Title 10, Chapter 5 of the City of Dubuque Code of Ordinances is amended to read as follows: Chapter 5 PARKS AND RECREATION ARTICLE A. ADMINISTRATION 10 -5A -2: PARK AND RECREATION ADVISORY COMMISSION: C. Powers: The responsibilities of the commission are to advise the city council on: 1. Use Of Grounds And Facilities: The establishment of rules and regulations governing the use of all grounds and facilities that have been or may be set aside as public parks, playgrounds, trails, open spaces, and other such park and recreation facilities and grounds. Such rules and regulations shall include, but are not limited to: ARTICLE B. USE REGULATIONS 10 -5B -1: DEFINITIONS: As used in this article, the following terms shall have the following meanings: Port of Dubuque Marina: That part of the Port of Dubuque that serves as the Marina bordered by the Ice Harbor. Port of Dubuque Riverwalk trail: A linear trail area paralleling the Mississippi River and Ice Harbor in the Port of Dubuque. Power Line trail: A linear trail running from Grandview Avenue near Murphy park to Julien Dubuque Drive. Pyatigorsk park: Area located at the northeast corner of Sixteenth Street and Kerper Boulevard, west of the Jaycees trail and south of the Highway 151 Bridge. Riley park: Lot E of Crescent Heights Subdivision. Rocco Buda Jr. park: Lot 1 of 1 of 1 of 810 A. McDaniels Subdivision. Southern park: Beginning at the NW Corner of Lot 1 of said John Breakey's Addition; thence S46°223/4W, 315.98 ft., along the Northwesterly line of said John Breakey's Addition; thence S81°011/4'W, 12.72 ft.; thence S38 °473/4 E, 64.04 ft.; thence S51 °121/4'W, 46.36 ft.; thence N38 °473/4'W, 78.87 ft.; thence S68 °573/4W, 111.56 ft.; thence S35 °45'W, 84.25 ft.; thence S42 °39'E, 218.28 ft. Trolley Line trail: A linear trail running from Mathia S Ham House to welcome area at entry of Eagle Point Park and a part of Eagle Point park. Usha park: Lot 1 of Lot 2 of Lot 1 of Byrne's Subdivision in the city of Dubuque, Iowa. Valentine park: Lot 1 of the Subdivision of Lot 1 of Lot 1 of Lot 1 of McLean Heights and Lot 4 in Block 2 of Marna Ridge Estates 2 in the city of Dubuque, Iowa. Valley High park: Lot 2 of Lot 1 of Lot 1 of Lot 1 in Mineral Lot 337 and Lot 5 in Wiegand's Subdivision, all in the city of Dubuque, Iowa. Van Milligen, City Manager Dubuque band AI- America City IIIii! 2007 • 2012 • 2013 SUBJECT: Park and Recreation Ordinance Amendment Recommendations Related to Animals, Definitions and Descriptions DATE: July 23, 2013 Leisure Services Manager and the Park and Recreation Commission recommend an ordinance amendment permitting leashed dogs and cats on certain trails, adding definitions, restricting horse drawn vehicles, establishing clean -up requirements, and revising park, open space and trail descriptions. The current ordinance has a limited number of City of Dubuque parks /areas that allow leashed pets. They are permitted in Granger Creek Nature Trail, John G. Bergfeld Recreation Area, Medical Associates Greenbelt Park and Miller Riverview Park. Unleashed pets are allowed in the Pet Park. The addition of the definition and descriptions will aid citizens and staff, including enforcement staff in the clear understanding of the ordinance and all areas that the ordinance covers. The recommended changes clearly define where leashed cats and dogs can and cannot be. The recommended ordinance contains the addition of four trails to the list of areas permitted for leashed dogs and cats. Ware, Leisure Services Manager DATE: July 29, 2013 SUBJECT: Park and Recreation Ordinance Amendment Recommendations Related to Animals, Definitions and Descriptions INTROD UCTION The purpose of this memo is to recommend an ordinance amendment permitting leashed dogs and cats on certain trails, adding definitions, restricting horsedrawn vehicles, establishing clean -up requirements, and revising park, open space and trail descriptions. BACKGROUND The recent policy decision by the City Council related to pets in parks included consideration of an ordinance which contained adding definitions including trails and open spaces, restricting horsedrawn vehicles, establishing clean -up requirements and revising park, open space and trail descriptions. These section additions assisted in clarifying the current ordinance and adding trails and their descriptions. The Park and Recreation Advisory Commission had also reviewed the horsedrawn vehicle section and suggested updates. During the proposed pets in parks ordinance discussion the question of dogs on trails was asked. In reviewing that question with the city's legal