The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the existing sign regulations for
Asbury Plaza, the number of properties impacted by the request and the existing and
proposed signage for Premier Bank.
Staff reviewed current restrictions on out lot signage, proposed language for amending the
Asbury Plaza PUD and the number of out lots in Asbury Plaza.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the proposed language
by staff is too wide open. The Commission proposed restricting the addition of another sign
to those out lots with three or more frontages. They reviewed the number of out lots that
could potentially erect an additional monument-style sign.
Recommendation
By a vote of 5 to 0 with one abstention, the Zoning Advisory Commission recommends that
the City Council approve the request as shown in bold type in the attached Ordinance.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Asbury Plaza PUD Text Amendment for Signage
INTRODUCTION
On January 15, 1996, the City Council approved the rezoning from AG and C-3 to PUD
Planned Unit Development with a PC Planned Commercial designation for
approximately eighty acres of land at the intersection of Asbury Road and the Northwest
Arterial. This development is known as Asbury Plaza. On April 3, 1996, Corey
Development revised the sign regulations for the Asbury Plaza PUD. The sign revisions
were not deemed a significant change to the PUD regulations and were approved by
the Zoning Advisory Commission and City Council. On May 17,1999, the City Council
approved an amendment to the Asbury Plaza PUD that incorporated approximately 27
additional acres to the original PUD. On November 18, 2002 the City Council approved
an amendment to wall-mounted and center sign regulations for Asbury Plaza that did
not include outlet signage.
DISCUSSION
On August 30, 2006, Andrew Mozena, representing Premier Bank, submitted an
application to amend the Asbury Plaza Shopping Center PUD sign regulations. He has
asked that the sign regulations be amended to permit an additional monument-style
freestanding sign not to exceed 10 feet in height and 10 square feet in area on all out
lots in the Asbury Plaza PUD. Currently, the regulations for out lots in the Asbury Plaza
permit one freestanding sign and read:
Section 2-3(b), each out lot parcel shall be allowed one (1) freestanding sign, limited to
100 square feet in size and a maximum of 25 feet in height.
The new regulation would add a Section 2-3(c), which would read:
"Each out lot shall be allowed one (1) freestanding monument-style sign not to exceed
ten (10) square feet in area and ten (10) feet in height.

The addition of second monument -style freestanding sign not to exceed ten (10) feet in
height and ten (10) square feet in area should have very limited impact on the total
amount of signage within the Asbury Plaza PUD. All freestanding signs will have to be
placed on the out lot, not on public or private right-of-way, and will not be allowed in the
visibility triangle. Therefore, staff does not perceive this change to the sign regulations
as being a significant one for the Asbury Plaza PUD.
RECOMMENDATION
Staff recommends the Commission review these proposed sign standard changes and
provide a recommendation to the City Council.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES HEREINAFTER
DESCRIBED PROPERTY LOCATED AT THE NORTHWEST CORNER OF
ASBURY ROAD AND THE NORTHWEST ARTERIAL TO AMEND ORDINANCE
NO. 44-99 THAT ESTABLISHED THE PUD PLANNED UNIT DEVELOPMENT
DISTRICT FOR ASBURY PLAZA AND ADOPTING AMENDED REGULATIONS
FOR OUT LOT SIGNAGE
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by providing for the amendment of Ordinance
No. 44-99, which adopted regulations for the Asbury Plaza Planned Unit Development
District for hereinafter described property, to wit:
Lots 1, 2, 3 and F of Asbury Plaza No.2, Lot 1-1 of Asbury Plaza, Lot 1 of Asbury
Plaza No.6, Lot 1 of Asbury Plaza No.7, Lot A of Asbury Plaza No.8, Lot 1 and 2
Asbury Plaza No.9, Lot 1 and Lot A Asbury Plaza No. 10, Lot 2 Asbury Plaza No. 11,
Lots 1, 2, 3, 4 and 6 of Asbury Plaza No. 12, Lot 2 of Asbury Plaza No. 13, and Lots 1,
2 and A of Asbury Plaza No. 14, and to the centerline of the adjoining public right-of-
way, all in the City of Dubuque, Iowa.
Section 2. Pursuant to Iowa Code Section 414.5 (2005) and as an express
condition of the reclassification, the undersigned property owner agrees to the following
conditions, all of which the property owner further agrees are reasonable and imposed
to satisfy the public needs that are caused directly by the zoning reclassification:

3. Out Lot Signage:
a) Each out lot parcel shall be allowed wall-mounted signage
as per the C-3 General Commercial District sign regulations.
The maximum number of signs per business is two (2) signs.

b) Each out lot parcel shall be allowed one (1) freestanding
sign, limited to 100 square feet in size and a maximum
height of 25 feet.
c) Each out lot with three (3) or more frontages shall be
allowed one (1) additional freestanding monument-style
sign not to exceed ten (10) square feet in area and ten
(10) feet in height.
Section 3. Recording. A copy of this Ordinance shall be recorded at the expense
of the property owner with the Dubuque County Recorder as a permanent record of the
conditions accepted as part of this reclassification after the adoption of this Ordinance.
This Ordinance shall be binding upon the undersigned and his/her heirs, successors
and assigns.
Section 4. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 5. This ordinance shall take effect immediately upon publication, as
provided by law.
