INTRODUCTION
The City Council has received a text amendment to amend the City's Unified
Development Code to prohibit firearm sales as a home -based business (Section 7 -1.3).
This memorandum provides information on places in Dubuque where people can
purchase firearms.
DISCUSSION
The list of federal firearm license holders includes large retail stores, Dick's, Theisen's
and Wal -Mart, as well as specialty establishments such as Central Range, and
individual federal firearm license holders who operate as a home -based business. The
information provides the assessed valuation of the property for the license holder as
well as the property tax paid by the license holder for the most recent calendar year
available.

My name is Kristy Lunceford. I live at 910 Hawkeye Drive Dubuque Iowa. My husband and I were
denied the CUP permit for an FFL to have a home based FFL business. Our neighbors feared for the sales
of guns in the neighborhood, there were more people there on that side then on our side. Therefore we
were denied. Each time we had met for the meeting there were never enough council there for us to
receive a fair vote, we did table a few times, which allowed the neighborhood to gather more on their
side. We had letters from FFL dealers , deputy Tom R. who just lives a few blocks away from Hawkeye,
he has not had any issues, he also checked with police department and had no issues with the other
approved FFL dealers home based. We had letter and proof that the property value around those that
had the FFL had not gone down, in fact they had increased.
I was told by Guy H. that the realtor letters would cancel each side out, that no matter how many
signatures that were on the partition, the council board looks only at if we met the guidelines for CUP.
We met all of the criteria of the home based and CUP guidelines, but still because there were more who
feared and did not understand the nature of what a FFL really was and what we were going to be doing
with our FFL.
Our goal to having an FFL was to help insure that all firearms are legally registered to people. Not to
open a store front to sell firearms in a residential or commercial area. We wanted to go to auctioneer
companies and offer to call in and do the gun transfers for the sale of the guns that they auction off at
the sales they conduct. There are many auctions where a person can purchase a long gun and have no
background check or NICCS check done.
Having an FFL is not just for the sale of firearms, you need one to do any type of gun smiting. That was
to be part of our future plan. A person has to go to extensive train for fire arm repair and to be certified
for companies like Remington and others.
Opening a store front to sell firearms was not what we want to do, that is why the home based business
was a great way for us to get started with a FFL. The cost of the FFL and repair training is a costly
investment in our future, something that was manageable at this time and could have been done right
from our home. It was taken away from us because of a small hand full of people who were uniformed
and fearful. As well as people were paid to sign the petion.
Our business plan never included an option to open a store front, not now, not in five years, not in ten
years. We would have never had large amounts of inventory in our home like the neighbors lead the
council to believe, firearm manufactures don't make a practice of letting the home based FFL dealers
order more than one or two firearms at a time. That was told to me from several FFL dealers that have
had home based FFL for over 30 years.
It is a shame that we were denied, we would have been paying sales taxes, permits, and helping with the
goal of registering sales of fire arms. Please don't take that right from others who want to have a home
based business regardless if it is an FFL, Avon, Candles, Clothing, Craft shows, a quitter, dress maker, flea
market seller, on line auction seller, purse seller or any other home based business.

in the neighborhood that selis guns.
We met all of the guide lines for the condional use permit. But still was denied because of the
neighborhood harmony would be upset. We were told by Guy H. that the council Iooks at the guide
lines to determine the approval. All guide lines were met, and still denied because a hand full showed
up at the many meetings to say they did not want guns and gun sales in the neighborhood. 1 say many
meeting because there never was enough council on the board to give us a fair vote.
The neighbor said it would cause traffic problems more unlike types in the neighborhood. 1 feel that

My wife tried to explain the other things OUR business plan was for, including transfers at auction and
gun smiting.
The council was more focused on pin pointing us down to how many gun sales we would have in a year.
How many pickups we would have, what times people would be at our home.
I feel that we were bullied and a denial was given to us because there were more people on their side
then showed up for us. We were denied because of popularity not because we did not meet the CUP
guide lines. Having people get paid for signing that petition against us was and is wrong.

