Mercy Medical Center property costsRESOLUTION NO. 427 - 99 RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT IA OF THOMAS E. BYRNE SUBDIVISION IN THE CITY OF DUBUQUE, IOWA Whereas, the Mercy Medical Center has requested the vacating of a portion of Clara Street; and Whereas, IIW Engineers & Surveyors, P.C. has prepared and submitted to the City Council a plat showing the vacated portion of Clara Street and assigned lot numbers thereto, which hereinafter shall be known and described as Lot 1A of Thomas E. Byrne Subdivision in the City of Dubuque, Iowa; and Whereas, Mercy Medical Center has agreed to construct a new cul -de -sac and relocate public utilities in accordance with plans to be prepared by IIW Engineers & Surveyors, P.C. and approved by the City Engineer. Whereas, the City Council of the City of Dubuque, Iowa has determined that this portion of Clara Street is no longer required for public use, except for utility easements as noted, and vacating and sale of said portions of alleys and streets known as Lot 1A of Thomas E. Byrne Subdivision in the City of Dubuque, Dubuque County, Iowa should be approved. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City of Dubuque intends to dispose of its interest in Lot 1A of Thomas E. Byrne Subdivision in the City of Dubuque, Iowa. Section 2. That the conveyance of Lot 1A of Thomas E. Byrne Subdivision in the City of Dubuque, Iowa to the Mercy Medical Center be contingent upon the payment of $4,085.00, plus platting, publication and filing fees. Section 3. That Mercy Medical Center shall construct a new cul -de -sac in accordance with plans approved by the City Engineer and relocate all necessary utilities at their sole expense within two (2) years from the date of acceptance of this resolution. Section 4. The City of Dubuque reserves unto itself a perpetual easement including the right of ingress and egress thereto, for the purpose of erecting, installing, constructing, reconstructing, repairing, owning, operating, and maintaining water, sewer, drainage, gas, telephone, t.v. cable, and electric lines as may be authorized by the City of Dubuque, Iowa, as shown on the plat of Lot 1A of Thomas E. Byrne Subdivision in the City of Dubuque, Iowa. Section 5. That the City Clerk be and is hereby authorized and directed to cause a notice of intent to dispose of said real estate to be published in the manner as prescribed by law. Attest: Mary A. Duggan, Ma - icAdERCY HEILTH CENTER June 21, 1999 The Honorable Terry Duggan Mayor of Dubuque 50 W. 13th Street Dubuque, IA 52001 Re: Vacating a portion of Clara Street to allow for modifications to the Mercy Institutional District Dear Mayor Duggan and City Council Members, Mercy Medical Center (Mercy) is requesting that Clara Street be shortened, and the cul -de -sac relocated, to allow for development of property owned by Mercy, which is located on the south side of Clara Street. The portion of the street, approximately 170 feet, which we are requesting be vacated, is abutted on both sides by property currently owned by Mercy. This request comes about as a result of Heartland Regional Paramedic Service's desire to centralize their operations on the Mercy campus. After looking at various locations, it was determined that the property adjacent to Clara Street, and in the immediate vicinity of the Emergency Department was the best choice. It allows the potential for emergency vehicles to access Wooten Street from Mercy property, thus minimizing their travel through residential areas. Wooten Street offers immediate access to the Dodge Street/Highway 20 corridor via Hill Street. This is the same path that is currently used by emergency vehicles entering and exiting the Emergency Room. Due to the deteriorated condition of the existing cul -de -sac, the fact that it only serves vacant Mercy property, and other topographical issues, we felt that rebuilding it farther to the west would benefit all interested parties. The Zoning Advisory Commission concurred with our assessment and supported our proposal for vacating a portion of Clara Street and rezoning the adjacent Mercy owned property to Institutional District (ID). We have submitted a sketch of the proposed changes to the City Engineer's office and have received positive comments from Mr. Ron Turner regarding the vacating of this property. He forwarded a copy of the "Vacating Procedure" to our office, and we are now in the process of complying with those items listed.
