ORDINANCE VACATING A PORTION OF CLARA STREET ABUTTING LOTS 6,
12, & 13 OF THOMAS E. BYRNE SUBDIVISION IN THE CITY OF DUBUQUE, IOWA
Whereas, Mercy Medical Center has requested the vacating of a portion of Clara
Street abutting Lots 6, 12, and 13 of Thomas E. Byrne Subdivision in the City of Dubuque,
Iowa; and
Whereas, IIW Engineers & Surveyors, P.C. has prepared and submitted to the City
Council a plat showing the vacated portion of a portion of Clara Street and assigned lot
numbers thereto, which hereinafter shall be known and described as Lot 1A of Thomas E.
Byrne Subdivision in the City of Dubuque, Dubuque County, Iowa;
Whereas, Mercy Medical Center has agreed to construct a new cul -de -sac and
relocate public utilities in accordance with plans to be prepared by IIW Engineers &
Surveyors, P.C. and approved by the City Engineer.
Whereas, the City Council of the City of Dubuque, Iowa has determined that this
portion of Clara Street is no longer required for public use, except for utility easements as
noted, and vacating of said portions of Clara Street known as Lot 1A of Thomas E. Byrne
Subdivision in the City of Dubuque, Dubuque County, Iowa should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the real estate described as Lot 1A of Thomas E. Byrne
Subdivision in the City of Dubuque, Iowa, be and the same is hereby vacated.
Section 2. The City of Dubuque reserves unto itself a perpetual easement
including the right of ingress and egress thereto, for the purpose of erecting, installing,
constructing, reconstructing, repairing, owning, operating, and maintaining water, sewer,
drainage, gas, telephone, t.v. cable, and electric lines as may be authorized by the City of
Dubuque, Iowa, as shown on the plat of Lot 1A of Thomas E. Byrne Subdivision in the City
of Dubuque, Iowa.

NOTICE is hereby given that the Dubuque City Council will conduct a public hearing on
MONDAY, August 16, 1999 at a meeting to commence at 7:00 P.M. in the Public
Library Auditorium for the purpose to consider disposing of City's interest in Lot 1A of
Thomas E. Byrne Subdivision to Mercy Medical Center contingent upon payment of
$4,085.00 plus platting, publication and filing fees. (Said property is that vacated portion
of Clara Street)
Written comments regarding above disposal may be submitted to the City Clerk on or
before time of public hearing. (Copies of all supporting documents may be viewed in
the City Clerk's Office, City Hall, during normal working hours.)
At said time and place of public hearing all interested citizens and parties will be given
an opportunity to be heard for or against said disposal.
Any visual or hearing impaired persons needing special assistance or persons with
special accessibility needs should contact the City Clerk's Office at (319) 589 -4120 or
TDD (319) 589 -4193 in the Human Rights Department at least 48 hours prior to the
meeting.