Esteemed Members of the City of Dubuque City Council
Dear Sirs and Madams;
After last night's Council Meeting I felt that I wanted you to know where I was coming from with this
request to make Commercial Fire Arm Sales a prohibited business in the Unified Code.
When my neighbor wanted to open a fire arm business in my neighborhood I went to the City Planning
Office to find out how to stop this. 1 proceeded through the process of proving that my neighborhood
did not want a Commercial Business to be located in it. I was told that we had to prove we did not want
a commercial business not just a gun business. I went through the process by picking out the sections of
the Unified Code that supported out stance that a commercial business was not a fit for our
neighborhood. In reading the code I discovered that there were 7 "prohibited businesses" and I couldn't
understand why a beauty or barber shop were prohibited and a gun business wasn't. I convinced the
Zoning Board of Adjustment that yes, our neighborhood was not conducive to a commercial business
and they turned down the request for a Conditional Use Permit by a 4 -1 vote.
I then decided that if a beauty or barber shop was prohibited it seemed logical that a gun business
should be too. I went through the process of the Zoning Advisory Commission and used the same
arguments but also used the type of business and explained why gun business and residential
neighborhoods did not go together. The Advisory board voted 5 -0 to recommend this amendment for
approval to you as a council.
Now the gun people come in and complain that this is Constitutional issue with their rights. This has
nothing to do with their right to bear arms it has everything to do with my right to live in a residential
neighborhood and someone trying to open a business in that neighborhood.
Ms. Connors talked about how the council relies on their boards and commissions to feed the proper
information onto them. Well I think the Board and Commission did just that because they realized this
was not a Constitutional issue but a Zoning issue.
Mr. Lynch, I understand your concern but this would not be a big issue if the word guns was not involved
and I feel the people against this preached that this was all based on fear and that is not the point. First
of all it is based on a commercial business in a residential neighborhood and the changes that are
happening in this city and country concerning guns. Please read the Internet articles I provided in my
packet as to how other cities have handled this issue if you have not already. This is not a fear issue it is
safety, security, property values, and the nature of fire arm sales that have initiated this request. Do not
let them stand behind the 2nd Amendment or intimidate you by stating this is trying to solve an issue
where there is no problem. I am trying to be proactive and keep a problem from arising. Again all of
these gun businesses were prior to 2009. Columbine was the only incident that happened and Internet
sales were just beginning. Both Aurora and Newton were Internet purchased sales. As these businesses
increase I do believe we will have more problems and neighborhoods will not be as safe because these
businesses give their addresses over the Internet and we all know that once an address is on the
Internet it is out there for the whole world to see, forever. I think I would rather see a billboard than
know my neighborhood had an address out there on the internet for selling guns. That is where the
changes have to be dealt with. The Unified Code states no billboards or traditional advertising, well
internet advertising of an address is more harmful to me than a billboard located in Dubuque.

Message: Dear City Council members: At the conclusion of the Monday, August 19, 2013, City Council's discussion of the
proposal to add home -based firearms to the list of prohibited businesses, you invited attendees to submit further discussions,
but requested that they be restricted to new information or topics. I would like to take this opportunity to respond to some of
the objections and concerns raised by council members against the proposal. Council members Sutton and Lynch couched
their concerns in terms of protecting the rights of gun owners. But there is nothing in the proposal that infringes on gun
owners' rights. No one's guns will be taken away from them, no one's right to purchase a gun will be affected, and no one's
right to sell a gun in a properly zoned commercial area will be infringed upon. The issue is about home fireamns sale in a
residential area, pure and simple. Council member Resnick argued that under current zoning law, persons seeking a variance
to for home -based fireamis sales must plead their case, meet certain requirements, etc., and that approval is not automatic.
Thus Mr. Resnick argued that the current zoning law ought to remain in place. But citizens have a right to expect that
exceptions to residential zoning laws ought to be rare. I don't know what the approval rate is for requests for home -based
businesses of other types, but to my knowledge there have been four such requests for home -based fireaiuis sales, and three
of the four have been approved, a 75% approval rate. That the number is small and the approved businesses have been
incident -free is largely irrelevant. Home owners should be reasonably assured when they purchase a home in a residentially -
zoned area that that area will remain residential without home -based businesses other than those on the approved list. When
variance - approval rates exceed denials, then the zoning means nothing at all. In such cases, the only way to insure that the
zoning board will not approve a type of home -based business is to put that type of business on the prohibited list. If we have
zoning laws, we ought to live up to them. I urge you to put firearms sales on the list of prohibited home -based businesses in

Dubuque City Council Members,
Thank you for letting me address you at last Monday evening's meeting
concerning Bev Knockel's request to add home -based gun dealerships to the zoning
prohibitions for the city of Dubuque.
I would like to add two additional points that, I believe, have not been
discussed as of yet.
First, in listening to the opposition at the August 19th hearing, they insist that
we are coming from a position of "fear. " We view it as "concern." This goes beyond
a semantics debate. This involves a mental health status of potential gun buyers.
Several speakers noted that gun dealers who have federal licensure are very
well trained in gun safety; no one denies that. However, federal licensure is not
currently a requirement for home -based or internet -based sales. Therefore, no
background checks are required for non - federal licensees. As a result, gun dealers
without federal licenses can sell to anyone without a background check.
While the gun dealer with or without a federal license may be trained and
practice safe procedures, there is no guarantee that the clientele visiting the
neighborhood would be as versed in the safety aspects of gun handling. The
neighbors are concerned more about gun safety procedures and the mental health
records of the clientele than that of the gun dealers, especially as mental health
services funding is continually decreasing. Clientele who have not undergone
background checks, driving into neighborhoods looking for dealers, to purchase a
weapon does raise a legitimate concern for residents. Once again, this all boils down
to a commercially -zoned issue to ensure safety for residents.
Second, Zoning Commissioner Stephen Hardie voiced in his comments before
the August 6th vote that Bev Knockel's request is "reasoned" and "prudent." He
stated that no one, as some City Council members also observed, is being denied the
chance to operate a business. Rather, he implied that the nature and potential of this
particular type of business infringes on common sense and a greater good of a
neighborhood's right to a safe residential area.

