I recommend that the City Council waive the technical irregularity in the Tricon bid and
award the contract to Tricon General Construction, Inc. as recommended by the City
Engineer and the City Manager.

INTRODUCTION
The enclosed resolutions authorize the award of the construction contract for the
National Mississippi River Museum and Aquarium Expansion Project Former Adams
Company Building Re-Roof and Structural Repairs.
BACKGROUND
In December of 2002, the City Council approved a grant with the Economic
Development Administration (EDA) in the amount of $2,000,000 to assist the City in
acquiring the Adams Company's property, relocation assistance for the business and
demolishing the existing structures.
Since that time, the Adams Company property has been purchased by the City, and
company has constructed a new facility and relocated to the Dubuque Industrial Center
West.
In late 2005 the Dubuque County Historical Society decided to pursue the reuse of the
former Adams Company building as part of the expansion plans for the National
Mississippi River Museum and Aquarium campus. Based on this decision, on June 19th
the City Council approved an Amendment NO.4 to the EDA grant which provided a six
(6) month extension on utilization of the balance of this grant funds (approximately
$297,181) until December 25, 2006.
The National Mississippi River Museum & Aquarium Expansion Project - Former Adams
Company Building Re-Roof and Structural Repairs Project will consists of re-roofing and
structural repairs at the former Adams Company Building at the Port of Dubuque. Work
includes the removal of the existing roofing and deck; installation of new steel deck,
insulation and sheet metal roofing; and installation of additional structural support to
improve the structural capabilities of the existing roof trusses.
BID RESULTS
Sealed bids were received on the project on July 27, 2006. Tricon General
Construction, Inc. of Dubuque, Iowa, submitted the low bid in the amount of
$414,000.00. Also it is recommended to select Alternate NO.2 (Metal Finishing)
(-$7,580) and Alternate NO.4 (Structural Repair) ($4,800). A summary of the base bid

RECOMMENDATION
I recommend that the contract be awarded to Tricon General Construction, Inc. in the
final amount of $411 ,220.00 which includes Alternate # 2 and Alternate #4.

RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
Whereas, on the yth day of July, 2006, plans, specifications, form of
contract and estimated cost were filed with the City Clerk of Dubuque, Iowa for
the National Mississippi River Museum and Aquarium Expansion Project -
Former Adams Company Building Re-Roof and Structural Repairs Project.
Whereas, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are
hereby approved as the plans, specifications, form of contract and estimated cost
for said improvements for said project.

Whereas, sealed proposals have been submitted by contractors for the
National Mississippi River Museum and Aquarium Expansion Project Former
Adams Company Building Re-roof and Structural Repairs EDA Project No. 05-
01-03816 pursuant to Resolution No. and notice to bidders published in a
newspaper published in the City of Dubuque, Iowa on the 7th day of July, 2006.
Whereas, said sealed proposals were opened and read on the 27th day of
July, 2006, and it has been determined that the bid of Tricon General
Construction, Inc. of Dubuque, Iowa, in the amount of $411,220.00 was the
lowest bid for the furnishings of all labor and materials and performing the work
as provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Tricon
General Construction, Inc. and the Manager be and is hereby directed to execute
a contract on behalf of the City of Dubuque for the complete performance of the
work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's
bond, the City Treasurer is authorized and instructed to return the bid deposits of
the unsuccessful bidders.

Whereas Tricon General Construction, Inc. has submitted the attached
executed contract and bond.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
1. The contract and bond attached hereto are hereby approved.
2. The City Manager is hereby authorized and directed to execute the
contract on behalf of the City of Dubuque.
