BUILDING CODE BOARD OF APPEALS 14 -1A -2: INTERNATIONAL BUILDING CODE AMENDMENTS: Sec. 113. Building Code And Advisory Appeals Board. A. Board Created. There is hereby created a building code and advisory appeals board. B. Mission. The mission of the building code and advisory appeals board shall be to determine the suitability of alternative building materials and methods of building construction, to provide for reasonable interpretation of the provisions of the building code, and to advise the city council on all building construction regulations and procedures. C. Internal Organization And Rules. The board may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with city or state code. D. Procedures For Operation. All administrative, personnel, accounting, budgetary, and procurement policies of the city shall govern the board in all its operations. E. Membership. 1. The building code advisory and appeals board shall consist of five (5) residents of the city of Dubuque, appointed by the city council. 2. Special Qualifications. a. One (1) member shall be an architect or engineer registered in the state of Iowa; b. One (1) member shall be a general building construction contractor; c. One (1) member shall be a journeyman carpenter; and, d. Two (2) members shall be from the public at- large. F. Terms. The term of office for members of the building code advisory and appeals board shall be three (3) years. All officers shall be eligible to serve successive terms of office. G. Vacancies. Vacancies caused by death, resignation, or otherwise shall be promptly filled by the city council for the unexpired term of office. H. Officers /Organization. The board shall choose annually, from its own membership, a chairperson and vice chairperson, each to serve a term of one (1) year. The building official, or designee, shall be secretary of the board. The board shall fill vacancies among its officers for the remainder of the unexpired term. I. Meetings. 1. Regular Meetings. The building code advisory and appeals board shall meet upon call of the chairperson, secretary or city manager. 2. Special Meetings. Special meetings may be called by the chairperson or at the written request of three (3) members by giving at least twenty -four (24) hours notice to every other member of the commission. The call for a special meeting shall include an agenda and only matters included in that agenda may be acted on at the meeting. 3. Open Meetings. All meetings shall be called and held in conformance with the Iowa open meetings law. 4. Attendance. a. In the event a member of the building code advisory and appeals board, created by this chapter, has been absent for three (3) or more consecutive meetings of the board, without being excused by the chairperson, it shall be grounds for the board to recommend to the city council that the position be declared vacant and a replacement appointed. b. Attendance shall be entered upon the minutes of all meetings. 5. Minutes. A copy of the minutes of all regular and special meetings of the board shall be filed with the city council within ten (10) working days after each meeting. 6. Quorum. Three (3) members of the board shall constitute a quorum for the transaction of business. The affirmative vote of at least three (3) members shall be necessary for the adoption of any resolution. J. Compensation. The members of the building code advisory and appeals board created by this chapter shall serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official board business and such shall be within the limits established in the city budget. K. Removal. The city council may remove any member of any board or commission which it has established. L. Powers. The building code advisory and appeals board shall have the following powers, duties, and responsibilities: 1. Any person who is aggrieved by a decision of the building official on any requirements resulting from the enforcement of the building code may appeal from such decision to the building code board and said board shall serve as an appeal board. In case the aggrieved party is a member of said board, said member shall be disqualified as a member of the board acting as an appeal board, until the person aggrieved has been heard and a decision rendered. The appeal shall be made by the person aggrieved, giving written notice of such appeal to the building official within seven (7) days of receipt of decision from which the appeal is taken. The building code board sitting as an appeal board shall meet within ten (10) working days after receiving such notice and render a decision within five (5) working days thereafter. Any interested party, including the building official, shall have the right to present their case to the appeal board, whose decision shall be final unless appealed to the district court as provided by law. The board of appeals may reverse or modify a decision of the building official only on finding that: a. The building official had incorrectly interpreted the provision of this code; or, b. The decision of the building official creates an unnecessary hardship upon the appellant. The board of appeals shall require that sufficient evidence or proof be submitted to substantiate any claims made regarding the use of alternates. All appeal hearings shall be conducted in accordance with the procedures specified in this code. On issues before the board involving the Americans with disabilities act (ADA) the board may elect to seek input from ADA advocates in the community. If the board elects to seek input from ADA advocates in the community the board shall consult with a minimum of two (2) individuals. M. Limitations Of Authority. The board of appeals shall have no authority relative to interpretation of the administrative provisions of this code nor shall the board be empowered to waive requirements of this code. In so modifying or reversing such decision of the building official, the board of appeals may authorize any alternate to the decision of the building official and the provisions, provided it finds the proposed material or method of construction is satisfactory for the use intended and complies with the provisions of this code, and that the material, method, or work offered is, for the purpose intended, at least equivalent to that prescribed by this code in suitability, strength, effectiveness, durability, fire resistance, and safety. ORDINANCE NO. 6 -08 AMENDING CHAPTER 11, BUILDINGS AND BUILDING REGULATIONS, OF THE CITY OF DUBUQUE CODE OF ORDINANCES BY ADDING A NEW ARTICLE VIII, ACCESSIBILITY CODE FOR READILY ACHIEVABLE CHANGES. