Description: To rezone property from R-2 Two-Family Residential District to R-1 Single-
Family Residential District.
Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed rezoning.
Staff reviewed the request, noting that the Commission recently rezoned this parcel from
R-1 to R-2. Staff indicated that the applicant, David Hartig, recently purchased the
subject parcel and wished to have it rezoned back to R-1 to function as a buffer and a
detriment to future rezoning requests to multi-family zoning.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the requested
change will not adversely impact surrounding property.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The property was subdivided in the County in the early 1900's and a
single-family residence was built at this location in 1920. The building served as a
single-family home until recently when it was abandoned, fell into disrepair, and has
been removed. The second parcel was originally an undeveloped residential building
lot that was purchased by the Morocco Supper Club and used for expansion of their
parking area.
Physical Characteristics: The subject parcel totals 2,614 square feet. The lot is
landlocked and lies along a wooded bluff. The lot is sloped to the west and drops to the
Catfish Creek valley.
Concurrence with Comprehensive Plan: Goals outlined in the Comprehensive Plan
state, "To buffer and protect incompatible uses from each other."
Impact of Request on:
Utilities: The lot has been labeled "non-buildable" and, therefore, should have little
impact on utilities
Traffic Patterns/Counts: lOOT 2005 Annual Average Daily Traffic Counts indicate
3,130 vehicle trips per day along Rockdale Road by the subject property.
Public Services: Existing public services should not be affected.

Environment: Staff does not anticipate any adverse impact to the environment as
the lot will not be developed.
Adjacent Properties: Staff does not anticipate any adverse impact to the adjacent
properties as the lot will not be developed.
CIP Investments: None proposed.
Staff Analysis: The applicant is proposing to rezone a 2,614 square foot parcel from
R-2 Two-Family Residential district to R-1 Single-Family Residential district. The two
lots that this parcel is a part of were recently rezoned from R-1 to R-2. The parcel is
substandard in that it is less than 5,000 square feet in area and has no frontage. The
Zoning Board of Adjustment has reviewed and approved the substandard lot. The lack
of frontage and small lot area were not deemed a problem because the lot is located
along a steep, wooded hillside and has been labeled non-buildable.
Rezoning this property to R-1 Single-Family Residential should have very little impact
on the neighborhood.
Staff recommends that the Commission review the criteria established in Section 6-1.1
regarding zoning reclassification.

ORDINANCE NO.77- 06
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 1331 ROCKDALE
ROAD STREET FROM R-2 TWO-FAMILY RESIDENTIAL DISTRICT TO R-1
SINGLE-FAMILY RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassifying the hereinafter-described
property from R-2 Two-Family Residential District to R-1 Single-Family Residential
District, to wit:
Lot 2 Heiar Place, and to the centerline of the adjoining public right-of-
way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.
