City Engineer Gus Psihoyos is recommending acceptance of the Dubuque Pack
Memorial Site Landscaping Project, as completed by Nauman Nursery, in the final
contract amount of $39,254.79, which is approximately 6% above the original contract
amount of $36,982.50. The landscaping included flagpoles, benches, sidewalk and
plantings. The increase is due to the anodizing of the three flagpoles for extended life,
colored mulch, and the addition of irrigation for all the plants.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Dubuque Pack Memorial Site Landscaping Project.
BACKGROUND
The Dubuque Pack Memorial Site Landscaping Project provided landscaping at the
recently installed memorial marker at the East 16th and Sycamore Street location. The
landscaping included flagpoles, benches, sidewalk and plantings.
In accordance with Iowa Code § 384.103 and § 364.12(3)(c), and Iowa Code, Section
26.14, on March 28, 2013 the City solicited informal bids for the Dubuque Pack
Memorial Site Landscaping Project. Nauman Nursery, Inc. of Dubuque, Iowa,
submitted the low bid in the amount of $36,982.50.
DISCUSSION
The Dubuque Pack Memorial Site Landscaping Project was completed by Nauman
Nursery of Dubuque, IA in the final contract amount of $39,254.79, which is
approximately 6% above the original contract amount of $36,982.50. The increase is
due to the anodizing of the three flagpoles for extended life, colored mulch, and the
addition of irrigation for all of the plantings.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $ 39,254.79 to Nauman Nursery for the Dubuque Pack Memorial
Site Landscaping Project.

RESOLUTION NO. 345 -13
ACCEPTING THE DUBUQUE PACK MEMORIAL SITE LANDSCAPING PROJECT
AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Dubuque Pack Memorial Site
Landscaping Project (the Project) has been completed and the City Engineer has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the City Engineer
recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the Bee
Branch Creek Restoration capital improvement appropriation for the contract amount of
$39,254.79 less any retained percentage provided for therein as provided in Iowa Code
chapter 573, and to pay such retainage only in accordance with the provisions of Iowa
Code chapter 573.