department found the following: The definition of park/parkway is as follows: PARKS OR PARKWAYS: Parks, parkways, buildings park roads or driveways, and all public service facilities or grounds, buildings and structures in and adjacent to the city, which are under the responsibility of the commission. The Park and Recreation Advisory Commission's responsibilities /powers include advising the City Council on the use of all grounds and facilities that have been or may be set aside as public parks, playgrounds and other such park and recreation facilities. Based on the above information the trails and open spaces fall under the jurisdiction of the Park and Recreation Advisory Commission. The Park and Recreation Advisory Commission and City Council currently prohibit animals in parks or parkways that includes trails and open spaces. Trails are not specifically defined in the city's ordinance. Staff from Legal, Leisure Services, Health Services and Police worked on language so that trails and open spaces are now defined and described just as parks. This clarity will assist staff and the public in being clear when questions are asked about trails and open spaces. The parks and trails system has grown significantly since the last update of the descriptions. Trails have been used by pet owners with some signs of no dogs on trails and others with signs reminding pet owners to pick up after their dog. Most trails currently have no signage. The current ordinance has a limited number of City of Dubuque parks/areas that allow leashed pets. They are permitted in Granger Creek Nature Trail, John G. Bergfeld Recreation Area, Medical Associates Greenbelt Park and Miller Riverview Park. Unleashed pets are allowed in the Pet Park. DISCUSSION The addition of the definition and descriptions will aid citizens and staff, including enforcement staff in the clear understanding of the ordinance and all areas that the ordinance covers. RECOMMENDATION The Park and Recreation Advisory Commission at their June 2013 meeting voted to recommend the attached ordinance. They voted 6 -1 in favor of the ordinance. They recommend Council approval. COMMISSION OR THE COMMISSION: The park and recreation advisory commission. DOG: Both male and female animals of the canine species whether neutered or not, but not including a law enforcement dog. DOMESTICATED ANIMAL: An animal commonly referred to as a bovine, swine, sheep, goat, domesticated deer, llama, poultry, rabbit, horse, pony, mule, jenny, donkey, or hinny. KEEPER: A person other than the owner keeping, sheltering, having control or custody of or harboring an animal. LEISURE SERVICES MANAGER: Leisure services manager or leisure services manager's designee. MULTI - PURPOSE USE TRAIL OR TRAILS: A hardened trail of asphalt, concrete or other impervious surface, typically ten (10) to twelve (12) feet wide and physically separated from the motorized vehicular traffic by an open space or barrier and either within highway public right -of -way or private property within an independent alignment for use by pedestrians, skaters, joggers, bicyclists, and city maintenance vehicles. OPEN SPACES: Open spaces available to the public for passive recreational use in and adjacent to the city, which are under the responsibility of the commission. OWNER: A person owning a cat, dog, or other animal. PARKS OR PARKWAYS: Parks, parkways, buildings, park roads or driveways, and all public service facilities or grounds, buildings and structures in and adjacent to the city, which are under the responsibility of the commission. 10 -5B -2: INTOXICATING BEVERAGES: A. Possession, Consumption, Or Use Of Alcoholic Liquor, Wine, Beer, Or Other Intoxicating Beverages Prohibited: 1. The possession, consumption, or use of alcoholic liquors, wine, and beer as defined by chapter 123 of the code of Iowa or any other intoxicating beverages is prohibited on park roadways and trails, in park and recreation facility parking lots, and in vehicles located within a park. B. Exemptions: 1. Locations Exempt: Subsection A2 of this section shall not apply to the possession, consumption, or use of alcoholic liquors, wine, beer, or other intoxicating beverages at: a. Alliant Energy Amphitheater events for which a special events permit has been issued under Title 10, Chapter 4; b. American Trust River's Edge Plaza events for which a special events permit has been issued under Title 10, Chapter 4; Mississippi Riverwalk events for which a special events permit has been issued under Title 10, Chapter 4; 10 -5B -3: HORSEDRAWN VEHICLES, RIDING OF ANIMALS RESTRICTED: Horsedrawn vehicles or the riding of horses or any other domesticated animals used for such purposes is prohibited in any park, parkway, trail, or open space unless permission is granted by the Leisure Services Manager and thereafter authorized through the issuance of a city special event permit under Title 10, Chapter 4. 