The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed lot layout and noting easements for future extension of utilities and access. Staff reviewed the staff report, reviewing the location of the property, lot layout and need to waive lot frontage requirements for Lots 1, 2 & 4 on Freedom Ridge Drive, that Lot 1 is zoned Agricultural, and Lot 4 is designated as non - buildable. Staff reviewed the location of the subdivision relative to the Southwest Arterial alignment. There were no public comments. The Zoning Advisory Commission discussed the request, and felt it was appropriate. Recommendation By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve the request subject to waiving lot frontage for Lots 1, 2 & 4. A simple majority vote is needed for the City Council to approve the request. SUBJECT: Final Plat Freedom Ridge Estates Plat 2, Dubuque County INTRODUCTION The submitted Final Plat of Freedom Ridge Estates, Plat 2 is located at the end of Freedom Ridge Drive which connects with Oakland Farms Road in Dubuque County, south of the city of Dubuque. The subject plat is within two miles of the city of Dubuque, and is being jointly reviewed by the City and County of Dubuque. DISCUSSION The submitted Final Plat Freedom Ridge Estates, Plat 2 subdivides the existing Lot 1 and Lot 5 of Freedom Ridge Estates into four new parcels. This plat facilitates the sale of a portion of the property to another buyer, and creates a new building lot for the property owners, John and Tina Perry, to build a new home. Freedom Ridge Estates Subdivision was originally approved in November 2003. The original subdivision created seven Tots, six of them house lots. The submitted Final Plat is considered a minor subdivision and is not subject to the City's 40 points of sustainability requirement in Section 11 of the City's Unified Development Code. The original subdivision, when platted, provided for adequate utility easements to facilitate the extension of City water and sewer to this subdivision in the future. The City of Dubuque has no immediate plans to annex this area; however, the subject property can be served with City utilities in the future, and the easements will reduce the time and expense of connecting these parcels into the City utility systems. The submitted Final Plat of Freedom Ridge Estates, Plat 2 does require that lot frontage be waived for Lots 1 and 4, and a partial waiver for Lot 2. Lot 1 is not anticipated to be built on because of topography and flood plain conditions impacting the lot. In addition, the property is currently zoned Agricultural in the County. Lot 4 is labeled is unbuildable and would require that a new plat be filed, reviewed, and approved prior to any new house being built on that lot. Lot 2 is substandard in terms of frontage as it only has 31 feet of frontage where 50 foot of frontage is required by the Unified Development Code. Memo to Zoning Advisory Commission Final Plat Freedom Ridge Estates Plat 2 Page 2 Planning staff does not object to the waiving of total lot frontage requirements for Lots 1 and 4 as neither lot can be built on as they are currently configured. While Lot 2 does not have the required 50 -foot of lot frontage, it does have sufficient lot frontage to provide adequate access to the site. Attached to this memorandum is a map depicting the alignment of the Southwest Arterial with the property included in the submitted Final Plat of Freedom Ridge Estates Plat 2 highlighted in red. No portion of the applicant's property will need to be purchased for right -of -way purposes. RECOMMENDATION Planning staff recommends that the final Plat of Freedom Ridge Estates, Plat 2, Dubuque County, Iowa be approved subject to waiving lot frontage requirements for Lots 1, 2 and 4. The submitted Final Plat is in all other respects compliant with the City of Dubuque Subdivision regulations contained in the Unified Development Code.
