City Clerk's Office • 50 W. 13`" Street, Dubuque, IA 52001 • 563.589.4100 Housing Trust Fund Advisory Committee 2 -5D -1: TRUST FUND ESTABLISHED: Subject to the conditions hereinafter set forth, a fund to be known as the city of Dubuque housing trust fund (trust fund) is hereby established for the collection and disbursement of funds to meet the housing needs of the city's low and moderate income residents. (2007 Code § 26 -31) 2 -5D -2: PURPOSE: The purpose of the trust fund shall be to collect and disburse revenue to meet the housing needs of low and moderate income households as defined in the city of Dubuque comprehensive housing affordability strategy (CHAS). This shall in no way construe that these funds will be used to finance housing permanently owned by the city. The trust fund, as a permanent and revolving source of revenue, will provide for loans and grants to finance projects including, but not limited to, the acquisition, rehabilitation and /or new construction of rental and owner occupied housing, as well as to provide money for relocation assistance to income qualified displaced tenants. (2007 Code § 26 -32) 2 -5D -3: FINANCIAL MANAGEMENT: The financial management of the trust fund shall be the responsibility of the city manager, whose responsibilities shall include, but not be limited to, the following: a) holding trust revenue for those purposes defined by the housing commission and approved by the city council; b) disbursing funds for the housing commission as appropriated in the annual operating budget approved by the city council; and c) performing any other function needed to ensure the sound financial management of and accountability for trust fund revenues and expenditures. (2007 Code § 26 -33) 2 -5D -4: TRUST FUND ADMINISTRATION: The trust fund shall be administered by the city manager. The city manager shall be responsible for, but not limited to, the following: a) marketing the program of the trust fund; b) soliciting applications; c) packaging applications for housing commission review; d) coordinating legal or financial assistance to the housing commission; e) ensuring public participation; f) pursuing new revenue sources; g) overseeing and accounting for funded projects; h) coordinating with the city departments and agencies; i) collecting and servicing loans made by the trust fund; j) preparing periodic reports for the housing commission and city council; and k) general day to day operation of the fund. (2007 Code § 26 -34) 2 -5D -5: FUNDING: The housing commission shall be responsible for recommending sources of funding and revenues for the trust fund to the city manager and /or city council. As funds and revenues become available, the activities of the trust fund shall be carried out as specified in this article. Notwithstanding the foregoing, however, nothing herein shall require or impose any obligation upon the city council to provide any funds for any of the purposes of this article. (2007 Code § 26 -35) 2 -5D -6: COMMITTEE ESTABLISHED; MEMBERSHIP; FUNCTIONS: A. Establishment; Functions: A housing trust fund advisory committee of the housing commission shall be established to recommend policy direction and oversight to the administration and operation of the housing trust fund by: 1) soliciting funding; 2) developing bylaws to govern the committee's operations; and 3) developing policies and guidelines for acquisition and distribution of funds. Such solicitations, bylaws, policies and guidelines shall be approved by the housing commission and submitted to the city council for its approval. B. Duties: The housing trust fund advisory committee shall coordinate an effective mechanism for public participation in the operation of the trust fund, recommend projects to the housing commission for funding approval and engage in activities providing for the efficient use of the trust fund. C. Membership; Terms: 1. The housing trust fund advisory committee shall have five (5) members appointed by the city council to serve for three (3) year terms. Three (3) of the committee members shall be members of the housing commission and two (2) shall be members of the public. The chair of the trust fund advisory committee shall be appointed by the housing commission. 2. The two (2) members of the public shall be selected specifically on the basis of experience in real estate development, banking, finance, accounting, funds management or other related areas of expertise. D. Meetings; Rules And Regulations: The housing trust fund advisory committee shall hold at least six (6) meetings each year. The housing commission may adopt such rules and regulations it deems necessary to govern the committee's organizational procedures and which do not conflict with this article or other resolutions and /or decisions of the city council. E. Governing Operations: All administrative, personnel, accounting, budgetary and procurement policies and practices of the city shall govern the housing trust fund advisory committee in all its operations and activities. (2007 Code § 26 -36) 2 -5D -7: IOWA FINANCE AUTHORITY STATE HOUSING TRUST FUND PROGRAM: A. Application For Funds: For purposes of the Iowa finance authority state housing trust fund, the housing trust fund advisory committee shall have the authority to make application to the Iowa finance authority for funds from the local housing trust fund program and the project based housing program and to direct, without further approval of any city officer or the city council, how such funds shall be used in accordance with the Iowa finance authority trust fund allocation plan. B. Maintenance Of Funds: Funds received by the city from the Iowa finance authority state housing trust fund shall be maintained by the city in a separate account and subject to the direction of the housing trust fund advisory committee. C. Local Matching Funds: For purposes of providing required local matching funds for applications to the Iowa finance authority state housing trust fund, the housing trust fund advisory committee shall have the final authority to direct how such funds shall be used in accordance