COMES NOW the Plaintiff, Mortgage Electronic Registration Systems, Inc., and
respectfully states to the Court the following as its cause of action against the Defendants:
1. The Plaintiff, Mortgage Electronic Registration Systems, Inc., elects to foreclose
without redemption pursuant to Iowa Code Section 654.20. The mortgaged property which is the

subject ofthis action is not used for an agricultural purpose. The mortgaged property is a one-
family or two-family dwelling.
2. The Plaintiff, Mortgage Electronic Registration Systems, Inc., is a corporation
duly authorized to transact business in the State ofIowa.
3. The Defendants, Wendy Weis f/kJa Wendy Galazin and Steven Weis, are a
malTied couple and are residents of Dubuque County, Iowa.
4. The Defendant, City of Dubuque, Housing & Community Development
Department, is joined as a party to this action because it may claim some right, title or interest in
the property which is the subject ofthis action including but not limited to by virtue of MOlt gage
dated August 3, 2004, and recorded August 16, 2004, in Instmment No. 14401-04. The
Defendant's rights to the property which is the subject of this action are junior to the Plaintiff.
5. The Defendants, Parties in Possession, are made parties to this cause of action
because they may claim some right, title or interest in the property which is the subject of this
action due to the fact that the Plaintiff is credibly infom1ed and believes that they may be tenants
in possession of the property the subject of this cause of action. The Defendants' rights to the
property which is the subject ofthis action are junior to the Plaintiff.
6. On or about May 28, 2004, the Defendant, Wendy Galazin n/k/a Wendy Weis,
executed and delivered to Mortgage Electronic Registration Systems, Inc., one certain
Promissory Note in the principal sum of Forty-nine Thousand Four Hundred Fifty-seven and
00/1 00 Dollars ($49,457.00). A copy of the Note is attached hereto as Exhibit "A" and by this
reference incorporated herein.

7. To secure payment of the Notc, the Defendant, Wendy Galazin n/k/a Wendy
Weis, executed and delivered to Mortgage Electronic Registration Systems, Inc. one certain
Purchase Money Mortgage datcd May 28, 2004, which Mortgage was filed on June 2, 2004, in
Instrument No. 9637-04 ofthe Dubuque County Recorder's Office, upon the following-
described real estate, to-wit:
The South 1/2 of all that part of Lot 36 in L. H. Langworthy's Addition in the City
of Dubuque, Iowa, lying Easterly of alley running through said lot, according to
the recorded plat thereof.
8. A copy of the Purchase Money Mortgage together with the Recorder's Certificate
thereon is attached hereto as Exhibit "B" and by this reference incorporated herein.
9. The Mortgage and Note is a Purchase Money Mortgage and provides that in case
of default the holder may declare the entire principal and the interest acemed thereon due and
payable and the Mortgage may be foreclosed.
10. The Defendant, Wendy Galazin nlkla Wendy Weis, has failed to pay the Note and
interest thereon as provided by the terms of the Note.
II. By reason of the failure to pay the Note and interest, the Plaintiff has elected and
does hereby elect in accordance with the terms and conditions of the Note and Mortgage to
declare the whole of the Note due and payable forthwith and to exercise its right to enforce
payment of the entire Note as provided by the Note and to foreclose the Mortgage givcn to
secure the same.
12. The unpaid balance due on the Note after allowing all credits due to the
Defendants is the sum of Forty-eight Thousand Four Hundrcd Eleven and 60/] 00 Dollars

{$48,4 I ] .ClOj, which is the principal halance, plus interest calculated at thc default rate of 6.500'%
per annum from April 1, 200Cl. Intercst accrues on the said sum at the rate of $8.62 per day.
13. In order to commence this foreclosure proceeding the Plaintiff has expended title
costs of $] 65.00, to which sum the Plaintiff is cntitled to a judgment against the property with
intercst at the rate of 6.500'% per annum, costs and accruing costs including but not limited to
any and all advances made by the Plaintiff for taxes, insurance, propel1y preservation and other
costs between the time of the Foreclosure Decree and the time of Sheriffs Sale, including
reasonable attorney's fees.
14. The Plaintiff is the owner and holder of the Note and Mortgage, due demand has
been made for payment, and payment has been refused.
15. Under the telms of the Mortgage a receiver may be appointed.
16. The Plaintiff gave a Notice of Right to Cure and more than thil1y (30) days have
elapsed since the notice was given. A copy of said Notice is attached hereto as Exhibit "C" and
incorporated herein by this reference.
] 7. The Plaintiff hereby waives their right to a defieiency judgment.
18. Under the ternlS of said Note and Mortgage, the Defendant, Wendy Ga]azin n/k1a
Wendy Weis, agreed to pay attorney's fces and all costs in conncction with the proceeding to
enforce or foreclose the Mortgage. Attached hereto as Exhibit "D" and incorporated herein by
this reference is an Affidavit of Attorney's Fees as required by Iowa Code S 625.22 (2003).
WHEREFORE, the Plaintiff, Mortgage E]ectronic Registration Systems, Inc., prays for
judgment in rem against the real estate described above, for the sum of F0l1y-eight Thousand
Four Hundred E]even and60IJ 00 Dollars ($48,4]] .(0), which is tne principal balance, plus

interest thereon at the rate of 6.500% per annum from April 1, 2006, such amount equaling $8,(,2
per day, the costs ofthis action, including title costs of$16S.00, reasonable attorney's fees ami
additional sums for continuing the abstract of title or other purposes authorized by said Note and
Mortgage and by Iowa law and that said sums be declared a lien upon the premises above
described from May 28,2004, the date of the Plaintiffs Mortgage, prior and superior to any
right, title, lien or interest of the Defendants or any of them therein; that the Plaintiffs Mortgage
be foreclosed; that any right, title, lien or interest of the Defendants or any of/hem in said
property be declared junior and inferior to the lien of Plaintiffs Mortgage; that a special
execution issue for the sale of/he mortgaged premises or so much thereof as may be necessary to
satisfy the judgment including interest, costs, and accruing costs including but not limited to any
and all advances made by the Plaintiff for taxes, insurance, property preservation and other costs
between the time of the Foreclosure Decree and the time of Sheriffs Sale, and that from and
after said sale under special execution, the right, title, lien or interest of the Defendants in and to
the mortgaged premises be forever cut off, barred and foreclosed, and the purchaser at said sale
take free and clear of any right, title, lien or interest of the Defendants or any of/hem.
The Plaintifffurther prays for a Writ of Possession to be isslied under the seal of this
Court, directed to the Sheriff of Dubuque County, Iowa, commanding him to put the purchaser at
said sale under special execution or a successor in interest in the possession of the premises; and
that a receiver be appointed to take charge of the m0l1gaged premises during the period of
foreclosure for the purpose of preserving the mortgaged premises for the benefit of all
concerned.
