Code of Ordinances adoption DU~~E ~ck~ MEMORANDUM December 13, 2006 TO: The Honorable Mayor and City Council Members FROM: Michael C. Van Milligen, City Manager SUBJECT: City of Dubuque Code of Ordinances Assistant City Manager Cindy Steinhauser, City Attorney Barry Lindahl and City Clerk Jeanne Schneider recommend that the City Council conduct a public hearing on December 18, 2006, to consider approval of the revised Code of Ordinances. An ordinance re-adopting the Code of Ordinances will be presented at the January 16, 2007 City Council meeting upon completion of the thirty day review period. Those changes which were considered to be basic "clean up" of outdated language and to bring the City Code into compliance with the Code of Iowa were approved by the City Council on August 21,2006. Proposed changes to Chapter 31 - Licenses and Miscellaneous Regulations and Chapter 35 - Peddlers and Transient Merchants were approved by City Council on October 2, 2006; and Chapter 6 - Amusements and Chapter 15 - Community Development were approved by the City Council on November 6, 2006. Schneider, City Clerk SUBJECT: City of Dubuque Code of Ordinances Backaround In 2003, we began a comprehensive review of the Code of Ordinances. Participating in every meeting was City Attorney Barry Lindahl, City Clerk Jeanne Schneider and Assistant City Manager Cindy Steinhauser. We also met with the Department Manager responsible for the enforcement of each chapter being reviewed. During each meeting, we reviewed and provided direction on the recommendations made by our code publishers, Sterling Codifiers, reviewed each chapter for compliance with the Iowa Code, and formulated other recommendations where appropriate. Discussion Those changes which were considered to be basic "clean up" of outdate language and to bring the City Code into compliance with the Code of Iowa were approved by the City Council on August 21, 2006. The Iowa Code requires a public hearing on the adoption of a code of ordinances. In accordance with Code of Iowa Chapter ~ 380.8, the revised Code will be on file in the City Clerk's Office for public review. Reauested Action The requested action is for the City Council to conduct a public hearing to consider approval of the revised Code of Ordinances. Any public comments received following the public hearing regarding the proposed changes, and an ordinance adopting the revised Code of Ordinances will be brought to the January 16, 2007 City Council meeting for adoption.
