The application, staff report and related materials are attached for your review. Discussion Staff reviewed the submitted Plat of Survey, noting that the Commission reviewed a similar plat the previous month. The new plat was necessary because the developer needed to alter the street alignment to accommodate the number of condo units he wanted to construct and still meet setbacks. There were no public comments. The Zoning Advisory Commission discussed the request, noting that the submitted Plat of Survey is in substantial compliance with the City's Subdivision Regulations. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Recommended Motion: Motion to approve the Plat of Survey of Lot 1-2 and Lot A-2 of Cedar Lake East Third Addition as it is in substantial compliance with City of Dubuque Subdivision Regulations. Conformance with Comprehensive Plan: This subdivision involves the Comprehensive Plan Land Use Element Goals 1.1, 1.2, 6.3, and 7.2. Impact of Request on: Utilities: Existing utilities are sufficient to handle the proposed development. Subdivision Staff Report - Lot 1-2 and Lot A-2 of Cedar Lake East Third Addition Page 2 Traffic Patterns: The subject development will be served by an extension of an existing private street named North Cedar Court. The number of vehicle trips on this roadway will be limited as it only serves Lot 1 of 2 and the future residence is built in that portion of the development. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control is provided during all phases of development of the property. Adjacent Properties: The proposed development is a continuation of the Cedar Lake planned residential development. Staff does not anticipate any adverse impacts to adjacent properties. Recommended Conditions on Plat: None. Staff Analysis: The Zoning Advisory Commission reviewed a very similar plat at the August meeting. The plat only differs from the previously approved plat by reconfiguring the location of North Cedar Court. The private road has been repositioned to the south to accommodate the proposed condominium units while still providing a 20-foot front yard setback. The previous final plat was approved by City Council, but was not recorded. Thus, this new plat can be approved without rescinding the previous plat. The submitted plat of survey is a continuation of the Cedar Lake Development comprised of single-family homes and four-unit condominium buildings. The subject plat provides for the extension of North Cedar Court and will allow the development of condominium buildings along the north side of the roadway. North Cedar Court is built with a 25-foot right-of-way and 24-foot of paving. This roadway is consistent with the other roadways previously built in the Cedar Lake Development and was approved through the Planned Unit Development process when the project was annexed to the City of Dubuque in the mid 1970's. This submitted plat of survey is in substantial compliance with the City of Dubuque Subdivision Regulations and staff would recommend that the Zoning Advisory Commission recommend approval of the submitted Plat of Survey of Lot 1-2 and Lot A-2 of Cedar Lake East Third Addition. City Clerk Address: City Hall 50 W. 13"' St. Telephone: 589-4121 RESOLUTION NO. 500 -06 A RESOLUTION APPROVING PLAT OF SURVEY OF LOT 1-2 AND LOT A-2 OF CEDAR LAKE EAST THIRD ADDITION IN THE CITY OF DUBUQUE, IOWA Whereas, there has been filed with the City Clerk a Plat of Survey of Lot 1-2 and Lot A-2 of Cedar Lake East Third Addition in the City of Dubuque, Iowa; and Whereas, upon said Plat of Survey appears a private street to be known as North Cedar Court (Lot A-2), with certain public utility easements, which the owner by said Plat of Survey has dedicated such easements to the public forever; and Whereas, the Plat of Survey has been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said Plat of Survey has been examined by the City Council and they find that it conforms to the statutes and ordinances relating to it, except that no streets or public utilities have yet been constructed or installed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the dedication of easements for public utilities, as they appear upon said Plat of Survey, be and the same are hereby accepted; and Section 2. That the Plat of Survey of Lot 1-2 and Lot A-2 of Cedar Lake East Third Addition is hereby approved by the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon said Plat of Survey, provided the owners of said property herein named, execute their written acceptance hereto attached agreeing: (a) To reduce North Cedar Court (Lot A-2) to grade and to hard surface with asphaltic concrete, all in accordance with the City of Dubuque standard specifications, in conformance with construction improvement plans approved by the City Engineer for a private street. . . . (b) To install sanitary sewer mains and sewer service laterals into each individual lot, water mains and water service laterals into each individual lot, and erosion control devices all in accordance with the City of Dubuque standard specifications, all in a manner acceptable to the City Engineer, and in accordance with construction improvement plans approved by the City Engineer, and inspected by the City Engineer. The private street and sanitary sewer mains are so designated as private mains and shall be maintained by the owners and/or homeowners' association. (c) To construct said improvements, prior to two (2) years from the date of acceptance of this resolution, at the sole expense of the owners, or future owner; (d) To maintain the public improvements, for a period of two (2) years from the date of the acceptance of those improvements by the City of Dubuque, Iowa, at the sole expense of the owners, or future owner; And, further provided that said Gibbs Construction, Inc., as owner of said property, shall secure the performance of the foregoing public water main provided in this Section by providing guarantees in such form and with such sureties as may be acceptable to the City Manager of the City of Dubuque, Iowa. Section 3. That the final acceptance of all public improvements shall occur upon certification of the City Engineer to the City Council that water main improvements have been completed in accordance with the improvement plans and City standard specifications and accepted by City Council Resolution. Section 4. That in the event Gibbs Construction, Inc. fails to execute the acceptance and furnish the guarantees provided in Sections 2 and 3 hereof within 180 days after the date of this Resolution, the provisions hereof shall be null and void and the acceptance and approval the plat shall not be effective.