negative influence on children, the possible increase in violence and /or criminals in city residential neighborhoods,
trafficked firearms, and the infrequency of federal and state inspections to adequately regulate these business
operations once established;
2. Fire and /or explosive hazard caused by potentially large quantities of stored firearms and ammunition in close
proximity to the homes of neighboring residents;
3. Potential theft of firearms and ammunition through burglary or robbery;
4. Inability to safely and securely store such firearms and ammunition in a home -based business where children are
commonly present;
5. No assurance that appropriate measures are being taken to prevent the
accessibility of firearms /ammunition by individuals prevented by law from
possessing them
6. Increased vehicular and foot traffic in residential areas caused by a firearms and ammunition sales business that
could change the neighborhood's character and harm the quality of life;
7. Probable negative impact on neighboring property values and requirement to "disclose" presence of home gun
dealer upon sale of neighbors' homes;
8. Increased demands on local law enforcement resources to monitor numerous home gun dealers, or lack of any
oversight by local police department;
9. Lack of sufficient federal or state inspections due to limited resources. (ATF reported in
2007 that it inspects each FFL, on average, only once every 17years);Home gun
dealers selling over the Internet are difficult to monitor.
10. According to ATF, home -based Internet FFL gun dealers typically operate by setting
up a website offering a variety of firearms and ammunition. The dealer responds to
requests by placing orders to the manufacturer, and the firearms are sent to the
dealer's home. He then sells them out of his house or redistributes them through the
mail to another FFL dealer out of the area

Dear Council Members,
Here I am back again. The article in the paper got me thinking about the arguments they were using regarding no
problems with gun businesses in over 30 years. I have known John Kemp for over thirty years and I know he is a
reputable and safety minded person. Here is the problem we have with what people are saying about home based
businesses. Most of these long running businesses have been operating by word of mouth in Dubuque. I do remember
somewhere in the Unified Code that it mentioned that Home Based Business would not be allowed to use billboards and
any outdoor signage they would want to use on their home would have to be minimal. Well guess what I found just by
sitting at my keyboard on Google and typing in Internet Gun Dealers Dubuque, la. The above Zink. There are several
businesses located in residential neighborhoods, Mr. Kemps included. Please cut and paste this link and open it I think it
will surprise you it did me months ago when I started this fight.
I do understand that they may feel safe and secure because they have guns in their homes, but this doesn't make their
neighbors feel that way. I would rather have a billboard on Kennedy and Hwy. 20 stating that there is an Internet Gun
Business at 910 Hawkeye Dr. By having these addresses given on the Internet the whole world has access to them and it
is not just for a limited time but forever. The Internet has done a lot of good but it has been proven that it can do a lot
of harm also. Internet gun business is in its early development and we are already seeing problems arising.
My beliefs that these restrictions for advertising were put in the Unified code to keep traffic down but how do you do
this when the whole world has access to your neighbor's address and they know he is selling guns there. I mentioned
looky loos in my arguments before the Board of Adjustment but what is even worse is the people from outside the area
that could come to Dubuque thinking they have an easy target.
Please do not be swayed by their arguments, always the same ones. Think how safe you would feel in this world today,
not thirty years ago, even ten years ago, knowing there was an Internet gun business in your neighborhood and even
more so how would your children feel about walking past that house to catch the school bus.

Section 7 -1. 3 that would make it illegal to sell firearms from a home based business. These transactions are already

to most any home business. I do not see any reason gun sales are being singled out in this amendment other than someones

impacted by this change, other than lost respect for a community that shouldn't be limiting entrepreneurs in this economic

Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant Beverly Knockel, spoke in favor of the request, reviewing how firearm
sales are not an appropriate home -based business, citing concerns for neighborhood
safety, potential for increased chance of burglaries, and negative impact on property
values. The applicant reviewed a petition submitted in support of the proposed text
amendment and email letters from realtors speaking to the impact on property value in
relation to the presence of a firearm sales business in a neighborhood. The applicant
indicated she supported that people have the right to bear arms but not the right to sell
them commercially in a residential neighborhood.
Staff reviewed the staff report, reviewing the current list of allowed and prohibited home
occupations, and that home -based businesses not listed are reviewed by the Zoning
Board of Adjustment as a conditional use. Staff reported that the Zoning Board of
Adjustment has previously approved three existing home -based firearm sales business.
Staff noted that the Police Department reports no calls for service to any of the three
home -based firearm businesses addresses related to the firearm sales.
There were several public comments in favor of the text amendment to prohibit home -
based firearm sales as it is inappropriate in a residential neighborhood from a safety
and property value perspective, and that there is sufficient space available in
commercially -zoned areas of the community.

The Zoning Advisory Commission discussed the request. Commissioner Smith asked if
the proposed text amendment would impact existing home -based firearm sales
businesses. Staff replied they would be grandfathered. Commissioner Hardie felt the
applicant has made a measured request to only list firearm sales as a prohibited home -
based business as there are opportunities for firearm sales to take place in commercial
areas of the community.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

to you. The packet contained the materials my neighborhood used to convince the Zoning Board of