10 -5B -4: DOGS, CATS AND OTHER DOMESTIC ANIMALS: B. Leashed Dogs And Cats Allowed In Certain Parks And Areas. 1. Notwithstanding the foregoing, leashed dogs and cats shall be permitted in the following: A.Y. McDonald Park Granger Creek Nature Trail Heritage Trail Jaycee Trail John G. Bergfeld Recreation Area Medical Associates Greenbelt Park Miller- Riverview Park Northwest Arterial Trail Port of Dubuque Marina Port of Dubuque Riverwalk Trail Powerline Trail Pyatigorsk Park Southern Levy Trail 2. Leashed dogs and cats as allowed in Section 10- 5B- 4(B)(1) are subject to and must comply with the provisions of Title 7, Chapter 6 of the City of Dubuque Code of Ordinances. 3. The owner or keeper must pick up and dispose of or take away the dog or cat's waste. 4. The owner or keeper is responsible for the actions of the dog or cat. D. Exceptions: This section does not apply to: 1. Service animals used by persons with disabilities; 2. As part of an approved and permitted special event under Title 10, Chapter 4; and 3. Animals which are part of the Storybook Hill Petting Zoo at Franklin Delano Roosevelt Park. 4. Animals within Eagle Point Park, Murphy Park and Flora Park which are confined to an automobile, camper, motorhome (a /k /a recreational vehicle), or other similar conveyance during the entirety of their time within the designated park(s). 10 -5B -5: WALKING ON GRASS: No person may go on foot or otherwise upon the grass or turf of any park, parkway, trail, or open space where any prohibitory sign is posted. 10 -5B -6: THROWING STONES OR OTHER MISSILES: No person may throw any stone or any other missile within any park, parkway, trail, or open space. 10- 5B -12: POSSESSION OF FIREARMS, WEAPONS AND FIREWORKS: A. Prohibition: The possession of firearms, air rifles, bows and arrows, pellet guns or slingshots, or fireworks of any description by any person within the limits of any park, parkway, trail, or open space is hereby prohibited unless authorized through the issuance of a city special event permit under Title 10, Chapter 4. B. Deer Hunting With Bow And Arrow: 1. Bow and arrow hunting will only be allowed on city property in accordance with the annual Deer Management Program adopted by the Environmental Stewardship Advisory Commission and the city council. 2. Exception: An exception to these rules may be granted if approved through a city of Dubuque special events permit. 10- 5B -22: OPEN SEASON AND HOURS GENERALLY: H. DOMESTICATED ANIMAL: An animal commonly referred to as a bovine, swine, sheep, goat, domesticated deer, llama, poultry, rabbit, horse, pony, mule, jenny, donkey, or hinny. KEEPER: A person other than the owner keeping, sheltering, having control or custody of or harboring an animal. LEISURE SERVICES MANAGER: Leisure services manager or leisure services manager's designee. MULTI - PURPOSE USE TRAIL OR TRAILS: A hardened trail of asphalt, concrete or other impervious surface, typically ten (10) to twelve (12) feet wide and physically separated from the motorized vehicular traffic by an open space or barrier and either within highway public right -of -way or private property within an independent alignment for use by pedestrians, skaters, joggers, bicyclists, and city maintenance vehicles. OPEN SPACES: Open spaces available to the public for passive recreational use in and adjacent to the city, which are under the responsibility of the commission. OWNER: A person owning a cat, doctor other animal. PARKS OR PARKWAYS: Parks, parkways, buildings, park roads or driveways, and all public service facilities or grounds, buildings and structures in and adjacent to the city, which are under the responsibility of the commission. 