Aaron Walling Claim
This is a claim for damage to Mr. Walling's automobile which he alleges he sustained
while driving on Chavenelle Road on October 4, 2013. His claim was referred to Public
Entity Risk Services (PERS) for investigation. PERS initially denied the claim for lack of
actual knowledge or constructive notice on the part of the City of the defect that alleged
to have caused the damage. Mr. Walling then appealed to the City Council for review of
his claim denial.
I have now reviewed the information provided by Mr. Walling with Street & Sewer
Maintenance Supervisor John Klostermann and Public Works Director Don Vogt. Street
Department crews patched Chavenelle Road a few days prior to Mr. Walling's accident.
Based upon the nature of the defect shown in the attached photograph, we agree that
City crews should have noticed this defect and repaired it prior to Mr. Walling's incident.
It is my recommendation that the claim in the amount of $1414.71 be paid. Mr. Vogt
and Mr. Klostermann concur in that recommendation.