Plus three additional items, the Sandy Hook Promise and an On -line and paper petition containing 370
signatures supporting the prohibition of fire arm businesses in residential neighborhoods. I would like
to ask at this time for anyone here who signed one of these petitions or just supports prohibiting fire
arm businesses in residential neighborhoods to raise their hand.
In the neighborhood packet is the petition circulated through our neighborhood only. The results, 44
against and 1 in favor, more than show how much our neighborhood did not want this type of
business, yes we proved that we did not want any business in our neighborhood but we also proved
our point that this "type" of business should not be allowed. I felt that you needed to see how we
argued the Sections of the Unified Development Code for business reasons and type of business
reasons. The four letters from the realtors are self - explanatory and the web articles and the Sandy
Hook Promise relate to the reasons why the nature of a fire arm business and residential
neighborhoods do not go together.
My neighborhood feels so strongly about this that they have taken up a collection to pay the
Application Fee for this process. We do not want any neighborhood in Dubuque to have to fight this as
we did, and strongly feel that preventing this type of business in a residential district is the way to
protect ourselves and our community. I have talked to several Neighborhood Assdociation Presidents
and several have gotten back to me to tell me their association wholeheartedly support this request.
Dubuque has received many prestigious designations and awards throughout the years.

One of the five promises of the American Promise Alliance is "Safe Places." How can we, as a
community make our children feel they live in a safe neighborhood when they may have to walk past a
home that could be a Fire Arm Sales Business or even the adults who fear the type of people coming
into their neighborhood. Two of the criteria for LivCom are "Best Practices and Improve our Quality of
Life." I do understand that LivCom awards are more environmentally oriented BUT living in a
residential neighborhood is the environment of those neighbors and I guarantee you that a gun
business is neither a Best Practice or improves the quality of life for the people in that neighborhood.
As far as the Forbes designation goes one of their criteria was "the rate of home ownership and
housing affordability." I think the four letters from realtors more than adequately address all of the
differences that could or would happen with these types of business in residential neighborhoods. Last
but not least the National Civic League looks for cities with successful efforts to address pressing local
challenges. The gun issue is rearing it's ugly head in Dubuque with what just happened last month with
the shootings in the Jackson Park area. I think that the climate of this country toward firearms proves
that this may not be resolved on the national level, yet, but we here in Dubuque know that we can
resolve one area of it that will make our residential neighborhoods a safer and happier place to live.
Without the fear of someone opening a firearm business next door.
To quote Bob Dylan, "The Times They Are a Changing." I realize that there have been 3 Conditional Use
Permits granted since 2005 in Dubuque for Internet Fire Arm Businesses. Since that time we have had
Aurora, Colorado and Newtown. Both of these shooters used the Internet to secure guns or
ammunition. I am here tonight because when I mention that commercial fire arm businesses can open
in residential neighborhoods, everyone I have talked to is shocked, that can't be they say to me. I say
to them yes it can and someone tried to do it in my neighborhood. Please to keep the rest of
Dubuque's neighborhoods safe and help curb the violence that is erupting in our city and country,
make Fire Arm Businesses a prohibited business so it can't even be tried again.
I want Dubuque to live up to the Sandy Hook Promise and we, be a community of change that does
not allow the commercial sale of fire arms in residential neighborhoods. I realize that everyone has
the right to bear arms in this country but not everyone has the right to commercially sell them in a
residential neighborhood. Fire arm sales belong in a commercially zoned area.
Because of traffic, safety and security, property values and the nature of firearm sales 1 am
asking that you prohibit fire arm businesses in residential neighborhoods per Section 7.1.3 of
the City of Dubuque's Unified Development Code.

The following petition was signed exclusively by residents of Hawkeye Dr., Inwood Ave. and
Buckeye Ct. It was solicited by people expressing their concerns over allowing an Internet gun
business to open at 910 Hawkeye Dr. The following concerns were discussed with the people
who signed the petition:

• Safety and Security
• Problems caused by the type of business
Bev Knockel will be presenting the view of all people who signed the petition. As you will see,
there was one person in favor of the business and everyone else who signed (44) against the
business.
The only reason that one person said he was in favor of the business is he thought it would make
it easy for him to buy his guns next door. Now will this person use the internet or just go next
door to purchase his guns. To me that is off the street traffic not internet. Is it really fair to go
against all the neighbors' feelings over the convenience and ease of one?

