SUBJECT: Sidewalk Installation Delay Request
A request has been received from Mr. and Mrs. Michael Lombardi at 948 Spires Drive
and Mr. and Mrs. Richard Soens at 978 Spires Drive to delay the installation of new
public sidewalk on the Knight Court side of their property due to the nonexistent amount
of pedestrian traffic, no houses built on Knight Court, no impact to general usage of
pedestrian safety, and leads to undeveloped area. The two property owners have
agreed in writing to install this sidewalk at their expense at such time as development
occurs or the City Manager requires due to increase in pedestrians or future
developments in the area.
City Engineer Gus Psihoyos recommends City Council approval to delay installation of
the sidewalk on the Knight Court side for these two properties, and to amend the City
policy to include that when only one house exists on one side of a stub street, a
sidewalk would not be required until future development occurs.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The City Engineering Department has had a request from two property owners, Mr. &
Mrs. Michael Lombardi at 948 Spires Drive and Mr. & Mrs. Richard Soens at 978 Spires
Drive to delay the installation of new public sidewalk on the Knight Court side of their
property.
DISCUSSION
In November, 2005 the City Council approved revisions to the Sidewalk Inspection
Program relating to sidewalk repairs, notifications, no-patching, permit fees and new
installations within subdivisions on a case-by-case basis.
The revisions to the Sidewalk Inspection Policy identified dead-end/stub streets to
adhere to the same schedule as 50%/80% ruling of subdivision installation requirements
with the following as guidelines:
1. Amount of pedestrian traffic using the area and the safety of the pedestrians.
2. In an area where the end property owner has a driveway, the property owner would
be required to install sidewalk from the driveway to the developed side, thus abutting
the neighbors.
3. In an area where the property owner does not have a driveway, the property owner
would be required to install the entire sidewalk, even if it leads to a dead-end/stub
street.
The Council agreed also that if the sidewalk has no impact on pedestrian traffic or
safety, or if it leads to an undeveloped area on one side of a driveway, the City could
allow a delay in the sidewalk installation.
In this particular case one of the properties has a drive and the other does not.
However, there is no additional housing on this stub street; therefore, there are no
neighbors adjoining these properties on the Knight Court side.
RECOMMENDATION
The Engineering Department feels the property owners in this case have valid reasons
for delay of installation due to the nonexistent amount of pedestrian traffic, no houses
built on Knight Court, no impact to general usage of pedestrian safety, and leads to
undeveloped area.
In compliance with the revised Sidewalk Inspection Program guidelines, the two
property owners have agreed in writing to install this sidewalk at their expense at such
time as development occurs or the City Manager requires due to increase in
pedestrians or future developments in the area. This would also be an obligation to any
future owners of these properties. Also, it is recommended that when only one house
exists on one side of a stub street, a sidewalk would not be required until future
development occurs.
ACTION TO BE TAKEN
City Engineering is requesting City Council concurrence with the delay of these two
property owner's sidewalk which abuts the Knight Court side of their properties at 948
Spires Drive and 978 Spires Drive.

It is agreed, that the parties named below understand their obligation to install sidewalks.
Said sidewalks being along the property line adjacent to Knight Court. It is understood
that the City of Dubuque will not require sidewalks constructed in the named location
until the development of the street is completed.
