SUBJECT: Fourth Street Extension Vacating
City Engineer Gus Psihoyos recommends City Council approval to vacate the Fourth
Street Extension in the City of Dubuque and to set a public hearing on the vacation for
September 5, 2006. The City plans to reconstruct the street in this area to provide
access to the Shot Tower and parking areas adjacent to the brewery. The vacated
portion of Fourth Street Extension and other adjacent City properties, including the
recent railroad purchase, will be replatted to provide the necessary right-of-way for the
street.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Fourth Street Extension Vacating
INTRODUCTION
This is a request from the Engineering Department for the vacating of Fourth
Street Extension in the City of Dubuque, Dubuque County, Iowa.
DISCUSSION
The attached plat shows the area proposed to be vacated. The abutting
properties are owned by the City of Dubuque and Dubuque Initiatives.
The area to be vacated is platted as Lot W in Dubuque Harbor Improvement
Company Addition in the City of Dubuque, Dubuque County, Iowa. Lot W is an
existing street on which public utilities exist. Easement rights will be reserved on
the area being vacated for existing utilities.
RECOMMENDATION
The City plans to reconstruct the street in this area to provide access to the Shot
Tower and parking areas adjacent to the brewery. This vacated portion of Fourth
Street Extension and other adjacent City properties, including the recent railroad
purchase, will be replatted to provide the necessary right-of-way for the street.
I would recommend that the area indicated by Lot W in Dubuque Harbor
Improvement Company Addition in the City of Dubuque, Dubuque County, Iowa,
on the attached plat be vacated, and that a public hearing be held for the
vacating of the subject area on September 5, 2006.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public
hearing should be scheduled on the vacating of the property through adoption of
the enclosed resolution.

RESOLUTION OF INTENT TO VACATE LOT W IN DUBUQUE HARBOR
IMPROVEMENT COMPANY ADDITION IN THE CITY OF DUBUQUE,
DUBUQUE COUNTY, IOWA
Whereas, the City of Dubuque Engineering Department has requested the
vacating of Fourth Street Extension; and
Whereas, WHKS & Co. has prepared and submitted to the City Council a plat
showing the vacated Fourth Street Extension, except for reserving the utility easements
as noted, and assigned a lot number thereto, which hereinafter shall be known and
described as Lot W in Dubuque Harbor Improvement Company Addition in the City of
Dubuque, Dubuque County, Iowa, should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to vacate Lot W in Dubuque
Harbor Improvement Company Addition in the City of Dubuque, Dubuque County, Iowa.
Section 2. That the City Clerk be and is hereby authorized and directed to
cause a notice of intent to vacate of said real estate to be published in the manner as
prescribed by law.