Unified Development Code Material
would now like to present the sections of the Unified Development Code for the City of
Dubuque that I feel supported my views. My reasoning used follows each section in bold and
italic.
Article 5: Zoning Districts
Section 5 -2 R1 Single Family Residential
The definition of a R -1 district:
The R -1 District is the most restrictive residential district and is intended to protect low
density residential areas from the encroachment of incompatible uses. The principal use
of land in this district is for low density single - family dwellings and related recreational,
religious and educational facilities
Section 5 -2.2 Conditional Uses
The following conditional uses may be permitted in the R -1 District, subject to the provisions
of Section 8 -5:
1. Accessory dwelling unit
2. Bed and breakfast home
3. Keeping of horses or ponies
4. Keeping of hens
5. Licensed adult day services
6. Licensed child care center
7. Mortuary, funeral home, or crematorium
8. Off - street parking
9. Tour home
10. Tourist home
11. Wind energy conversion system
This particular business is in no way similar to the above Permitted Conditional Uses.
Article 8: Zoning Board of Adjustment Applications and Procedures
Section 8 -5.4 Standards for Granting a Conditional Use Permit sub - sections F and H.
F. The location and size of the conditional use, the nature and intensity of the activities to be
involved or conducted in connection with it, the size of the site in relation thereto, and the location
of the site with respect to streets giving access to the conditional use, shall be such that it will be in
harmony with the appropriate and orderly development of the district and neighborhood in which
it is located.
The nature and intensity of a gun business definitely is not in harmony with the appropriate
and orderly development of the district and neighborhood in which it is located. As stated
earlier our access is one way in and one way out. The code even uses the plural streets meaning
more than one access point as I have stated we are only accessible by Peru Road and this is a
major issue discussed amongst us.
The business of selling guns does not belong in residential neighborhoods, it belongs in a
neighborhood zoned for business not children walking to catch a school bus.
H. The proposed conditional use will not cause substantial injury to the value of other property in
the neighborhood in which it is located and will contribute to and promote the convenience and
welfare of the public.
I have presented documentation from realtors regarding property values and I really cannot see
how it will contribute to and promote the convenience and welfare of the public, if anything I
see a danger to the public because Internet guns sales is a major access point for a lot of the
guns that have been used by sick people to kill a lot of innocent people. I also fear for the
probability of break -ins both at their house and anyone else's in the neighborhood. i think that
public interest should also be considered when you have a petition taken only in the affected
area with only 1 in favor and all other residents against that type of business. This does not
promote convenience with the way the residents want their neighborhood to be. if anything it
promotes discord.
Article 7: Supplemental Use Regulations
Section 7 -1 Horne Base Businesses
7 -1.1 General Provisions Sub - section C
C. Services or sales conducted on the premises shall be by appointment only and shall not be
oriented toward, or attract, off -the- street customer or client traffic.
Just by the nature of this business I fear that people would be coming into our
neighborhood to see where the business is located or if they can just buy a gun there. This is
Dubuque and when word gets out on the internet that someone on Hawkeye Dr. is selling guns
out of their house we will have all kinds of looky loos besides the increased traffic created by
the business. Also the people who like my one neighbor thinking it is a convenience to just go
next door but why not drive up and see what he has!
Because of the above mentioned Articles to the Code I feel that this business should not be
allowed to be granted a Conditional Use for our Residential Neighborhood. i actually believe it
should be listed as a Prohibited Business but that is another issue I will take up with the other
Zoning Board.
Again because of the likelihood of more traffic, negative property and resale values, and
security and safety issues we please ask that you turn down this request. Thank you

Bev: I don't want to give a "shoot from the hip" type answer on this...but here's my thoughts...
If someone has a gun (ie they are a hunter) and want to sell or buy a gun NOT as an on -going business, I think that should
be okay. Looking at it from a "BUSINESS" point of view...is WAY different. It could make the "business" a target for less -
than- desirable people who want guns. Even if it's "internet" buying and selling, the guns will be brought to and taken out of
the business on more than a "regular" basis. I am not opposed to guns (we have a couple...a 12 gauge used for hunting and
a pistol for target practice). I absolutely believe we should all have the right to bear arms...just not buy and sell them next
door in a neighborhood "all the time ".
"Residential" living should be about families enjoying their homes and their children being able to play safely without having
concerns of less than desirables coming into the neighborhood. There's enough of that going on as it is.
am sure, too, there would be a lot of decent people who travel in and out of the "business "...and probably most would
be. But then there are the others that you wouldn't want to "attract" to your neighborhood. The sale of guns as a business
should be done out of a business district and not in someone's backyard.
In "my opinion "...if I brought clients into your neighborhood to buy a home and they found out the neighbor buys and sells
guns for a living...they would probably move on to something else...l'd bet money on that.
Another example of "what people look for when buying a home...they aren't usually attracted to "a busy street" if there
is concern about child safety...common sense would tell you they wouldn't want to live next door to a "gun dealer" either.
My last point...I doubt any gun business will be limited to "hunters "...so the type of some people coming to a gun dealer's
door aren't going to be looking for a nice deer rifle! I wouldn't want to encourage "that type" to come to my neighborhood and
most people wouldn't!
Bev, I would prefer you kept my name anonymous and you could refer to me as a "local realtor" in your conversations. I am
not afraid to voice my concerns, I just don't want to be miss quoted or get pulled into this at this point. I have enough to keep
me busy. You may also check with Joe Leiser at the Board Office (he's the executive officer) to get his thoughts. I'm sure
don't speak for every realtor, but I would guess the majority as to their experience with clients... no matter what they

Firearms Home Businesses Banned in Ames
Ames City Council approved the third reading of an ordinance adding firearms sales to the list of prohibited home
businesses Tuesday.
Ames City Council Tuesday unanimously approved adding firearms sales to the list of prohibited home businesses for
the third time making it law.
George Seaton, who applied for a permit to sell firearms in his home in April, was given a one year permit which will be
valid until April 2013, despite the new prohibition, WOI reported.
Seaton has a Federal Firearms License, which allows him to sell firearms as a business so long as zoning laws allow it.
Residents in Seaton's neighborhood petitioned the council to add firearms to the list of prohibited businesses after
learning of his home business earlier this year, saying that they believed it could affect their property values.
At an Oct. 9 City Council meeting neighbors of other in -home firearms sales businesses including Suzi Howk, told the
council that they have seen no impact on their neighborhood as the result of similar businesses. Representatives from
the Iowa Firearms Coalition, Liberty Iowa PAC and Campaign for Liberty also collected more than 300 signatures from
residents who said they weren't in favor of the home occupation ban and filed the petition Oct. 9.
Council members approved the third reading unanimously without discussion at the time of the vote.
Animal hospitals, dancing and exercise studios, private clubs, restaurants, stables and kennels, repair or painting of
motor vehicles and motorcycles are already on the list of prohibited home occupations. The ban doesn't affect private
gun sales or firearms possession.
This one is pretty close to home. It looks like it was pretty easy to get it through to ban it in Ames. It sounds
like there were even people in favor of allowing it but the City Council still approved the ban.