with the Iowa finance authority trust fund allocation plan. Allocation of local matching funds to the housing trust fund advisory committee shall be made by decision of the city council. Appointment; Term: The transit advisory board shall comprise five (5) trustees appointed by the city council. All appointments shall be for a term of three (3) years or until a successor has been appointed and qualified. B. Officers: The transit advisory board shall elect from its own number a chairperson and a secretary who shall serve for such terms as the board shall determine. (2007 Code § 46 -68) 5 -1 -2: QUORUM; VOTING REQUIREMENT: Three (3) members of the board shall constitute a quorum for the transaction of business. All action of the board shall be by resolution and the affirmative vote of at least three (3) members shall be necessary for the adoption of any resolution. (2007 Code § 46 -69) 5 -1 -3: POWERS AND DUTIES OF BOARD: The board shall: A. Advise the city council on executing agreements and grants relating to the transit system operation and the purchase of new equipment. B. Advise the city council on rates, fares or charges for the transportation of passengers and any incidental services and the rates or charges to be made for advertising in buses or any other facility. (2007 Code § 46 -71) 5 -1 -4: MEETINGS: A. Regular Meetings: The board shall meet not less than bimonthly on a regularly scheduled day. B. Attendance Requirement: Members of the board shall attend at least two - thirds (2/3) of all regularly scheduled meetings within any twelve (12) month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the board to recommend to the city council that said member be replaced. Attendance of all members shall be entered on the minutes. C. Copies Of Minutes Filed With Clerk: The board shall file with the city clerk a copy of the minutes of each regular and special meeting of the board within ten (10) working days after each such meeting. All appointive boards, commissions, committees, and councils of the state established by the Code, if not otherwise provided by law, shall be gender balanced. Last session, the General Assembly passed legislation that applies this requirement to the local level. This Q &A explains background on the legislation, the new requirements in the legislation for cities and how cities can comply. Q: What are the new requirements for gender balance on city boards and commissions? A: During the 2009 legislative session, legislation (HF243) was passed that extends to cities and counties gender balance require- ment for all appointive boards, commissions, committees and councils created by the Iowa code. In other words, bodies cities are required to have under Iowa code when they provide certain functions or services, such as the planning and zoning commission, library boards and the board of adjustment, with appointed (not elected) members, must be gender balanced. Q: What does `gender balanced' mean? A: Gender balance means if the body has an even number of ap- pointees, it must be evenly made up of men and women. For exam- ple, three women and three men must serve on a six member board. If the body has an odd number of appointees, it must be "one half plus one" of either gender. For instance, if there are five members, three could be men and the other two women, or vice versa. Q: When do the changes go into effect? A: Cities must have gender balanced boards, commissions, com- mittees and councils by January 1, 2012. This does not prohibit an individual whose term expires prior to January 1, 2012, from being reappointed even though the reappointment continues an inequity in gender balance; however, cities should start planning upcoming appointments now, to ensure gender balance is reached by that date. Making a chart of existing boards and upcoming vacancies, and/ or keeping track of current appointments and necessary recruit- ing periods would be a good start to ensuring your city is tracking gender balance, and is prepared for the January 1, 2012 implementa- tion date. Q: Is there any option if my city simply cannot find a person to serve on the board or commission of the needed gender? A: Yes. Under the new code section, cities that make a good faith effort to find a qualified person of the necessary gender to fill the position for a period of three months and are unable to do so may appoint a person to the position regardless of the gender balance requirement. Q: What constitutes a "good faith effort "? A: There is no hard and fast definition, but cities should be able to demonstrate a legitimate effort during the three month time period to recruit qualified members of the necessary gender, before appointing a member that creates gender imbalance. In addition, the legislation requires that cities must always "utilize a fair and unbiased method of selecting the best qualified applicants," regard- less of gender. Q: Is there a reporting requirement? A: No. The legislation did not include a reporting requirement; however, many cities keep information on their boards and commissions — including current members- posted online, to better inform citizens of the makeup of local governing bodies. Q: How can I recruit more women or men to volunteer for these positions? A: The Commission on the Status of Women has prepared a guide to help cities learn how to recruit gender balanced boards and com- missions. The Commission also prepared a guide called the "Five Step Guide to City and County Boards and How to Get Appointed" to be used as a tool by interested women to learn more about how to get involved in city boards and commissions. Undertaken for the city of North Liberty, this project involves a membrane bioreactor method of treating wastewater and provides a significantly higher effluent water quality compared to conventional wastewater treatment processes. Used on a limited basis in the U.S. it is the first of its kind in Iowa. The city has certainly "gone the extra mile" to improve the water quality in their receiving stream; they are to be commended for their foresight and respect for the environment.
