Assistant City Engineer Bob Schiesl is recommending acceptance of the construction
contract for the 16th Street Railroad Crossing Approach Pavement Removal and
Replacement Project, as completed by Portzen Construction, Inc., in the final contract
amount of $42,117.78, which is a 6.1% increase from the original contract amount of
$39,679.20. This is due to an increase of 152 tons of stone base material required to
raise the profile of the east approach roadway.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
the 16th Street Railroad Crossing Approach Pavement Removal & Replacement Project
which was completed in conjunction with the 16th Street Railroad Grade Crossing
Repair project.
BACKGROUND
In June 2012, the City of Dubuque and the Canadian Pacific Railway received a
Railroad Grade Crossing Surface Repair Grant through the Iowa Department of
Transportation (Iowa DOT) for the construction of surface improvements at the East
16th Street grade crossing.
Per the terms of the grant agreement, the City is responsible for contracting and
completing the necessary approach pavement improvements to provide an acceptable
transition and driving surface over the new railroad surface crossing.
The City received informal competitive quotations for the 16th Street Railroad Grade
Crossing Approach Pavement Removal & Replacement Project on October 1, 2013.
Portzen Construction, Inc. of Dubuque, Iowa submitted the low bid in the amount of
$39,679.20. The project was awarded to Portzen Construction based on a competitive
quotation process for public improvements in accordance with Iowa Code, Section
26.14.
DISCUSSION
The 16th Street Railroad Grade Crossing Approach Pavement Removal & Replacement
Project was completed by Portzen Construction, Inc. in the final contract amount of
$42,117.78, which is a 6.1% increase from the original estimated contract amount. The
final contract amount is based on actual quantities incorporated into the project, which
included an additional 152 tons ($3,300) of stone base material required to raise the
profile of the east approach roadway.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize final
payment of the contract amount of $ 42,117.78 to Portzen Construction, Inc. for the 16th
Street Railroad Crossing Approach Pavement Removal & Replacement Project.

ACCEPTING THE 16TH STREET RAILROAD CROSSING APPROACH PAVEMENT
REMOVAL & REPLACEMENT PROJECT AND AUTHORIZING THE PAYMENT OF
THE CONTRACT AMOUNT TO THE CONTRACTOR
Whereas, the Public Improvement Contract for the 16th Street Railroad Crossing
Approach Pavement Removal & Replacement Project (the Project) has been completed
and the City Engineer has examined the work and filed a certificate stating that the
Project has been completed according to the terms of the Public Improvement Contract
and that the City Engineer recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the. City Engineer is approved and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Railroad Crossing Improvements and the Rehabilitation Railroad Tracks capital
improvement appropriation for the contract amount of $42,117.78 Tess any retained
percentage provided for therein as provided in Iowa Code chapter 573, and to pay such
retainage only in accordance with the provisions of Iowa Code chapter 573.