You don't have to live in Pleasant Hill to be concerned about the ramifications of allowing Home Gun Dealers to
operate in residential neighborhoods. Guns don't stay where they are sold. And illegal guns all start out as legal guns.
Sales of firearms and ammunition, two dangerous products, belong in a commercial business zone with proper security
and oversight, not in a residential neighborhood. The Contra Costa Brady Campaign urges you to attend the following

Here are 10 good reasons why you should be concerned about having your next door neighbor (Federal Firearms

1. The safety of residents in close proximity to home -based firearm and ammunition sales poses concerns about
its negative influence on children, the possible increase in violence and /or criminals in city residential neighborhoods,
trafficked firearms, and the infrequency of federal and state inspections to adequately regulate these business
operations once established;
2. Fire and /or explosive hazard caused by potentially large quantities of stored firearms and ammunition in close
proximity to the homes of neighboring residents;
3. Potential theft of firearms and ammunition through burglary or robbery;
4. Inability to safely and securely store such firearms and ammunition in a home -based business where children
are commonly present;
5. No assurance that appropriate measures are being taken to prevent the
accessibility of firearms /ammunition by individuals prevented by law from
possessing them
6. Increased vehicular and foot traffic in residential areas caused by a firearms and ammunition sales business
that could change the neighborhood's character and harm the quality of life;
7 Probable negative impact on neighboring property values and requirement to "disclose" presence of home gun
dealer upon sale of neighbors' homes;
8. Increased demands on local law enforcement resources to monitor numerous home gun dealers, or lack of any
oversight by local police department;
9. Lack of sufficient federal or state inspections due to limited resources. (ATF reported in 2007 that it inspects
each FFL, on average, only once every 17years);
10. Home gun dealers selling over the Internet are difficult to monitor. According to ATF, home -based Internet FFL
gun dealers typically operate by setting up a website offering a variety of firearms and ammunition. The dealer
responds to requests by placing orders to the manufacturer, and the firearms are sent to the dealer's home. He then
sells them out of his house or redistributes them through the mail to another FFL dealer out of the area.
Because of these concerns, cities and counties throughout California have adopted Taws prohibiting kitchen table gun

This article says it all for our neighborhood. 1 certainly hope you understand it is just not our neighborhood but
neighborhoods all over the country that are fighting this issue. I have hi- lighted the areas that we feel affect our
neighborhood and are fighting this business on but all points need to be considered. Actually 1 hi- lighted only the five
areas pertinent to the Unified Development Code for that meeting, but all 10 are pertinent to this meeting. A point of fact
is the person in our neighborhood did not even have an alarm system in his house and when asked by a board member if
he was going to get one he replied yes sometime, but an alarm system isn't a requirement for a Conditional Use Permit
and this certainly should be for this type of business. Please look closely at all 10 reasons.

Joseph Leigh believed he'd found a way to beat the recession with a new business in his South Jordan home:
assembling and selling specialty guns.
Selling firearms from his Daybreak house would be the key to bringing in a salary after Leigh was laid off last year,
planning documents filed with the city show. He'd already operated a gun business out of his home when he lived in
Pleasant View in 2010 and wanted to retry the endeavor.
But that plan hit a snag when a neighbor raised concerns about gun sales in a subdivision full of children, leading the
South Jordan Planning Commission to reject Leigh's request for a business license to operate the firearms business.
But Leigh isn't giving up yet, and on Tuesday, he'll appeal his denial to the commission in an effort to secure a license
for his home to operate Leigh Custom Arms LLC. He insists his gun business won't be a safety hazard.
Leigh has said he intends to sell standard factory firearms upon request, but does not plan to carry inventory. Should
his business grow to that point, Leigh told city planners he would move assembly and sales to a regular storefront.
"Pre- manufactured parts will be ordered from several outside vendors and those parts will be assembled into the
firearm," Leigh told city planners in an appeal letter. Leigh has an active federal license that allows him to manufacture
firearms, a process he likened to assembling bicycles, according to city documents.
Leigh said he also plans to offer gun training, with classroom work and target shooting taking place off -site from his
home as part of his business.
Licenses like the one Leigh requested, however, can be a hard sell to the commission, which is required by a city
ordinance to deny a license for a home occupation business if any neighbors voice objections, said South Jordan City
Planner Jake Warner. Notices were sent out to all residents within 30o feet of Leigh's home, Warner said.
The planning board denied Leigh's request last month based on a neighbor's letter of concern about locating such a
"high- risk" business in a residential area teeming with children, "where the homes are at times not even ro feet from
door to door."
Leigh's chance to get a business license for his home isn't over yet, though. City ordinance allows applicants to appeal,
Warner said, which Leigh filed late last month.
In his letter of appeal, Leigh pledged to install steel grates over basement window wells and to keep all guns under lock
and key. He also said it would take three to six weeks to fill customer orders.
"This waiting period, along with the cost of the gun, is not typical for someone who would want to purchase a gun to
commit a crime," Leigh told planners.
Warner said it's likely the planning board will grant Leigh's request if all impacts can be mitigated. That approval,
however, could later be appealed to the City Council, where Leigh's request for a business license could again be shot
down.
In early July, Holladay's Planning Commission approved a similar home -based firearms business over robust
objections from neighboring residents. However, they did not pursue recourse from the City Council within the allowed
10 -day period and any further appeal must be filed in court.
In other action, South Jordan's planning board will also consider a conditional use permit Tuesday for the city's first
indoor shooting range in a commercial zone at 1231 W. South Jordan Parkway. The new business, called "The Gun
Vault," will also sell firearms.

