SUBJECT: Alley Vacating Petition
In response to a request from Loras College to vacate the westerly 30 feet of the alley
between West 16th Street and West 1 th Street west of Catherine Street, City Engineer
Gus Psihoyos states that the City has no plans for this property, no public utilities exist
in the property so it not necessary to reserve any easement rights, and recommends
approval of the request to vacate for the purchase price of $1 ,290, plus platting,
publication and filing fees. It is further recommended that a public hearing be set on this
matter for September 5, 2006.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Alley Vacating Petition

INTRODUCTION
This is in response to a request from Loras College for the vacating of the
westerly 30 feet of the alley between West 16th Street and West 1ih Street west
of Catherine Street.
DISCUSSION
The attached plat shows the alley area proposed to be vacated. The abutting
properties are owned by Loras College.
The area to be vacated is platted as Lot 44A of Yates' Subdivision of Outlots 780
and 713. Said Lot 44A is an existing 20-foot wide alley on which no public
utilities exist. No easement rights will be reserved on the area being vacated.
The property has been valued at $2.15 per square foot, for a total of $1 ,290.00.
RECOMMENDATION
The City has no rlans for the utilization of the westerly 30 feet of the alley
between West 16t Street and West 1ih Street west of Catherine Street to be
vacated.
I would recommend that the areas indicated by Lot 44A of Yates' Subdivision of
Outlots 780 and 713 on the attached plat be vacated, and that a public hearing
be held for the vacating and disposition of the City's interest in the subject area
on September 5, 2006. I would further recommend that the purchase price be
established at $1,290.00, plus platting, publication, and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public
hearing should be scheduled on the vacating and disposal of the property
through adoption of the enclosed resolutions.

RE: Vacate City Property
Dear Mayor and Council Members:
This letter is written to inquire about the possibility of purchasing a portion of a city alley
abutting our property between Lots 44 & 45 of Yates's Subdivision ofOutlots 780 and 713. Lot
44 is bordered on its south by West 16th Street and the alley mentioned above to its north. Lot 45
is bordered on its north by West 17TH Street and by said alley on its' south. Both lots, 44 & 45
are located just east of the Loras College tennis courts on 17th Street. Lots 44 & 45 both have
structures on them which are scheduled for demolition to accommodate a parking lot for the
proposed Athletic and Wellness Center. The area ofthe alley mentioned herein falls between
lots 44 & 45 and is needed for the proposed parking area.
The City Engineering Department has been contacted and they have indicated a favorable
condition for the vacating but may need easements reserved for utilities. We understand that the
vacated area would need to be surveyed and platted at our expense and a fee paid for the parcel,
plus publication and filing fees. Please call me at 588-7011 if you have any questions.

RESOLUTION NO. 380-06
RESOLUTION OF INTENT TO VACATE AND DISPOSE OF CITY INTEREST
IN LOT 44A OF YATES' SUBDIVISION OF OUTLOTS 780 AND 713 IN THE
CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, Loras College has requested the vacating and disposal of the westerly
30 feet of the alley between West 16'h Street and West 17'h Street west of Catherine
Street; and
Whereas, IIW Engineers & Surveyors, PC has prepared and submitted to the
City Council a plat showing the vacated portion of westerly 30 feet of the alley between
West 16'h Street and West 17'h Street west of Catherine Street and assigned a lot
number thereto, which hereinafter shall be known and described as Lot 44A of Yates'
Subdivision of Outlots 780 and 713 in the City of Dubuque, Dubuque County, Iowa,
should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to vacate and dispose of its
interest in Lot 44A of Yates' Subdivision of Oullots 780 and 713 in the City of Dubuque,
Dubuque County, Iowa.
Section 2. That the conveyance of Lot 44A of Yates' Subdivision of Outlots
780 and 713 in the City of Dubuque, Dubuque County, Iowa, to Loras College be
contingent upon the payment of $1 ,290.00, plus platting, publication, and filing fees.
Section 3. That the City Clerk be and is hereby authorized and directed to
cause a notice of intent to vacate and dispose of said real estate to be published in the
manner as prescribed by law.
