SUBJECT: Voluntary Annexation Request of Dubuque Bank & Trust
Dubuque Bank & Trust has requested annexation of their Key West branch office,
consisting of 0.52 acres of property at 2690 Rockdale Road, in conjunction with
rezoning to C-3 General Commercial District.
Planning Services Manager Laura Carstens recommends that a public hearing be set
for September 18, 2006 on the voluntary annexation request.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Introduction
This memo transmits a request from Dubuque Bank & Trust (DB&T) for annexation of
the Key West branch office, consisting of 0.52 acres of property at 2690 Rockdale
Road, in conjunction with rezoning to C-3 General Commercial District. A staff report,
resolution, and application materials concerning the DB&T request are enclosed.
Discussion
On September 6, 2006, the Zoning Advisory Commission has a public hearing
scheduled on the C-3 rezoning.
The City Council's public hearing on the rezoning request should be held concurrently
with the public hearing on the annexation. Staff recommends that a public hearing be
held at the City Council's September 18, 2006 meeting to meet State Code notification
requirements for annexations.
DB&T is requesting that the property be annexed and zoned C-3 to allow installation of
a message center sign, which County zoning does not allow. DB&T has been informed
that City water is nearby, but that City sanitary sewer is not, and there is no plan to
extend sewer in the next 5 years.
Recommendation
I recommend that a public hearing on the voluntary annexation request of DB&T be set
for the City Council's September 18, 2006 meeting.

Dear Mr. Mayor and Members of the City Council:
We, Dubuque Bank & Trust Company, hereby make application pursuant to Iowa Code Chapter
368 for the voluntary annexation into the City of Dubuque of certain land owned by us and
legally described as follows:
Lot 2-1-1-1-3 of Annie Waller Sub Division #2
Parcel No. 15-01-377-006,
commonly known as the Dubuque Bank & Trust Co. branch office located at 2690 Rockdale
Road, Dubuque, Iowa.
The attached map shows the property to be annexed outlined in red. The present boundary of the
City of Dubuque is outlined in blue.
We also propose that the property be zoned C-3, General Commercial, as described in the City of
Dubuque Code of Ordinances, and we plan to work with Planning Services to that end in the
event that the above-referenced land is annexed by the City of Dubuque.
We ask that you put this matter on the next available agenda for the City Council. Should you

RESOLUTION NO. -06
RESOLUTION APPROVING APPLICATION FOR VOLUNTARY ANNEXATION OF
TERRITORY TO THE CITY OF DUBUQUE, IOWA
Whereas, Dubuque Bank & Trust, the property owner, has submitted a written
application for voluntary annexation of approximately 0.52 acre of land to the City of
Dubuque, Iowa; and
Whereas, the annexation territory is not subject to an existing annexation
moratorium agreement; and
and
Whereas, the annexation territory does not include any State or railroad property;
Whereas, Iowa Code section 368.7 authorizes the extension of City limits in
situations of this character by adoption of a resolution after notification and public hearing;
and
Whereas, this annexation is consistent with the Comprehensive Plan of the City of
Dubuque; and
Whereas, the City of Dubuque has the capacity to provide substantial municipal
services to the annexation territory; and
Whereas, the annexation is in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the application of Dubuque Bank & Trust, the property owner, for
voluntary annexation of approximately 0.52 acre of land of territory lying outside of the
corporate limits of the City of Dubuque, Iowa, as shown on Exhibit A and legally described

as Lot 2-1-1-1-3 of Annie Waller Subdivision # 2 is hereby approved for annexation to the
City of Dubuque, Iowa.
Section 2. That, subject to the approval of the Secretary of State, the corporate
limits of the City of Dubuque, Iowa, be and they hereby are extended to include the
approximately 0.52 acre of annexation territory as shown on Exhibit A.
Section 3. That the City Council of Dubuque, Iowa, does hereby certify that the
City of Dubuque has complied with the notice and hearing requirements of the Iowa Code
pertaining to voluntary annexation of territory outside an urbanized area of another city.
Section 4. That if Secretary of State approves this annexation, the territory hereby
annexed shall become a part of Precinct One of Ward One of the City of Dubuque, Iowa.
Section 5. That the City Clerk shall file this resolution, all exhibits and the
applications for voluntary annexation with the State of Iowa in accordance with the
provisions of Chapter 368 of the Iowa Code.

Puroose: The bank has requested annexation concurrent with commercial zoning to
allow construction of a message center sign, which is not allowed in the County.
Phvsical Characteristics: The subject property is located near the intersection of
Rockdale Road, Maquoketa Drive, and U.S. 61/151. It has been used for a Dubuque
Bank & Trust branch office since its construction in 1976.
Conformance with Comprehensive Plan: The Comprehensive Plan includes goals
and objectives supporting annexation of land for commercial development that is
readily served by City infrastructure and utilities. This request is consistent with the
Comprehensive Plan's Land Use Element: Goals 2.2, 2.3, and 6.1, 6.2, and 6.3. The
2002 Proposed Land Use Map of the Comprehensive Plan designated this area for
residential development.
Impact of Request on:
Utilities: City water is available along the right-of-way of Rockdale Road. Sanitary
sewer is not in the area, and an extension is not in the 5-year CIP.

Traffic Patterns/Counts: The subject area will be served by Rockdale Road. Based on
2005 lOOT counts, U.S. 61/151 carries approximately 15,500 average daily trips and
Rockdale Road carries approximately 5,200 average daily trips.
Public Services: Existing public services will be adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment since
the bank proposes to construct only a message center sign.
Adiacent Prooerties: The most likely impacts to adjacent properties may be a slightly
higher ambient light level than existing in the area with installation of a message center
sign.
CIP Investments: None proposed. The applicant has been informed that City water is
nearby, but that City sanitary sewer is not, and there is no plan to extend sewer in the
next 5 years.
Staff Analysis and Recommendation:
The applicant is requesting annexation of the subject property to the City of Dubuque
concurrent with rezoning to C-3 General Commercial District. Land that is annexed to
the City that is not rezoned as part of the annexation process automatically comes in as
agricultural.
The applicant is requesting that the 0.52-acre property be zoned C-3 to allow
installation of a message center sign, which County zoning does not allow. The C-3
district is intended to provide commercial uses which are designed to serve the
motoring public or uses requiring highway or arterial locations for their most beneficial
operation and which cannot be more appropriately located in other commercial districts.
The property requested for annexation lies outside the urbanized area of any other city.
Iowa Code allows for these types of voluntary annexation requests be approved first by
the City Council, and then by the Secretary of State. The property meets Iowa Code
requirements for 50 feet of adjacent boundary for annexation to the City of Dubuque.
The property is included in the City's 1996-1997 Annexation Study as a preferred area
for annexation due to its proximity to the City limits, infrastructure and utilities.
Staff recommends approval of the annexation request.