Howard Slaughter owns a home on the corner of Adams and Sycamore Streets in the city's Ellicott District.
Slaughter teaches a pistol permit class and now wants the opportunity to sell guns to his clients -- out of his home.
Slaughter made a request to city officials for permission to sell firearms out of his Adams Street home that request
was denied Wednesday afternoon.
"His house is too close to the main street and school buses pick up children and drop children off and there is a city
bus stop there. It wouldn't be feasible, "stated Norma Robinson, who has lived on Adams Street for 57 years.
"The neighbors were concerned about delivery methods, they were concerned about people breaking into his home,
to look for weapons on the premises," said Councilmember Darius Pridgen.
Meanwhile, there have been more than two dozen violent 911 calls, including one gun call and robbery over the
past year at various locations on Adams Street.
None of those calls involved Slaughter's home.
Slaughter could not be reached for comment for this story
I wish we were in Buffalo. It seems a lot easier to have this stopped than here in Dubuque. These people didn't
even have to fight that hard.
But the issue ended on Wednesday, April 24, without a bang when applicants Roger and Jill Miller
asked by letter to withdraw their request from consideration by the township Planning Commission.

PORT SHELDON TOWNSHIP, MI -- Neighbors came armed with data ready to shoot down a special
use request to operate a gun shop in a residential neighborhood.
"It has come to our attention that we might have some neighbors who have serious concerns about our
request," wrote the Millers in a letter to planners read at the start of Wednesday's meeting.
"Being a good neighbor is more important to us; it is our hope that this retraction might help alleviate
those concerns."
Neighbors along Lakeshore Drive began to organize against the special use permit after it was
requested in March.
One of the things that concerns us is the increase in home invasions and robberies that occur when
people know there are guns," said neighbor Mary Nienhuis, who was one of about 30 homeowners to
attend the meeting.
"There are appropriate places to sell guns and residential neighborhoods is not one of them," she said.
Other residents questioned whether gunpowder, ammunition and guns were being kept on the property.
They also complained of gunshots being fired on the property in a residential area where children played
outside.
Building Official Wayne Oosterink said he visited the Miller property and found equipment and
components for reloading bullets in an accessory building on the property.
"There were no guns or powder on site but township requirements are that a home occupation has to be
done in the home," said Oosterink, noting that the Millers had been sent a "cease and desist order"
because of the accessory building violation.
Commission Chairman Ken Souter said homeowners in the township by right" are allowed to run home
occupations. Home occupations involving guns though require approval of a special use permit from the
Planning Commission.
Souter said Port Sheldon is a rural township and individuals have the right to safely fire guns on their
property. The only restriction is that if a gun is being used during hunting, it cannot be fired within 400
feet of a residents.
Resident Jack Petroelje said he was pleased that the request for a gun business permit was withdrawn
without a fight.
"It was the right thing to do. We have lived in this area for 27 years and my wife and I decided that if the
permit was approved we would have to move," he said.
These people are lucky. Their gun business requesters cared enough about the neighborhood to
do the right thing. I think our neighborhood will never be the same because of what this request
has done to us.

2013 -06- Even after the seriousness of the Newtown tragedy and the national outcry in
support of tighter gun control, there seems to be something of a stalemate in
legislation to further protect life by restrictions on the purchase and use of
firearms. That has been alarming and disappointing to me. However, we can
do something more locally in our community and I think that prohibiting firearm
business in residential neighborhoods would be an excellent place to start. I
am in full support of this effort!

SUBJECT: Proposed Amendment to Section 16 -7 -1.3 Prohibiting Firearm Sales as a
Home -Based Business
INTRODUCTION
This memo is written in response to a request from Beverly Knockel, 900 Hawkeye
Drive, Dubuque, asking to amend Section 7 -1.3 of the Unified Development Code
regarding home -based businesses. Ms. Knockel is asking that firearm sales be added
to the list of prohibited home -based businesses.
DISCUSSION
Section 7 -1 of the City of Dubuque's Unified Development Code (UDC) regulates home -
based businesses that are by definition located in residentially zoned districts. This
section outlines the general provisions regulating home -based businesses and also lists
those home -based businesses that are permitted and those that are prohibited.
Section 7 -1.4 of the UDC states that any proposed home -based business not
specifically prohibited, or that employs up to two people who do not reside within the
home herein, shall be considered a conditional use and can be granted or denied by the
Zoning Board of Adjustment upon finding that the proposed home -based business can
meet the provisions of this section.
The general provisions in Section 7 -1.1 state that the home -based businesses may not:
1) Change the outside appearance of the dwelling or be visible from the street.
2) Generate traffic, parking, sewerage or water use in excess of what is normal in a
residential neighborhood.
3) Create a hazard to person or property, result in electrical interference or become
a nuisance.