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Chapter 11 of the Dubuque Code of Ordinances is hereby amended by adding the following Article VIII: ARTICLE VIII. Accessibility Code for Readily Achievable Changes Sec. 11 -84. Public accommodations. A place of public accommodation means a facility whose operations fall within one of the following categories: (a) An inn, hotel, motel, or other place of lodging, except for an establishment located within a building that contains not more than five (5) rooms for rent or hire and that is actually occupied by the proprietor of such establishment as the residence of such proprietor; (b) A restaurant, bar or other establishment serving food or drink; (c) A motion picture house, theater, concert hall, stadium or other place of exhibition or entertainment; (d) An auditorium, convention center, lecture hall or other place of public gathering; (e) A bakery, grocery store, clothing store, hardware store, shopping center or other sales or rental establishment; (f) A laundromat, dry- cleaner, bank, barber shop, beauty shop, travel service, shoe repair service, funeral parlor, gas station, office of an accountant or lawyer, pharmacy, insurance office, professional office of a health care provider, hospital or other service establishment; (g) A terminal, depot or other station used for public transportation; (h) A museum, library, gallery or other place of public display or collection; (i) A park, zoo, amusement park or other place of recreation; (j) A nursery, elementary, secondary, undergraduate, or postgraduate private school or other place of education; (k) A day care center, senior citizen center, homeless shelter, food bank, adoption agency or other social service center establishment; and (I) A gymnasium, health spa, bowling alley, golf course or other place of exercise or recreation. Sec. 11 -85. Owner defined; Landlord and tenant responsibilities For purposes of this Article, owner shall mean the owner of a building that is or houses a place of public accommodation, a landlord who owns property that is or 012408ba1 houses a place of public accommodation, and a tenant who owns or operates a place of public accommodation. Sec. 11 -86. Removal of architectural barriers if readily achievable. (a) It shall be a violation of this ordinance for an owner of a public accommodation to fail to remove architectural barriers, and communication barriers that are structural in nature, in any public accommodation, where such removal is readily achievable. The phrase "readily achievable" shall have the meaning set forth under the Americans with Disabilities Act of 1990 (42 U.S.C. 12182), as amended, and any implementing regulations. (b) Where an owner can demonstrate that the removal of a barrier under subsection (a) is not readily achievable, an owner shall nonetheless be required to make existing facilities available through alternative methods if such methods are readily achievable. Sec. 11 -87. General Enforcement. The building official is authorized to take such action as may be necessary to enforce this Article. Sec. 11 -88. Compliance agreements. In lieu of or in addition to any penalty or procedure authorized herein or by law, the building official and an owner accused of violating Chapter 11, Article VIII may enter into a written agreement providing for the proper and timely abatement of violations. A compliance agreement may include a description of the specific action that will be taken to abate violations or to provide greater accessibility, a compliance timetable, a requirement for performance security, notice procedures and reporting requirements, liquidated penalties and other items reasonably related to the proper and timely abatement of violations. A compliance agreement shall constitute a written contract between the city and the owner which may be enforced by any appropriate action at law or in equity, including an action for specific performance or injunctive relief. A compliance agreement shall run with the land and shall be recorded. The violation of a compliance agreement shall constitute a separate violation of this Article. A compliance agreement shall not relieve an owner from the continuing obligation to comply with this Article or any other law or regulation pertaining to accessibility. Sec. 11 -89. Notices and orders of building official (a) Whenever the building official has inspected or caused to be inspected any place of public accommodation and has found and determined that there exist barriers whose removal is readily achievable, the building official shall commence proceedings to cause the removal of such barriers. (b) The building official shall attempt to reach an agreement with an owner alleged to have violated this Article on a plan for proper and timely abatement of violations. Such agreement shall be in writing signed by all of the owners and 012408ba1 the building official and shall include a description of the specific action that will be taken by the owner to abate the alleged violations or to provide greater accessibility, and a compliance timetable. A failure to abate the alleged violations in accordance with the timetable shall constitute a municipal infraction. (c) If the building official and an owner alleged to be in violation of this Article are unable to reach agreement within 30 days of inspection, for the abatement of the alleged violations, the building official shall issue a notice and order directed to all of the owners of the public accommodation. The notice and order shall include: (1) The street address and a legal description sufficient for identification of the premises upon which the building is located. (2) A statement that the building official has found that barriers exist whose removal is readily achievable. (3) A statement of the action required to be taken as determined by the building official. Such order shall require that all required permits be secured therefor and the work physically commenced and completed within such time as the building official shall determine is reasonable under all of the