ZONING BOARD OF ADJUSTMENT
SPECIAL MEETING

PRESENT:
Chairperson Mike Ruden; Board Members Randy Klauer, Jim Urell, Bill
Gasper, and Bill Gibbs; Staff Members Guy Hemenway and Kyle Kritz.
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying the meeting
was being held in compliance with the Iowa Open Meetings Law.
CALL TO ORDER: The meeting was called to at 4:00 p.m.
DOCKET 53-06: Application of Mike Williams, United States Postal Service/Jerry Purdy,
Design Alliance, Inc. for a variance for property located at 4555 Futuro Court to place a
concrete driveway/parking area 0 feet from the east and north property lines, 15 feet required,
in the Dubuque Industrial Center PUD Planned Unit Development District.
Jerry Purdy, Design Alliance, representing the U.S. Postal Service, discussed the site layout,
vehicle access and parking. He indicated the paved driveway will encroach on the east side
yard setback, but, the parking area would not. He said the east side of the building offers the
best access. He said the west side has a steep slope that would require grading and
construction of a retaining wall.
Kevin Botsford, 865 Camilla Ct., said the west side of the building is problematic because of
topography. He said that the Postal Service and would like to reserve the west side of the
building for future expansion. Mr. Botsford discussed security concerns for the parking areas
and government vehicles.
Discussion followed regarding parking configuration. Staff Member Kritz discussed the PUD
requirements and reviewed photos of the property. He said that the applicants are asking for
a waiver to allow construction of a driveway and parking lot in the required setback. He said
that a 15 foot setback is necessary for both the east and north side property lines. He
indicated that notices were sent to adjacent property owners.
Board members and felt that it met the criteria for granting a variance.
Motion by Urell, seconded by Klauer, to approve the request as submitted. Motion carried by
the following vote: Aye - Klauer, Urell, Gibbs and Ruden; Nay - Gasper.
DOCKET 58-06: Application of Randall Klauer, Klauer ConstructionNalet Foods Inc.
for a variance for property located at 1230 E. 12th Street to reduce green space from 4.9% to
2.4% to provide additional parking, 20% minimum required, in an HI Heavy Industrial zoning
district.

Randy Klauer stepped down from the table. He reviewed his request with the Board noting
street configuration, lack of available altematives for off-street parking, and the reduction of
green space.
Staff Member Hemenway reviewed the site characteristics, and noted the 20% green space
requirement was not in effect when the subject property was developed. He also reviewed
permeable area and the location of the 16th street detention basin.
The Board discussed the request and felt that it met the criteria for granting a variance.
Motion by Urell, seconded by Gibbs, to approve the variance request as submitted. Motion
carried by the following vote: Aye - Urell, Gasper, Gibbs, and Ruden; Nay - None; Abstain -
Klauer.