4) Result in outside storage or display of any kind.
5) Employ other than self or family members residing on the premise.
6) Occupy more than 50% of the total floor area of the dwelling unit.
7) Require deliveries of materials to and from the premises involving the use of
vehicles over 2 ton capacity, except parcel post or similar parcel service vehicles.
8) Produce noise, vibration or smoke, odors, heat or glare as a result of the home -
based business which would exceed that normally produced by a single
residence as determined by the City Planner.
9) Advertise with a sign on -site or off - premise.
The general provisions further note that customer or client contact shall be primarily by
telephone, mail, fax, email or website and not on the premises of the home -based
business, except those home -based businesses such as tutoring, teaching, child care or
personal services which cannot be conducted without personal contact and that are
listed as permitted. General provisions also note that service or sales conducted on the
premises shall be by appointment only and shall not be oriented toward or attract off -
street customer or client traffic.
Section 7 -1.2 lists the following as permitted home -based business:
1) Adult day -care services
2) Art studio
3) Cake decorating
4) Ceramics
5) Computer programming
6) Consultant services
7) Child care (not included licensed child care center)
8) Dress making, sewing and tailoring
9) Film processing
10) Home cooking and preserving
11) Home crafts
12) Home office
13) Home products distributors
14) Income tax preparation
15) Insurance sales persons
16) Mailing services
17) On -line businesses
18) Painting, sculpting and writing
19) Teaching or tutoring limited to 4 persons at one time
20) Telephone answering
21) Typist or stenographer

Section 7 -1.3 lists the following as prohibited home -based businesses:
1) Antique furniture refinishing for resale on the premise or as a service for the
general public
2) Automotive repair, except that an individual residing on the premises may
service such individual's own vehicle providing that the provisions of Section
7 -1.1 are met and that no repair shall take place between the hours of 9 p.m.
to 9 a.m.
3) Barber and beauty shops
4) Contractor shop
5) Recycling or salvage operation
6) Small engine repair
7) Welding services
All home -based businesses, whether specifically permitted or permitted as an approved
conditional use, have to follow all of the general provisions as outlined in Section 7 -1.1
above. As an approved conditional use, the Zoning Board of Adjustment can stipulate
any additional conditions they feel necessary to mitigate any perceived negative
impacts that may be caused by the proposed home -based business.
The Zoning Board of Adjustment has approved three home -based firearm sales
businesses within the City since 2005. These were located on Windsor Avenue,
Phyllrich Drive and Kane Street. The Zoning Board of Adjustment placed conditions on
two of the three permits. One approval limited the business to one customer on the
premises at a time and limited the hours of operation to between 8 a.m. and 5 p.m. The
second approval limited the hours of operation for delivery and pick -up to between 8
a.m. and 6 p.m. The third approval had no conditions.
Since the first firearm sales home -based business was approved in 2005, the City of
Dubuque's Planning Services Department has received no complaints from the
neighbors. The City of Dubuque Police Department has also listed no calls for service
at these addresses specific to the firearms business. Over this time there have been
numerous calls for service at these locations. However, once the general calls such as
fire alarms, ambulance calls and child welfare calls are eliminated, there were five calls
regarding illegal parking that may or may not be attributed to the home -based
businesses.
In general, it has been Planning Services staff's experience that a business of this
nature tends to generate little traffic, demand on parking, noise or activity over and
above that normally found in a residential neighborhood. There are a number of other
permitted home -based businesses that may generate more traffic, such as home day

care, income tax preparation, insurance sales and teaching or tutoring. Home based
firearms sales are generally web based and customer contact is required to be by
appointment only. The contact would generally consist of customer pick -up of a firearm
that had been ordered over the internet.
The applicant states that the home -based firearms business would have a negative
impact on the value of adjacent properties. Planning Services staff has no evidence
either supporting or dismissing this claim.
The applicant also states that based on the nature of the firearms business, there is the
possibility there could be security issues and the potential for criminal element to be
tempted to rob the home. This potential certainly exists; however, to what degree and
how it is different from any other home burglary is not clear. Again, staff can only base
their assessment on experience with existing firearm sales and from Police reports.
It is also important to note that a resident seeking a Federal Firearms License (FFL)
undergoes an extensive background check and must meet all of the rules and
regulations set forth by the Federal Bureau of Alcohol, Tobacco and Firearms.
RECOMMENDATION
Staff recommends that the Commission review the applicant's request in light of all the
information provided, be prepared to discuss the information at the upcoming Zoning
Advisory Commission meeting and to provide a recommendation to the City Council.

8. Firearm sales.
Section 2. This amendment has heretofore been reviewed by the Zoning
Advisory Commission.
Section 3. This Ordinance shall take effect immediately upon publication as
provided by law.