10 -5B -2: INTOXICATING BEVERAGES: A. Possession, Consumption, Or Use Of Alcoholic Liquor, Wine, Beer, Or Other Intoxicating Beverages Prohibited: 1. The possession, consumption, or use of alcoholic liquors, wine, and beer as defined by chapter 123 of the code of Iowa or any other intoxicating beverages is prohibited on park roadways and recreational trails, in park and recreation facility parking lots, and in vehicles located within a park. B. Exemptions: 1. Locations Exempt: Subsection A2 of this section shall not apply to the possession, consumption, or use of alcoholic liquors, wine, beer, or other intoxicating beverages at: a. Alliant Energy Amphitheater events for which a special events permit has been issued under Title 10, Chapter 4; b. American Trust River's Edge Plaza events for which a special events permit has been issued under Title 10, Chapter 4; I. Deer Hunting With Bow And Arrow: Nothing herein shall prohibit the hunting with bow and arrow of deer by persons licensed by and during the period of time authorized by the Iowa department of natural resources and issued a permit by the city. 1. DISCUSSION The pets in parks enforcement plan for Leisure Services is based on job classification. Full-Time and Seasonal Park Maintenance employees All employees in this job classification are now required to make contact any time there is a pet in the park. These employees request compliance, educate and fill out a detailed log sheet. They do not issue warnings or citations. Seasonal Park Patrol employees All employees in this job classification are now required to make contact any time there is a pet in the park. These employees will also check the tags on the pet for current licenses and vaccinations. Compliance is requested, education completed and a detailed log sheet filled out. Seasonal park patrol is not authorized to write municipal infractions. Per city ordinance, seasonal park patrol can write municipal infractions once approved and trained to do so. Full time Park Patrol officers The two full time employees in this job classification are required to make contact any time there is a pet in the park. They check for violations of the animal control ordinance and parks and recreation ordinance for issues such as current licenses and vaccinations, no leash, or unlawful deposit and issue municipal infractions as appropriate. All instances are logged on log sheets as well as calls for service. The Parks Division Manager is responsible for monitoring the pets in parks enforcement plan. Log sheets are collected and reports prepared regarding enforcement efforts. RECOMMENDATION: This is provided for informational purposes. DISCUSSION Signs and Pet Waste Dispensers Throughout the park system there are parks with no signs (a sign for the park and/or any rules signs) and some signed with no pets signs. There were also parks that even though the ordinance stated no dogs allowed in parks, there were signs present requesting pet owners pick up after their pets. Some of these locations also had pet waste stations. Parks department personnel have been removing pet waste dispensers in any areas that by ordinance there is no pets allowed. They have also been removing the signs that remind persons to pick up after their pets in areas where no pets are allowed. Another inconsistent sign removed was a sign at Bergfeld Recreation Area that stated dogs must be leased when park users are present. This was inconsistent with the leash law. Most have now been removed. Signs that are on trails have not been removed at this time. The removed pet waste station will be kept and installed in locations where dogs are allowed. Throughout the discussions related to dogs in parks the Parks and Recreation Commission felt it was very important to share the rules related to pets in parks through consistent signage. They felt it would be important to not only post rules related to pets but other rules such as park hours, whether alcohol was allowed or other specific regulations per each park area. The signs would better inform our park patrons of the rules governing each park and could serve as a welcoming sign to the park for some park areas with no park sign. The Park and Recreation Commission at a spring meeting reviewed examples of 12" x 18" signs and 24" x 30" signs that could be used for posting regulations related to pets in parks and potentially other pertinent information. The Commission agreed that 24" x 30" sign size would be best for posting all information related to rules and information for each specific park or trail versus numerous signs. They agreed that secondary entrances would be best served with 12" x 18" signs. The Commission wanted the sign size appropriate to the park or area. The costs for signing no pets in parks is as follows: Signs, posts and bolts $ 3,936 Installation of signs $ 1,750 $ 5,686 Jenny Larson, Budget Director, identified funding the signage and installation of approximately $5,800 with Airport rents and concessions revenue which is over budget by $5,820. Once the City Council has resolved the ordinance these signs will be designed, purchased and installed. Park Department Policy Review In reviewing parks department policy related