On March 7, 1965, Don Kirch-
berg filed claim for damages to
his motor behicle in the amount of
$45.49 as a result of damages suf-
fered to his car on March 7, 1965
at West Locust Street & Rosedale
in the City of Dubuque, claiming
a defective condition thereat con-
sisting of a hole in the street 10
inches deep and 54 inches wide, as
a result of which he suffered dam-
ages to his vehicle.
I have made an investigation of
this matter and have conferred
with the claimant who has agreed
to accept the sum of $45.49 and it
is recommended that said offer be
accepted and the City Auditor be
instructed to draw a warrant pay-
able to Don Kirchberg in the
amount of $45.49 and to transmit
same to the City Attorney for
delivery to claimant upon receipt
of a duly executed release.

On December 28, 1963, Alvina
Duschen filed claim for damages
as a result of injuries suffered in
a fall on Oct. 23, 1963, claiming
a defective condition existed in
the public walk on West 7tb Street
at or near Ralph's Barbershop
thereat.
On July 22, 1964 when reporting
to the City Council on said claim,
City Attorney recommended denial
of such claim and said recom.
mendation was approved by the
City Council. At the time of mak-
ing such recommendation to the
City Council it was the opinion
of tbe City Solicitor that tbe de-
mand for settlement was not in
line with the injuries received.
Since that time the City Solicit-
or has had numerous conferences
with the claimant's attorney who
has finally made an offer of settle-
ment in the amount of $300.00.
Claimant suffered special dam-
ages in the amount of $132.94.
In view of tbe foregoing it is
the recommendation of tbe City At-

the offer of settlement in the
amount of $300.00 be accepted and
that the City Auditor be instruct-

of governing the parking of motor
vehicles in a parking meter space ad-
jacent to a parking meter and limit-
ing the time during which a motor
vehicle may be parked thereat.

City of Dubuque, Iowa:
Section 1. That Ordinance No. 33-49,
as amended, known as <<Traffic Code"
of City of Dubuque, Iowa, be and the
same is hereby amended by repealing
Section 16.6 thereof and enacting a new
Section 16.6 in lieu thereof as follows.
"Section 16.6. Between the hours
and on the days ordered in Section
5, Ordinance No. 37-65, holidays except-
ed, nc motor vehicle shall be parked
in a parking meter space as defined in
Ordinance No. 37-65, adjacent to which
a parking meter has been installed,
while such meter is showing a signal
indicating that such space is illegally
used, for a longer period than is neces-
sary to actuate the meter, and no motor
vehicle shall be parked for a longer
period of time at anyone time than
the period ordered in Section 5 of
Ordinance No. 37-65. Each motor vehicle
parked in any parking meter space shall
park within the lines or markings desig-
nating the same."
Section 2. This Ordinance shall be
in full force and effect from and after
its final passage, adoption and publi-
cation as by law provided.

in any parking meter any slug, de-
vice, or any metaUic substitute for
any United States coin.
Section 7. It shall be unlawful
for any unauthorized person to
open, or for any person to deface,
injure, tamper with, or wilfully
break, destroy, or impair the use-
fulness of any parking meter In-
stalled pursuant to this Ordinance,
or two hitch any animals thereto.

the police, under the dLrection of
the Chief of Police to keep ac~
count of all violations of this Or.

Section 9. Any person violating
any provision of this Ordinance
shall be deemed guilty of a mis-
demeanor, and upon conviction
thereof shall be punishable by a
fine not exceeding $100.00 and up-
on failure to pay said fine shall
be imprisoned for a period not ex-
ceeding thirty (30) days. The
word "person" herein shall in-
clude individual, firm, association,
or corporation.
Section 10. It shall be the duty
of the City Manager to designate
some person or persons to make
regUlar collection of money de-
posited in saId parking meters and
deilver the money to the Ci ty
Treasurer and he shall place such
money in a special fund to be
known as the Parking Meter Fund.
Such person or persons making
such collections shall be bonded
and covered by the City's Honesty
Blanket Position Bond.
Section 11. If any section, part
of section, sentence, clause, or
phrase of this Ordinance shall be
neld to be unconstitutional or in-
valid, the remaining provisions
hereof shall nevertheless remain in
full force and effect.
Section 12. That Ordinance No.
26-51; Ordinance No. 61-57; Ordin-
ance No, 31-61; Ordinance No. 47-
63; and Ordinance No. 41-64, be
and the same are hereby 'repealed.
Section 13. This Ordinance shall
be in force and effect thirty days
from and after its final passage,

