SUBJECT: Vacating Petition -Unnamed Street between 640 and 650 Kane Street
In response to a request from Tim Schmit II to vacate an unnamed street between 640
and 650 Kane Street, City Engineer Gus Psihoyos states that the City has no plans for
the utilization of the unnamed street between 640 and 650 Kane Street, that no public
utilities exist in this parcel and recommends approval of the request to vacate. Three
abutting properties owners, Irene Schueller, Roger Lindecker and Tim Schmit II will
each purchase a portion of the property being vacated, and it is recommended that the
purchase price be established at $300 for each, plus surveying, platting, publication and
filing fees.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
A request has been received from Tim Schmit II for the vacating of an unnamed street
between 640 and 650 Kane Street.
DISCUSSION
The area to be vacated is divided into three lots numbered Lots 4A, 46, and 4C of
Kieffer Place in the City of Dubuque, Dubuque County, Iowa. These lots comprise the
existing 40-foot wide right-of-way on which no public utilities exist.
Currently this right-of-way is used as a portion of a paved drive for 640 Kane, a gravel
drive for 650 Kane, some lawn area, and steep wooded hillside. Irene Schueller will
retain a small triangular-shaped lot which encompasses her existing driveway. Richard
Wieser, at 611 Kaufmann Avenue, was not interested in his portion of the area to be
vacated. Roger Lindecker at 615 Kaufmann Avenue will purchase half of the right-of-
way abutting his lot. The remainder will go to Mr. Schmit.
Because of the rough terrain and possible future maintenance expenses for the City, a
purchase price of $300 for each lot, plus surveying, platting, publication, and filing fees
was agreed upon with the parties involved.
RECOMMENDATION
I would recommend that this unnamed street between 640 and 650 Kane Street, as
shown on the attached plat, be vacated, and that a public hearing be held for the
disposition of the City's interest in the subject area on January 3, 2007. I would further
recommend that the purchase price be established at $300 for each lot, plus surveying,
platting, publication and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be held on the disposal of the property through the adoption of the enclosed
resolutions.

RESOLUTION APPROVING PLAT OF PROPOSED VACATED UNNAMED
STREET BETWEEN 640 AND 650 KANE STREET
Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated the 20th day of November, 2006, prepared by Buesing & Associates,
Inc., describing the proposed vacated unnamed street between 640 and 650 Kane
Street; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the plat dated the 20th day of November, 2006, prepared by
Buesing & Associates, Inc., relative to the real estate hereinabove described be and the
same is hereby approved, and the Mayor and City Clerk be and they are hereby
authorized and directed to execute said plat for and on behalf of the City of Dubuque,
Iowa.

and assigned lots number thereto, which hereinafter shall be known and described as
Lots 4A, 4B, and 4C of Kieffer Place in the City of Dubuque, Dubuque County, Iowa;
and
Whereas, the City Council of the City of Dubuque, Iowa has determined that this
an unnamed street between 640 and 650 Kane Street is no longer required for public
use and vacating of said an unnamed street between 640 and 650 Kane Street, known
as Lots 4A, 4B, and 4C of Kieffer Place in the City of Dubuque, Dubuque County, Iowa,
should be approved.
