RE: Zaber vs. City of Dubuque (Franchise Fee Litigation)
Dear Mayor and Council Members:
As you know, the City of Dubuque, along with several other Iowa cities, has been sued
in an action brought challenging the legality of certain franchise fees. Several of the
other cities have retained the law firm of Ahlers & Cooney, P.C. to represent them in this
litigation. Because the cities have a number of common interests in these lawsuits, I
believe it is in the mutual interests of the City of Dubuque to retain the law firm of Ahlers
& Cooney, P.C. to represent the City as well.
I would request your authority to retain the Ahlers & Cooney, P.C. law firm to represent
the City in the franchise fee litigation.
