SUBJECT: Acceptance of Public Improvements in Shady Oaks Subdivision Including
an Extension into Mt. Carmel Heights
City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, Tschiggfrie Excavating Co., has recently completed in Shady Oaks
Subdivision and an adjacent development in Lot 7 of Mt. Carmel Heights. Maintenance
of said improvements shall be the responsibility of the contractor and owner, Tschiggfrie
Excavating Co., for a period of two years from the date of acceptance.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Including an Extension into Mt. Carmel Heights
INTRODUCTION
The enclosed material provides for City Council acceptance of the public
improvements which the developer, Tschiggfrie Excavating Co., has recently
completed in Shady Oaks Subdivision and an adjacent development in Lot 7 of
Mt. Carmel Heights.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 54-95, the
developer of Shady Oaks Subdivision was required to install certain public
improvements including street paving with curb, sanitary sewer main, watermain,
storm sewers and catch basins, boulevard street lighting, and off-site detention
facilities and to dedicate these improvements to the City upon completion. In
conjunction with these improvements, the Sisters of Charity, BVM, requested the
City take over maintenance and ownership of a new 8" sewer they were installing
to new apartments on Lot 7 of Carmel Heights.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required
public improvements, the subdivider shall notify the City in writing of the
completion of the improvements, requesting that the City either approve or reject
the acceptance of the improvements, together with a statement of reasons for
any rejection.
On December 8, 2006, Tschiggfrie Excavating Co. requested City's acceptance
of the improvements in Shady Oaks Subdivision. On April 18, 1996, the Sisters
of Charity, BVM, requested City ownership and maintenance of sanitary sewer
improvements. Upon inspection by the City, it has been determined that all of the
public improvements required by Resolution No. 54-95 and those approved for
sanitary sewer to Lot 7 of Carmel Heights, have been completed in accordance
with plans approved by the City Council and in conformance with City
specifications. Sidewalk construction and tree removal, if necessary for
construction of the sidewalk, will be the responsibility of the abutting property
owner.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public
improvements. Maintenance of said public improvements shall be the
responsibility of the contractor and owner, Tschiggfrie Excavating Co., for a
period of two (2) years from the date of acceptance by the City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements.

ACCEPTING PUBLIC IMPROVEMENTS IN SHADY OAKS
SUBDIVISION INCLUDING AN EXTENSION INTO CARMEL HEIGHTS
Whereas, pursuant to Resolution 54-95, certain public improvements
including street paving with curb, sanitary sewer main, watermain, storm sewers
and catch basins, boulevard street lighting, and,off-site detention facilities were
installed by the developer of Shady Oaks Subdivision, inclusive of Lots 1 through
35, and Lot A, and Lot 7 of an extension into Lot 7 of Carmel Heights.
Whereas, the improvements have been completed and the City Manager
has examined the work. and has filed a certificate stating that the same has been
completed in accordance with the plans approved by the City Council and in
conformance with City specifications, and has recommended that the
improvements be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE:
Section 1. That the recommendation of the City Manager be approved
and that said public improvements in Shady Oaks Subdivision and the extension
into Lot 7 of Carmel Heights be and the same is hereby accepted.
Section 2. That the construction of sidewalks, including the removal of
trees within the right of way, if necessary, is the responsibility of the property
owner abutting said right of way.
Section 3. That maintenance of said public improvements shall be the
responsibility of the contractor and owner for a period of two (2) years from this
date.
