Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing that reconstruction of Katrina
Circle is taking place and noted that future construction of the remaining condominium
buildings will take place on Lots 3, 4 and 5.
Staff reviewed the staff report, noting that the submitted Final Plat creates three lots
without frontage on a public or private street. The lots appear to "float" in space
because the Pine Knoll Homeowners Association owns all the surrounding property.
The new condominium buildings will have access to the reconstructed Katrina Circle.
Staff noted that at the writing of the staff report, the Pine Knoll Homeowners Association
was planning to dedicate the reconstructed Katrina Circle to the City of Dubuque for
public maintenance. The applicant no longer desires to dedicate the street, and staff
has revised the resolution accordingly.
There were no public comments.
The Zoning Advisory Commission discussed the request and found it to be appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving the lot frontage requirement for Lot 3, Lot 4 and
Lot 5.

Physical Characteristics: The subject property is located on the south side of Kane
Street and takes its access from Kane Street and is served by a private roadway named
Katrina Circle. The property is relatively flat.

Utilities: The existing condominium development is served by City water and sewer.
The proposed three new lots with new condominium buildings can be adequately
served by the existing utilities.
Traffic Patterns: There are no traffic counts available for Katrina Circle. Kane
Street carries approximately 3,000 average daily trips based on 2009 IDOT counts.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided erosion and sediment control is provided during reconstruction of Katrina
Circle and construction of the new condominium structures.
Adjacent Properties: Staff does not anticipate any notable impacts to adjacent
properties as the proposed subdivision plat allows for dedication of Katrina Circle to
the City of Dubuque for public maintenance and facilitates the construction of three
new residential condominium buildings that were part of the original planned unit
development conceptual plan for this development.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Pine Knoll Subdivision is located on the
south side of Kane Street and is currently served by a private street named Katrina
Circle. The homeowners association is in the process of reconstructing Katrina Circle
to City specifications and is offering dedication of Katrina Circle to the City for public
maintenance.
As part of the Final Plat, there are three building lots that will be developed by private
contractors. In order to get financing for the projects, the lots had to be platted off
separately. The lots were platted to include only the exterior dimensions of the
proposed residential structures as the surrounding property is under common
ownership held by the Pine Knoll Homeowners Association.
The Pine Knoll Homeowners Association is proposing to dedicate Katrina Circle to the
City for public maintenance after it's reconstructed to City standards. The condominium
development is currently served by City water and sanitary sewer. The reconstructed
Katrina Circle will be built with a paving width of 27 feet within a 42 -foot right -of -way.
The 27 -foot paving width is an alternate street standard for the City of Dubuque;
however, the 42 -foot right -of -way is 8 -foot narrower than the City standard of 50 -foot
right -of -way. The City streets within Westbrook and Eagle Valley Subdivisions utilize
27 -foot streets within 42 -foot right -of -ways.

The Engineering Department has reviewed and is recommending approval of the
proposed street cross - section design. Planning staff also has no objection to waiving
the right -of -way width from 50 -foot down to 42 -foot. The 42 -foot width has been used in
the past and since this basically a large cul -de -sac with very little traffic, Planning staff
does not feel that the narrower street and right -of -way will have any adverse impact to
the existing or future residences being served by Katrina Circle.
The location of the sidewalk adjacent to the back of curb will mean the City snow plows
will deposit wind rows on the sidewalk as part of snow plowing operations. This
situation is not new though. The Homeowners Association President pointed out that
the private snow plowing service the Association has hired regularly deposited snow on
the sidewalks.
Planning staff does not object to waiving the lot frontage requirements for Lots 3, 4 and
5 as they will all have access directly to Katrina Circle. The 42 -foot right -of -way cross -
section shows the 4 -foot sidewalks directly behind the back curb with 3.5 feet of green
space between the sidewalk and the right -of -way line. This layout is the same as the
original private street and maintains the same setbacks between the sidewalk and
condominium buildings.
Planning staff recommends that the Zoning Advisory Commission approve the
submitted Final Plat of Pine Knoll Subdivision, waiving lot frontage requirements for
Lots 3, 4, and 5, and the right -of -way width from 50 -foot to 42 -foot for Katrina Circle.

RESOLUTION APPROVING THE FINAL PLAT OF PINE KNOLL SUBDIVISION IN THE
CITY OF DUBUQUE, IOWA
Whereas, Pine Knoll Homeowners Association, as owners, have filed with the City Clerk
the Final Plat of Pine Knoll Subdivision in the City of Dubuque, Iowa; and
Whereas, upon said Final Plat appears certain public utility and water main easements,
which Pine Knoll Homeowners Association by said Final Plat have dedicated to the public
forever; and
Whereas, said Final Plat provides 0 feet of frontage for Lot 3, Lot 4, and Lot 5 on a
public or approved private street, where street frontage is required by Section 11 -14 of Title
16 of the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the dedication of the easements for public utilities and water main, as
they appear upon said Final Plat, be and the same are hereby accepted.

Section 2. That Section 11 -14 of Title 16 of the City of Dubuque Code of Ordinances,

Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa upon said Final Plat, provided that Pine Knoll Homeowners
Association execute their written acceptance hereto attached.
Section 4. That in the event Pine Knoll Homeowners Association fails to execute the
acceptance of this Resolution, the provisions hereof shall be null and void and the
acceptance of the dedication of easements and approval of the plat shall not be effective.