to dogs in vehicles at Eagle Point Park we found that Eagle Point fee collectors followed this policy that has been established for many years: "If you observe pets inside of a vehicle entering the park, you must inform the owner of this rule (Dogs, cats, etc are not allowed in city parks) before you collect the entrance fee. If they still wish to enter the park, advise them that the pet must be kept in the vehicle the entire time that they are in the park." This policy means that pets are and have been in parks (in vehicles). In speaking with staff many persons do come and drive through Eagle Point Park on a daily basis, especially elderly persons. Some just drive through and some leave their pets in their cars as they walk in the park. Because vehicles drive in and through Murphy and Flora Parks this likely happens at these two parks as well. We have worked with Crenna Brumwell, Assistant City Attorney on language that has now been recommended to update our ordinances to allow for this to policy to continue as a part of the proposed ordinance change. The proposed change would be under exemptions to no pets in parks and would be proposed as "Animals within Eagle Point Park, Murphy Park and Flora Park which are confined to an automobile, camper, motorhome (a /k/a recreational vehicle), or other similar conveyance during the entirety of their time within the designated park(s)." This proposal is a part of the ordinance proposal related to dogs on trails and other park and recreation ordinance updates contained in a separate memo. ACTION REQUESTED This memo is to request approval for purchase and installation of the proposed signage at each park once the City Council has acted upon the ordinance proposal. Dalsing Chief of Police RE: Animal Calls INTRODUCTION The purpose of this memo is to update you on past calls for service and enforcement activities, and the Dubuque Police Department's plans for future enforcement. BACKGROUND On April 15, 2013 a meeting was held between you, me, and representatives from the Health Dept. and Park Dept. to discuss past and future enforcement of domestic animal related issues. Everyone present was asked to review their departments' past activities and develop a plan of action for addressing ongoing issues. DISCUSSION Generally the Dubuque Police Department is third in lines for calls involving parks and/or animals depending on the season, day of week and hour of the day. Animal Control and the Park Officers would be the primary responding units if they are available. However, due to the limitations of staffing and staff hours of both departments and the fact the Park Officers are seasonal, the Dubuque Police Department does respond to many calls involving parks and animals and is often the primary department. The second category All CFS in Dubuque Parks includes any type of call from disorderly conduct to found property. For informational purposes, an official Call for Service (CFS) occurs when a citizen reports an incident to Dispatch or an officer self- initiates a call and it is logged into the master computer system and a case number is automatically generated. Not all officer activities and citizen contacts generate a CFS. Officers are encouraged to generate a CFS on any official activities but some incidents do not warrant one based on the limited time used. Minor issues like giving directions to a motorist or removing a street hazard are common examples of situations where an officer may not generate a CFS. Officers have a great deal of discretion when it comes to enforcement. Traditionally simple domestic animal issues that an officer might observe, whether in parks or in other public areas, have been handled through warnings and education. This would also be a common situation where officers haven't always generated a CFS as the encounters are usually brief and pet owners are usually cooperative. During the recent City Council discussion on changes to the animal ordinances, there was much discussion on enforcement of the existing ordinances and the appearance that enforcement is lacking. At the April 15th meeting you directed staff to review past activities as well as implement a plan to increase enforcement efforts. On April 22, 2013 I issued an internal memorandum to all personnel directing them to be more aware of animal violations, act upon any violation they see, and that every call needs to be properly documented. Documentation can include written reports and citations, but also include generating a traceable computer CFS, something that I believe was missing. Officers are still authorized to