The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing location of the property, that the
existing dilapidated house will be demolished and a single duplex constructed in its
place.
Staff reviewed surrounding zoning and land use, and reviewed allowed uses in the R-2
District.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the requested
rezoning would not adversely impact adjacent property and serve as a transition
between the commercial property to the south and single-family homes to the north.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassifying the hereinafter-described
property from R-1 Two-Family Residential District to R-2 Two-Family Residential
District, to wit:
Lot 1 of 2 of 7 and Lot 2 of 2 of 7 Shipton's Resubdivision, and to the
centerline of the adjoining public right-of-way, all in the City of Dubuque,
Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Property History: The property was subdivided in the County in the early 1900's and a
single-family residence was built at this location in 1920. The building served as a
single-family home until recently when it was abandoned and has fallen into disrepair.
The second parcel was originally an undeveloped residential building lot that was
purchased by the Morocco Supper Club and used for expansion of their parking area.
Physical Characteristics: The subject parcels total approximately 33,000 square feet.
The southern-most lot that accommodates a portion of the Morocco parking lot is
relatively level but tapers on the west side to a wooded drainage. The northern-most lot
is heavily wooded with relatively steep topography. The northern-most lot is terraced
and sits above the grade level of Rockdale Road, has a level building pad to
accommodate the house and drops precipitously to the west to the Catfish Creek valley.
Concurrence with Comprehensive Plan: Goals outlined in the Comprehensive Plan
state, "To buffer and protect incompatible uses from each other and to encourage the
use of mixed use develop", and to "Promote...... neighborhoods that allow a diverse mix
of residents and housing types".
Impact of Request on:
Utilities: Sanitary sewer is available along Rockdale Road; however, contingent on
basement floor elevations, a pump installation may be necessary to access the
public sewer system. City water is available along Rockdale Road.

Traffic Patterns/Counts: lOOT 2005 Annual Average Daily Traffic Counts indicate
3,130 vehicle trips per day along Rockdale Road by the subject property.
Public Services: Existing public services are adequate to serve the site.
Environment Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development.
Adjacent Properties: If the property is fully subdivided and utilized, it may be
possible to place four duplexes, or eight units, at this location. This number of
units would be directly adjacent to, and across the street from, single-family
residential development. Redevelopment of this property; however, would serve to
remove an existing abandoned, deteriorated home and would also serve as a
buffer between the single-family residences to the north and the Morocco Supper
Club parking lot.
CIP Investments: None proposed.
Staff Analysis: The applicant is proposing to rezone two parcels that total
approximately 18,000 square feet from R-1 Single-Family Residential to R-2 Two-
Family Residential. The northern-most subject lot at 1331 Rockdale Road currently
accommodates an abandoned and deteriorated home. The southern lot serves as the
northern portion of Morocco's Supper Club's parking lot. Both of these parcels have
direct access onto Rockdale Road. If subdivided and fully developed, it may be
possible to place four duplexes on the subject properties. Adequate utilities are in
place to serve the potential units; however, pumps may be necessary to ensure that the
sanitary sewer can be accessed.
If the southern-most lot is developed, it will remove approximately 35 parking spaces
from the existing Morocco Supper Club parking lot. There will be; however,
approximately 70 remaining paring spaces, which is in excess of the amount required
for the current facility.
Staff recommends that the Commission review the criteria established in Section 6-1.1
regarding zoning reclassification.
