RESOLUTION
Be it resolved by the City Coun-
cil of the City of Dubuque, Iowa
that
WHEREAS, it is the policy and
intent of the City of Dubuque,
Iowa to maintain and encourage
harmonious relation between Man-
agement and Labor concerning
the construction and building con-
tracts, as well as Public Works
contracts, contracted for by the
City of Dubuque, Iowa with private
contracting firms; and
'WHEREAS, it is the desire of
the City of Dubuque not to in any
way interfere with the present es-
tablished and prevailing wage rates
in the City of Dubuque, Iowa, nor
by its contracting with private
firms to encourage inflationary
measures, nor to in any manner
be a party to the depression of
the standards of living of any em-
ployees in the City of Dubuque,
Iowa;
NOW, THEREFORE, it is hereby
established as the policy of the
City of Dubuque, Iowa as follows:

of the Dubuque County Metropol-
itan Area Planning Commission be
amended to allow elected officials
to serve on the Commission and
that each member community

Supervisors be asked to approve
the Resolution and transmit their
approval to the office of the Com-
mission at their earliest conven-
ience.

MEMBERSHIP OF THE
COMMISSION
The Dubuque County Metropoli-
tan Area Planning Commission
(hereinafter referred to as the
"Commission") shall consist of not
less than 5 members, a majority
of whom shall hold no other pub-
lic office or position except ap-
pointive membership on a city
plan commission or other planning
commission, board or agency.
(1) Two (2) members shall be
appointed by the County Board of
Supervisors. One (1) appointee
shall be a member of the legally
appointed County Zoning Commis-
sion and one (1) may be appointed
from the citizenry at large or from
the Board of Supervisors. If an
elected official is appointed, he
shall serve a period only during
his tenure as an elected official.
(2) Two (2) members shal be
appointed from the incorporated
places of more than 50,000 popula-
tion by the City Council. One (1)
appointee shall be a member of
the legally appointed City Plan and
Zoning Commission, and one (1)
may be appointed from the citi-
zenry at large or from the City
Council. If an elected official is
appointed, he shall serve a period
only during his tenure as an elect-
ed official.
(3) One (1) member shall be ap.
pointed by the City or Town Coun-
cil of any other city or town en-
tering into these Articles of
Agreement. If an elected official
is appointed, he shall serve a peri-

turned Booth Street between Uni-
versity and Loras into a gun lap
for the Indianapolis 500. Mr. Har-
ry Kopple, operator of a store on
Uhiversity stated that youths defy
motorist and have discouraged
customers from sending their chil-
dren to his place of business. Mrs.
Ellwood Flick stated that grown-
ups are forced to walk in the
street around LOE's establishment
and further complained of the use
of obscene language, and drinking
and the breaking of bottles in the
neighborhood.
Mr. Moes, the operator of the
establishment admitted that park-
ing in the area always has been
a problem but denied allegations
as to liquor, drinking and broken
bottles. He sells no beverages in
bottles only in paper cups.

Resolution requiring abutting
property owners to make sewer
and water and gas connections.
WHEREAS, the City Council
has heretofore adopted Resolution
No. 111-66, being the Resolution
of Necessity for permanently im-
proving City of Dubuque 1966 Hot
Mix-Hot Laid Asphaltic Concrete
Paving Project No. 1.
Now, Therefore, Be It Resolved
by the City Council of the City of
Dubuque, Iowa:
Section 1. That the owners of
all property abutting on said im-
provement are hereby required to
make connections from the sewer,
water and gas mains to the curb
line of said property prior to July
5, 1966.
Section 2. That the City Clerk is
hereby authorized and directed to
serve a written notice on such
abutting property owners in ac-
cordance with Ordinance No. 128,
ordering compliance with this Res-
olution;
Section 3. That in the event any
such property owner shall fail or
refuse to make such connection
within the time set out in this
Resolution, then the City Manager
shall proceed to have said connec-
tion made upon a contract made
and entered into for that purpose
and upon completion, report said
fact together with the cost there-
of to the City Council, whereupon
the cost of such connection shall
be assessed against such abutting
property.

On April 8, 1966, Arthur C. John.
son of 539 Almond Street, Du-
buque, Iowa, suffered injuries as
the result of a fall on a public
sidewalk abutting the premises of
1955 Clarke Drive whereat it was
claimed that a defective condition
existed by reason of elevation in
part of said public sidewalk.
I have been in contact with rep-
resentatives of the owner of the
abutting property who have settled
Mr. Johnson's claim in a total
amount of $162.14 and said repre-
sentatives of the abutting owner
have made demand for payment
of one-half of the amount towards
said settlement.
The owner of the abutting prop.
erty is Clara Creig Finger, and the
representatives of the owner is the
American States Insurance Com-
pany.
It is the recommendation of the
City Attorney that the City pay
one-half of the settlement amount
in order to acquire a release exe-
cuted by the claimant and his
spouse and that the City Auditor

COUNCIL OF THE CITY OF DU-
BUQUE, IOWA:
Section 1. That Gerald L. Udelhofen and
Joan Udelhofen, as owners of the prem-
Ises known as 1898 Audubon Street, in
the City of Dubuque be, and they are
hereby granted the revocable license and
authority to construct and maintain re-
taining wall on 1898 AUdubon Street,
under the terms and conditions set forth
in this Ordinance:
Section 2. That such construction shall
be done in accordance with plans hereto-
fore submitted by permittees and ap-
proved by City Manager, under the super-
vision and direction of the City Manager,
and in accordance with all applicable
state and federal laws and regulations,
and the ordinances of the City of Du-
buque.
Section 3. That the permission herein
granted is expressly conditioned on per-
mittees agreement to:
(al Assume any and all lIabJllty for
damages to persons or property which
may result from the existence, con-
struction or maintenance of said re-
taining wall
(bl To pay on behalf of the City of
DL:buque all sums which the City of
DUbuque shall become obligated to
pay by reason of the liability im-
pOsed upon the City of Dubuque for
damages of any kind resulting from
the existence, construction or main-
tenance of said retaining wall, sus-
tained by any person or persons,
caused by accident or otherwise, to
defend at its own expense and on be-
halt of said City any claim against the

of retaining wall.
Section 4. That the permission herein
granted is expressly conditioned upOn
permittees further agreement that should
the right and privilege herein granted
be rescinded or revoked by the City Coun-
cil, permittees, or their successors in in-
terest, as owners of the abutting prop-

Manager, so to do, at their own expense,
remove said retaining wall, and in the
event of their failure so to do, the City
of Dubuque shall be authorized to re-
move said retaining wall, at permittees
expense and dispose of the same, and
the permittees shall have no claim against
the City or its agents for damages re-
sulting from the removal of said re-
taining wall.
Section 5. ThIs Ordinance shall become
effectiVe and the rights hereunder accrue
to Gerald L. Udelhoten and Joan Udel-
hofen when this Ordinance has been
adopted by the City Council and the
terms and conditions thereof accepted by
permittees by acceptance endorsed on this
Ordinance.