use discretion in enforcement on these calls, particularly because there is still confusion by the public as to which parks and other public areas allow pets, and what are the "leash laws." Officers were also provided copies of the most common City Codes for animal control. It was highlighted for them that there should be little discretion in violations of licensing laws. 911 Center Director Mark Murphy shared my memorandum with his staff so they were aware of our activities. He also directed his staff to ensure that animal calls are dispatched in a timely manner regardless of the fact that they are considered lower priority calls. CONCLUSION & RECOMMENDATION Animal related calls are a regular and routine part of the Dubuque Police Department's role. Throughout the recent discussions on proposed ordinance changes we identified issues with citizen and staff knowledge of existing ordinances and with documented enforcement. I believe that the police department, in cooperation with the other City departments, has developed plans to correct these issues. Attached is a report of FY 2012 regarding all of the enforcement activities conducted by Animal Control. The spreadsheet breaks down complaints in general categories, the types of citations issued, and the types of advisory notices and letters sent out regarding enforcement where citations are not issued. Additional enforcement data from 2006 to present is also available upon request. Also attached is a memo regarding enforcement by Animal Control conducted in City parks, and the Animal Licensing Enforcement Policy. ENFORCEMENT Citations issued for non - licensing Animal Control violations: these are typically issued on a "repeat offence" situation or when cooperation to follow the city code (i.e., barking, running loose, waste) are not followed in a timely fashion. The goal of the municipal infraction is to gain compliance. Therefore, for most offences (and depending on the nature of the incident), a citation is not issued without first educating the citizen or providing them with information on the Animal Control Ordinance, responsible pet ownership, etc. For the 33 non - license citations issued for Animal Ordinance violations, all of these were issued by Animal Control. Most received a fine or did corrective action to alleviate the violation. Police wrote approximately four citations in the year. Animal licensing enforcement: • Of the 1,101 licensing citations issued in FY12, all were issued by Animal Control. • Approximately 90% of the license citations are issued based on batches generated by PetData. These include those that fail to annually renew their pet 1 license, or fail to obtain one subsequent to receiving a rabies vaccine. • The other 10% are those individuals dealt with through direct contact by Animal Control officers. • Of the 1,101 license citations issued in FY12, approximately 25% were fined according to the Animal Licensing Enforcement Policy (see attached) which was developed by the Health Services and Legal Departments. • 25% were returned for delivery failure (Certified mail not claimed); therefore they did not go to court. • 25% were voided due to animal deceased /moved /owner transfer /etc. • 40% of the 1,101 cited did purchase their license. The reason this doesn't add up to 100% is because some of the 40% that paid for their license had to pay a citation fine also, in accordance with the attached policy. County and State Park Regulations Dogs are allowed in Dubuque County and State Parks if they are on a leash no greater than six feet or confined in a car. FUTURE ENFORCEMENT Licensing Given the community publicity and education, along with notices provided by PetData, failure to purchase a pet license (dog or cat) should result in issuance of a municipal infraction (without a warning) and fined according to the attached Licensing Enforcement Policy. Any animal enforcement staff, which includes Animal Control, Police and Park Patrol, should issue a municipal infraction (MI) to anyone they encounter that does not have and display a current pet license. The City Clerk's Office could be added to issue MI's when owners pay the impoundment fee for non - licensed dog /cats which have been picked up. Access to the PetData database will be provided to Police and Park Division staff. Animal Ordinance violations (other than licensing): • Failure to Confine (7- 6C -2): If a pet owner refuses to confine animal which has bitten a person, issue MI by 48 hours after the bite occurred. If animal is then confined, void MI. • Dangerous Animals (7- 6D -3): Failure to surrender dangerous