circumstances, but not to exceed twelve months from the date of the order. (4) Statements advising (a) that an owner may appeal from the notice and order or any action of the building official to the building code and advisory appeals board, provided the appeal is made in writing as provided in this Article and filed with the building official within thirty (30) days from the date of service of such notice and order; and (b) that failure to appeal will constitute a waiver of all right to an appeal of the matter. The building code and advisory appeals board shall follow the appeals and hearing process set forth in sections 11 -26 and 11 -27 of this Chapter, except that the board shall be supplemented with two additional members as described in section 11 -89 for purposes of appeals under this Article. To receive, investigate, and finally determine the merits of complaints alleging unfair or discriminatory practices. B. To investigate and study the existence, character, causes, and extent of discrimination in public accommodations, employment, apprenticeship programs, on the job training programs, vocational schools, other educational institutions, and housing in the city and to attempt the elimination of such discrimination by education and conciliation. C. To hold hearings upon any complaint made against a person, an employer, an employment agency, a labor organization, or the employees or members thereof, to subpoena witnesses and compel their attendance at such hearings, to administer oaths and take the testimony of any person under oath and to compel such person, employer, employment agency, labor organization, or employees or members thereof, to produce for examination any books and papers relating to any matter involved in such complaint. The commission shall issue subpoenas for witnesses in the same manner and for the same purpose on behalf of the respondent upon the respondent's request. Such hearings may be held by the commission, by any commissioner, or by any hearing examiner appointed by the commission. If a witness either fails or refuses to obey a subpoena issued by the commission, the commission may petition the district court having jurisdiction for issuance of a subpoena and the court shall, in a proper case, issue the subpoena. Last session, the General Assembly passed legislation that applies this requirement to the local level. This Q &A explains background on the legislation, the new requirements in the legislation for cities and how cities can comply. Q: What are the new requirements for gender balance on city boards and commissions? A: During the 2009 legislative session, legislation (HF243) was passed that extends to cities and counties gender balance require- ment for all appointive boards, commissions, committees and councils created by the Iowa code. In other words, bodies cities are required to have under Iowa code when they provide certain functions or services, such as the planning and zoning commission, library boards and the board of adjustment, with appointed (not elected) members, must be gender balanced. Q: What does `gender balanced' mean? A: Gender balance means if the body has an even number of ap- pointees, it must be evenly made up of men and women. For exam- ple, three women and three men must serve on a six member board. If the body has an odd number of appointees, it must be "one half plus one" of either gender. For instance, if there are five members, three could be men and the other two women, or vice versa. Q: When do the changes go into effect? A: Cities must have gender balanced boards, commissions, com- mittees and councils by January 1, 2012. This does not prohibit an individual whose term expires prior to January 1, 2012, from being reappointed even though the reappointment continues an inequity in gender balance; however, cities should start planning upcoming appointments now, to ensure gender balance is reached by that date. Making a chart of existing boards and upcoming vacancies, and/ or keeping track of current appointments and necessary recruit- ing periods would be a good start to ensuring your city is tracking gender balance, and is prepared for the January 1, 2012 implementa- tion date. Q: Is there any option if my city simply cannot find a person to serve on the board or commission of the needed gender? A: Yes. Under the new code section, cities that make a good faith effort to find a qualified person of the necessary gender to fill the position for a period of three months and are unable to do so may appoint a person to the position regardless of the gender balance requirement. Q: What constitutes a "good faith effort "? A: There is no hard and fast definition, but cities should be able to demonstrate a legitimate effort during the three month time period to recruit qualified members of the necessary gender, before appointing a member that creates gender imbalance. In addition, the legislation requires that cities must always "utilize a fair and unbiased method of selecting the best qualified applicants," regard- less of gender. Q: Is there a reporting requirement? A: No. The legislation did not include a reporting requirement; however, many cities keep information on their boards and commissions — including current members- posted online, to better inform citizens of the makeup of local governing bodies. Q: How can I recruit more women or men to volunteer for these positions? A: The Commission on the Status of Women has prepared a guide to help cities learn how to recruit gender balanced boards and com- missions. This resource can be found at www.women.iowa.gov / whats_new /index.html. The Commission also prepared a guide called the "Five Step Guide to City and County Boards and How to Get Appointed" to be used as a tool by interested women to learn more about how to get involved in city boards and commissions. Undertaken for the city of North Liberty, this project involves a membrane bioreactor method of treating wastewater and provides a significantly higher effluent water quality compared to conventional wastewater treatment processes. Used on a limited basis in the U.S. it is the first of its kind in Iowa. The city has certainly "gone the extra mile" to improve the water quality in their receiving stream; they are to be commended for their foresight and respect for the environment.