FEE THEREFOR AND PROVI-

VIOLATION THEREOF, AND RE-
PEALING ORDINANCES NO. 26-
51; 61--57; 31-61; 47-63; and 41-64.
BE IT ORDAINED BY THE CITY
COUNCIL OF CITY OF DU-
BUQUE, IOWA:
Section 1. The City Manager is
hereby authorized and directed to
install parking meters in all mu-
nicipally owned parking iots for
the purpose of, and in such num-
bers, and at such places as may be
necessary to the regulation. con-
trol and inspection of the parking
of motor vehicles therein.
Section 2. Such parking meters
shall be installed immediately
adjacent to the individual puking
spaces hereinafter described, and
each parking meter shall be so
constructed and adjusted as to
show when properly operated, a
signal that the space adjacent to
which it is Installed is or is not
legally in use. Each parking meter
installed shall indicate on and by
its dial the duration of the period
of legal parking and on the ex-
piration of such period shall indi-
cate illegal or overparking.
Section 3. The City Manager shall
establish and designate by suitable
markings, parking spaces and traf-
fic lanes on said municipally own-
ed parking lots and each motor
vehicle parking in such parking lots
shall park within such parking
spaces. It shall be unlawful to
park any motor vehicle on any
municipally owned parking lot in
such a posItion that the same shall
not be entirely within such park-
ing space or in such a manner
that it shall obstruct the free
movement ot vehicles over such
traffic lanes.

Street Improvement Bond
The City of Dubuque in the State
of Iowa promises to pay as here-
inafter mentioned to the bearer
hereof, on the first day of ..............,
or at any time before that date,

buque, the sum of Five Hundred
dollars with interest thereon at
the rate of 5 per cent per annum,
payable semi-annually, on the pre-
sentation and surrender of the in-
terest coupons hereto attached.
Both principal and interest of this
bond are payable at the office of
the City Treasurer in the City of
Dubuque, in the State of Iowa.
This bond is issued by the City of
Dubuque under aod by virtue of
Chapter 396 of the 1954 Code of
Iowa, as amended, and the Reso-
lution of said City duly passed on
the 11th day of October, 1965, be.

scribed in said Resolution, in said
City, which cost is payable by the
abutting and adjacent property
along said improvements and is
made by law a lien on all of said

the SpeCial Assessment Fund No.
1253 created by the collection of
said special tax, and said fund can
be used for no other purpose.

Dubuque's shot tower.
Some have suggested recently
there be a crash-fill program of
dumps on the riverfront in order
that this land be quickly adapted
for light industrial use. We must
remember that the prsent dump-
filling program provides an outlet
for the entire community, includ-
ing one of Dubuque's finest indus-
tries, the Dubuque Packing Com-
pany. A systemized plan of dump-
ing is extremely esesntial for Du-
buque Packing Company which
employs four thousand persons.
So while some propose a crash-
dumping program in order to se-
cure industry that might possibly
employ 10 to 20 persons, we are
putting a burden on the Dubuque
Packing Company and permitting
this firm to be open to suggestions
to move elsewhere. Let us not be
so foolish as to overlook this great
industrial friend that we have. And
let's remember, too, that any crash-
dumping program would bring
about, within the near future, the
necessity for a multi-million dollar
incinerator which would have to be
paid for by tax dollars.
There are other areas in which
the Dubuque Park Board could
work, including the conversion of
vacated alleys to park or recrea-
tion areas. Certain other vacant
sites could also serve as valuable
assets to the neighborhood recrea-
tion area need which is becoming
more vital each year.
Only last week a report was
issued showing that Iowa is among
the lowest in States providing rec-
reational land and facilities. Be-
cause of the need to increase our
potential in this field and because
of the natural waterways and land
sites which Dubuque already en.
joys, it is imperative that this
council act now to place the re-
sponsibility of this vital planning
with one arm of the community
structure. I suggest, gentlemen,
that this arm be our Park Board.

Park Board is seeking new area
for parks while the Recreation
Commisison is doing the same
thing. At present, our Park Board
controls certain recreational and
park property while the Recreation
Commission controls the rest. Be-
cause planning of recreational
areas will be so essential for
Dubuque's future, it is in the best
interests of the City to have one
body doing such planning.
Since the Park Board is an elec-
tive body, chosen by the citizens
of our city, I propose that the con-
trol of all park and recreational
real estate be turned over to that
body. And, in order that there be
an orderly transition of budget
affairs, I suggest that this move
be made effective January 1, 1967.
The Recreation Commission,
which has been a valuable part of
our community structure, would
continue to serve as a program-
ming body and an advisory body.
For example, the Recreation Com-
mission would not control the
swimming pools as real estate but
would staff them. This group would
not control the golf course, but
would staff it with a director and
service personnel. This group's
possessions, then, would be those
items related to their staffing and
programming needs.
Such planning will give our Park
Board the opportunity to work
with the Dubuque County park
authority and Dubuque County
Conservation Commission in mak-
ing plans for a long range system
of parks and recreation area for
Dubuque. It also will give this
board the opportunity to apply,
under new government assistance
plans, for dollar help and tax re-
lief in purchasing new areas.
I would suggest, too, that our
Park Board begin now to work to
secure any riverfront property re-
maining in Dubuque for future
Ipark and necreation area" The

that we stop the practice of taking
this valuable land, which our citi-
zens own, and turn it over for in-