animals, issue MI. • Vicious dog or cat (7- 6B-4): If owner refuses to euthanize pet when it is declared vicious, issue MI. Animal Control ordinance violations will be enforced at the discretion of the Animal Control Officer, Police Officer or Park Patrol. The following criteria will be considered for enforcement: 2 • Number of times the violation has occurred; • Cooperation of pet owner /keeper; • Whether injuries to other pets or humans occurred and the severity; • Public health impact of the violation; • Geographic area /location of the violation; • Staff initiated vs. Citizen Complaint and • Residency /Familiarity with local ordinances. Since 2009, 12 calls were received for 10 different parks. The following is the specifics of each call: Eight out of eleven owners were given warnings in these calls. 1. Eagle Point Park- People taking leashed dogs into park when closed. Not called in at time of incident. 2. Comiskey Park- Owner with leashed dog while playing basketball. Owner was given a warning. 3. 15th & Bluff (Not really park, green area)- Dog in area. Owner was given a warning. 4. Jackson Park- Two leashed dogs in park. Gone on arrival. 5. Unknown area- Owner given warning. 6. Jefferson Park- Owner in park with leashed dog. Owner was given a warning. 7. Bergfeld Pond- Dogs running loose. Owners were given a warning. 8. Cleveland Park- Owner with leashed dog. Owner was given a warning. 9. Jefferson Park- Loose dogs in park. No owner, not located 10. Valentine Park- Loose dog with owner. MRC /lh Animal Licensing Enforcement Policy In accordance with the City Code, all dogs and cats are required to be vaccinated for rabies and licensed in the city of Dubuque. The City of Dubuque Health Services Department contracts with PetData to process and issue animal licenses. PetData sends out an animal license notice /invoice, along with an additional reminder if the license is not purchased within 30 days. Quarterly, PetData sends a list of delinquent pet licenses to the Health Services Department for enforcement. The Health Services staff issues a civil citation with a letter that includes information on what animals need to be licensed and the amount owed. The following are the guidelines to fine amounts and enforcement for animal license citations: 1st Time Offenders License Citations /Fines • If licenses are purchased, or owner contacts office that they no longer have the animal, before the deadline listed on the citation letter ♦ Void citation • If licenses are not purchased, or no contact is made about no longer having animal, before the deadline listed on the citation letter ► $25 fine plus court costs Repeat Offender of Delinquent License Citations /Fines 2nd Offense • One animal ► $50 plus court costs • Two animals ► $100 plus court costs • Three animals ► $150 plus court costs • More than three animals ► $200 plus court costs 3rd Offense • One animal ► $100 plus court costs • Two animals ► $150 plus court costs • Three animals ► $200 plus court costs • More than three animals ► $250 plus court costs 4th Offense (or more) • One animal • Two animals • Three animals • More than three animals ► $150 plus court costs $200 plus court costs $250 plus court costs $300 plus court costs If a repeat offender does not purchase the license(s) by the deadline, add $25 to whatever their fine would have been had they purchased the license in a timely manner, i.e., if their 2nd offense fine would have been $100 if license was purchased, it will be $125 because they didn't purchase it. 8/23/11 Procedure: It is very important to enter the new citation list names, addresses and court dates on the "CITATION OWNER LIST (Combined) 2006 - " file in the Publicin Animal Control Bulk Citation folder. This will provide tracking for the history of citations for animal owners. After you insert at the end of the document, perform a "sort" to alphabetize. For each new citation bulk mailing, notes with dates of payment, calls, transactions, etc. are recorded in the spreadsheet. This allows ACO to know which citations should or shouldn't be taken to court or their court date. It also helps later when owners that haven't complied, receive their court orders and request a detailed explanation why they were issued the fine and court costs by the court. In Wisconsin, the Janesville Police Department is on full alert to find a dog who did just that. According to the report, the unknown dog was involved in a dog attack that injured a child. The eight - year -old child was walking recently with an adult on West Holmes and Lincoln Streets. Suddenly, a dog reportedly approached