A change in the interest rate benefits everyone who is assessed; businesses, landlords and homeowners. The City is embarking on a three year effort to reconstruct 73 alleys as part of the Bee Branch Watershed Flood Mitigation Project. Should the City receive a State Flood Mitigation Grant, this would increase to 240 alleys over the next 20 years. A change in the assessment rate will not only help the people along these alleys with their assessments, but will help people across the City when they face assessments for streets and other projects. A property owner paying a $1,000 assessment would pay $84 per year for 15 years. The assessments on the first three alleys average $1,420 per property. If a person is low income, they can receive financial assistance for a portion of their assessment, up to 100% depending on their income. BACKGROUND In the spring of 2012, the City of Dubuque entered into an agreement with the Iowa Department of Natural Resources to use $9.4 million dollars in State Revolving Fund (SRF) monies to rebuild seventy three (73) alleys in the Bee Branch Creek Watershed. The Bee Branch Watershed Green Infrastructure Project will reconstruct 73 alleys using permeable pavement. The permeable pavement allows storm water to infiltrate, rather than runoff the pavement. The project is to be developed over three years. The first two years of alley reconstruction will include minimal utility work. The third year of alleys will include reconstructing sewer and water utilities. DISCUSSION Engineering has been working on the design of the first group of alleys to be bid. This first bid set of alleys will consist of three alleys. The alleys are located: • Between Almond and West Locust Street from Foye Street and Ellis Street • Between Cedar Street and Maple Street from 14th to 15th Street • Between Providence Street and Lincoln Avenue from Johnson Street to Windsor Avenue Below is the schedule for the proposed project: Initiate Public Bidding Process Publish Notice to Bidders, Advertise for Bids Publish Public Hearing Notice on Plans, Specs, Assessments Mail Special Assessment Notice to Property Owners Publish Notice of Special Assessment: 1st Publication: 2nd Publication: Pre -Bid Construction Conference Public Hearing on Plans & Specs, Spec. Assessments Receipt of Bid Proposals (Bid- Letting) Award Construction Contract Project Completion Dates: January 6, 2014 January 10, 2014 January 10, 2014 January 10, 2014 January 10, 2014 January 17, 2014 January 16, 2014 January 20, 2014 January 23, 2014 February 3, 2014 June 30, 2014 Prior to the bidding schedule outlined above, engineering staff will meet with the abutting property owners of each alley. In these information meetings, the project schedules will be discussed along with what type of work will occur. Special assessments will also be discussed. Special Assessments Based on the Engineer's Estimate, a preliminary schedule of special assessments is developed. This schedule of costs represents the most the property owner would be expected to pay for their special benefit conferred on the project. The calculation of the special assessment uses the methodology of the New York Somer's method. This method has been used on City Street assessment projects for over 40 years. This method takes into account the width and depth of each lot abutting the improvement to calculate the special assessment. Eight green alleys have been constructed to date. Four of the alleys are SEP alleys which were not assessed due to the EPA consent decree. Three alleys were funded using Community Development Block Grants (CDBG) and by law cannot have special assessments levied. The remaining green alley had special assessments levied to the abutting property owners. That alley is located between Jackson and Washington Street from 17th to 18th streets. This alley had assessments that ranged from $315.95 to $2,071.30. These amounts included paving costs and private water services, where applicable. The plat and assessment schedule is attached and lists the individual assessments. The alley pavement portion of the total special assessment is reduced 75 %, exactly like the street program. This alley included water service assessments. Water service assessments are 100% assessable to abutting property owners and are used to replace the property owners lead service lines. In this case four (4) properties had lead water service lines. Each lead water service line replaced was assessed at a cost of $838.68 to the property owner. 2 If the alley had included sanitary sewer service replacements, those private sewer service costs would also be 100% assessable to the abutting property owner. The estimate on this cost would be around $800 per sewer lateral. This estimate is based on recent street program costs for replacing ten (10) feet of sewer lateral and the accompanying wye connection at the sewer main. For this current set of three alleys, attached is the preliminary schedule of special assessments. The assessment plat of each alley is also attached. Based on the preliminary schedule the range of assessments are as follows: Alley Between Almond and West Locust Street from Foye Street and Ellis Street Between Cedar Street and Maple Street from 14th to 15th Street Between Providence Street and Lincoln Avenue from Johnson Street to Windsor Avenue Highest Lowest Average Assessment Assessment Assessment $2,740.23 $648.94 $1,252.45 $5,637.25 $677.86 $1,734.85 $3,225.13 $805.82 $1,272.65 The highest assessments listed above are primarily due to the fact the lots are larger than typical, and in one case the property is a commercial enterprise which does not receive the same reductions as residential lots do. None of these three alleys have utilities that are being assessed to the abutting property owner. Financial Assistance Financial assistance is provided to low and moderate income families. The financial assistance provided is based on owner occupied income and size of household. Engineering follows a graduated scale which can provide between 20% and 100% assistance. A copy of this graduated financial assistance scale is attached. The top income limits on the scale follows the Housing Department's income guidelines for low to moderate households. Reduce the Interest Rate One the most contentious issues from property owners at public meetings is the 9% interest rate on special assessments. Many property owners feel the city's interest rate is much too high. A change in the interest rate benefits everyone who is assessed; businesses, landlords and homeowners. Below is a chart that shows a typical 3 assessment for an alley and the total cost at 9% and a hypothetical scenario in which the rate is set at 3 %. The annual cost is also listed. The property owner would realize a $600 savings over the 15 year term of the loan by the lower interest rate. Past Financial Assistance History Lower and moderate income property owners receive a reduction in their assessments based on income. This is further assistance along with a lower interest rate. Five street construction projects were looked at for financial assistance history. These five streets include: • White Street (21St to 32 "d) — 2004 • W. 5t" Street (Alpine to Delhi) — 2006 • Cleveland Avenue — 2009 • Bonson Road — 2007 • Rush Street - 2009 Attached is a comparison sheet that displays the assistance given on each of the projects. You will notice that White Street had close to 20% of the parcels qualify for financial assistance versus an 11% average for the other streets listed (W. 5th, Cleveland, Bonson and Rush). An additional chart is attached that shows the distribution of the financial assistance. On White Street, 30% of the applications qualified for 100% funding. On the chart the items shaded in yellow represent the four streets combined. These include West 5t" Street, Bonson Road, Rush Street and Cleveland Avenue. White Street is represented with tan shading. For example, at the 52% financial assistance level, White Street had one assisted property and the other streets combined had three assisted properties. At the 100% financial assistance level, White Street had 22 properties receive assistance the other four streets combined had 19 properties receive assistance. Based on data for the five street projects, the number of properties eligible for 100% assistance is 41. 4 ACTION TO BE TAKEN I respectfully recommend that the special assessment interest rate be reduced from 9% to 3 %, creating an opportunity for property owners to pay their assessments at 3% interest over 15 years.
