City Engineer Gus Psihoyos recommends City Council acceptance of the storm sewer
improvements in Timber Hyrst Estates No. 2 and Timber Hyrst Place No. 2, which the
owners, Robert and Beth Hartig, have recently completed. Maintenance of the erosion
control devices at the outfall area of the relocated storm sewer shall be the
responsibility of the property owner in perpetuity.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of storm sewer
improvements in Timber Hyrst Estates No. 2 and Timber Hyrst Place No. 2 which the
owners, Robert and Beth Hartig have recently completed.
BACKGROUND
As a condition of Storm Sewer Relocation Agreement dated May 21, 2013, the owners
of Lot 2 Timber Hyrst Estates No. 2 and Lot 1 Timber Hyrst Place No. 2 were required
to install certain public improvements including storm sewer and said improvements
were to be dedicated to the City upon completion.
DISCUSSION
Upon inspection, it has been determined that the public improvements consisting of
storm sewer required by said Storm Sewer Agreement dated May 21, 2013 have been
completed in accordance with plans approved by the City Council and in conformance
with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvement
consisting of storm sewer. Maintenance of the erosion control devices at the ouffall area
of the relocated storm sewer shall be the responsibility of the property owner in
perpetuity.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements consisting of storm sewer in Timber Hyrst Estates No. 2 and Timber
Hyrst Place No. 2 in the City of Dubuque, County of Dubuque, Iowa.

RESOLUTION NO. 244 -13
ACCEPTING STORM SEWER IMPROVEMENTS IN TIMBER HYRST
ESTATES NO. 2 AND TIMBER HYRST PLACE NO. 2
Whereas, pursuant to a Storm Sewer Relocation Agreement dated May
21, 2013, certain public improvements including a storm sewer extension were
installed by Robert and Beth Hartig, Owners of Lot 2 Timber Hyrst Estates No. 2
and Lot 1 Timber Hyrst Place No. 2 ; and
Whereas, the storm sewer extension has been completed and the City
Manager has examined the work and has filed a certificate stating that the same
has been completed in accordance with the plans approved by the City Council
and in conformance with City specifications, and has recommended that the
storm sewer extension be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said storm sewer extension in Timber Hyrst Estates No. 2 and Timber
Hyrst Place No. 2 be and the same is hereby accepted.
Section 2. That maintenance of permanent erosion control devices at
the effluent end of said storm sewer extension shall be the responsibility of
Robert and Beth Hartig, Owners of Lot 2 Timber Hyrst Estates No. 2 and Lot 1
Timber Hyrst Place No. 2, in perpetuity.