them and bit the child in the face. The child was taken to a local hospital where she received treatment, including 10 stitches. Additionally, the police officers are requesting the help of the public to locate to dog. The dog was described as a medium, brown and black mixed breed. The incident remains under investigation. The case above stresses the danger of dog attacks, not only to children but also other people. Dog attacks can lead to bites, claw marks and nerve damage. Caren and Laine Henry told The Des Moines Register on Thursday that a 50 -pound Labrador mix ran out of a yard near Laine's father's home in rural Madrid on Sunday to attack the couple while they were walking their pet beagle. Caren Henry said the dog bit her abdomen and right thigh, scratched at her eyes, then clamped onto her nose, tearing it off. She said her husband was bit on an arm when he tried to help her. "It could have been so much worse," she said. "If I hadn't been wearing my sunglasses, I'm sure I would be missing an eye. If it had gotten ahold of my throat, I'd be dead." Caren Henry said the dog wouldn't stop the attack despite her husband trying to fight it off. "He finally had to bite the dog in its nose, and it let loose," she said. Henry has begun a series of reconstructive surgeries she hopes will restore her nose. The dog is under quarantine for six weeks at the home from which it escaped and attacked the couple, but Dallas County doesn't have a vicious -dog ordinance that would require criminal penalties or lead to the dog being euthanized. To help alert people to this threat, Albany Medical Center recently held a press conference to raise awareness about how dangerous a dog attack can be. The medical center sees more than 200 dog bite cases each year, and around 75 percent of those are children. Doctors said that hands and faces were bitten most commonly. One doctor noted how important it was to clean the wound, suture it properly and to be sure there are no other injuries, such as bone or ligament damage, that occurred as a result of the attack. Because of the nature of dog bites, antibiotics are normally required to help prevent an infection. However, the doctor also noted that stopping the wound's bleeding was the most important step. Flushing the wound with water and bandaging it were important later, but if the bleeding cannot be brought under control, seeking medical attention would be necessary. Another concern, especially if the dog is a stray, is contracting rabies. The story cited an example of a woman having the tip her thumb bitten off by her own dog, in addition to injuries 'to her chest, stomach and legs. Her dog had a brain tumor that hadn't be detected, possibly causing this violent behavior. While the woman in the story was attacked by her own dog, many attacks occur from strange dogs. A vicious dog attack in a Kenosha, Wisconsin, neighborhood has left three people injured and a dog dead. The attack, which happened on July 6, occurred as a neighborhood resident was walking her 9- year -old Cavalier King Charles. The injuries and tragic dog fatality occurred when two pit bulls escaped from a nearby pen. News reports indicate the woman walked past the house scores of times in the past. She had heard barks from behind the fence, but she was never sure what kind of dog lived in the home. The attack happened when the two pit bulls reportedly shoved their way thronght the fence, striking out at both the woman and her dog. The dog died at the scene, while the woman suffered injuries to her hand. The woman's son and a nearby neighbor were also injured as they rushed to aid the victims. Authorities say the two pit bulls are currently being housed at the humane society while the matter is investigated. The woman has already purchased a new puppy to replace her beloved pet, but she is railing to have the pit bulls euthanized. The dogs are now being held under mandatory quarantine Experts say the dogs may not have been properly socialized, a condition that causes the animals to become increasingly anxious and fearful around other dogs and people. If the dogs have not had regular interaction with other beings, they are more likely to attack, accor ing to a representative from the local shelter. It is not yet clear whether the dogs' owner will be facing charges in connection with the incident. Even if that person is not tried for criminal charges, he or she could be the target of a civil suit in the case. The woman and other victims could seek financial damages for medical bills, pain and suffering and emotional distress, among other claims.
